In 2003, the first modification to the conceptual PD (CUP -03-014) included the approval of 122,000 square feet of commercial and 52,250 square feet of office space and detailed approval of 96 apartment units, Also in 2003, a second modification to the conceptual PD (CUP -03-054) increased the office component by approximately 35,000 square feet and reduced the commercial/retail component by approximately 18,000 square feet. In 2004, CUP -04-049, a detailed CUP, granted approval for the construction of four commercial buildings, totaling approximately 25,600 square feet of retail space, on two platted lots, Lott and a portionof Lot 4, Block 3, Devon Park Subdivision No. 1. Banner Bank has already been constructed on said Lot 1 In 2005, CUP -05-035, a detailed CUP, granted approval for the construction of a restaurant, totaling approximately 4,200 square feet, on Lot 2, Block 3, Devon Park Subdivision. Said lot 2now hosts Smoky Mountain pizza. In 2007, CUP -06-032, a detailed CUP, a modification of CUP -04-049, granted approval of a new development plan (site plan & building elevations) for Lots 3 and 4, Block 3, Devon Park Subdivision No. 1. A Certificate of Zoning Comp[liance (CZC-07-027) was approved for retail building Y2 on the subject property in 2007. The site plan and building elevations submitted with the CZC varied from the site plan approved with CUP -06-032 but were deen=med to substantially comply with those previously approved. In 2009, MCU -08-002, a modification to CUP -06-032 that only applied to the previously mentioned retail buildings approved on the northeast portion of Lot4, Block 3, Devon Park Subdivision No. 1. Fairview Lakes is requesting the modification of two items: 1. As approved under CUP 04-049, Exhibit H, standards for conditional use Item B. The current Comprehensive Plan text policy required that all development to proceed through a CUP. The development is zoned CG, under the current zoning ordinance all approved commercial uses can be approved with a Certificate of Zoning Compliance and staff level design review only. 2. As approved under ( CUP -02-014) the applicant was required to provide (2) site amenities. A pedestrian corridor was provided through the development. (CUP 06-032) detailed a court yard and pond amenity. Because of the addition of the daycare the fountain would become an attractive nuisance. Fairview Lakes is proposing that the pond be eliminated.
