The site is 1.96 acres in size and located at the southwest comer of W. Cherry Lane and N. Summertree Way, 4275 W. Cherry Lane, Meridian, Idaho. We are proposing to develop 10 single family lots and 4 common lots. The property is currently zoned R- 4. The gross density for the project is 5.1 dwelling units per acre. Access to the site is via Summertree Way. All utilities are available to the site. All streets are proposed to public streets. The property has surface water irrigation rights from the Nampa -Meridian Irrigation District and a pressurized system will be installed. Rezone We have been approved for a rezone from the existing R-4 to R-8. Easement Vacation We have been approved for the vacation of the existing sanitary sewer drain field recorded in the Hearthstone Subdivision as described in Note 6 of the Plat (Lot 2, Block 1 contains an easement for a sanitary sewer drain field which serves Lot 1). Davis and Mildred L. Davis, husband and wife, conveyed a thirty (30) foot wide easement for ingress and egress to Gene and Terri Jones which Ingress/Tigress Easement was recorded with the Ada County Recorder as Instrument Number 100040637 on May 25, 2000; WHEREAS, the Ingress/Egress Easement provided direct access to West Cherry Lane; WHEREAS, the Turpins whose street address is 1490N. Jones Creek Lane, Meridian, Idaho 83642 are the current property owners which enjoy the Ingress/13gress Easement referenced above; WHEREAS, CS2, LLC is the current fee owner of the property which Is subject to the Ingress/Egress Easement referenced above; WI-MREAS, CS2, LLC desires to and has obtained preliminary plat approval from the City of Meridian to develop its property commonly referred as the Reardon Subdivision; WHEREAS, as a condition of the final plat approval, the Ada County Highway District ("ACHD") required CS2, LLC to construct and dedicate a public roadway through its property and close the.direct access to West Cherry Lane by extinguishing the Ingress/Egress .Easement; WHEREAS, CS2, LLC has prepared a preliminary plat drawing depicting the public roadway which traverses across CS2, LLC's property and encroaches the Ingress/Egress Easement area which will provide the Turpin an alternative means of access to West Cheng Lane. Attached hereto and incorporated herein by reference is a copy of the preliminary plat depicting the easement as N. Jones Creek Lane and the new public roadway referred as West Jones Creek Drive, marked as Exhibit A which attached hereto and incorporated herein by reference; W14EREAS, CS2, LLC and the Turpin desire to avoid litigation by fully and finally resolving all issues associated with the Ingress/Egress Easement, in accordance with the terms of this Agreement. AGREEMENT TO VACATE EASEMENT AND RELOCATE ACCESS -I TERMS AND CONDITIONS NOW, THEREFORE, in consideration of the mutual promises, terms, obligations and undertakings set forth herein, and other good and valuable consideration, the sufficiency and adequacy of which is hereby acknowledged, C82, LLC and the Turpin agree as follows: L The Parties incorporate into this Agreement, as part of the term of this Agreement, the "Recitals" set forth above. 2. C82, LLC agrees to pay the Turpins the sum amount of Two Thousand Five Hundred and 00/100 Dollars ($2,500.00) in exchange for the Turpins vacating any and all right, interest and/or title to the Ingress/Egross Easement referenced above which property encumbered by said easement shall revert back to CS2, I.IX's fee ownership. 3. ]n addition to the foregoing payment and the Turpins' agreement to vacate the Ingress/Egress ,Easement, C82, LLC agrees upon the recording of the final plat to quitclaim a portion of its property to the Turpins, more particularly described in Exhibit 13, collectively, which is attached hereto and incorporated herein by reference, which property shall provide the Trupins' property a direct means of access to the public roadway as depicted on the recorded final plat. 4. Further, the Turpins will grant a perpetual easement to CS2, LLC and/or its assigns and successors for the benefit of the lot owners in the Reardon Subdivision for a pump station to be generally located at the northeast corner of the Turpins' property as reflected in Exhibit A herein and more particularly described as Exhibit C, collectively, attached hereto and incorporated herein by reference. With regards to the foregoing easement relating to the pump station, the parties agree to the following terms and conditions: A) The area encompassing the easement shall not exceed 12' X 12' and be enclosed by a perimeter fence connecting to the existing easterly fence; E) Access to the pump station shall be accessible from N. Stmimertree Way; C) CS2, LLC shall tie the'furpins' into the Reardon Subdivision's pressurized irrigation system with a 2" service valve which includes a backflow preventer to protect the Turpins' well; D) CS2, LLC shall also install a second 2" service valve to service the Turpins' pasture; E) CS2, LLC shall be responsible, at its sole expense, for the installation of the fence, installation of the 2"service valves mentioned above, for the construction AGREEMENT TO VACATE EASEMENT AND RELOCATE ACCESS - 2 of the pump station, for pump operations and for all maintenance and repairs to the pump station; P) CS2, LLC acknowledges and agrees that lot owners of the Reardon Subdivision will be solely responsible for any costs and/or assessments assessed by Settler's Irrigation Company from the pressurized irrigation water serving their respective properties; G) The Tenpins acknowledge and agree that they will be solely responsible for any costs and/or dues assessed by Settler's Irrigation Company for their gravity irrigation rights which serves their land; and 1.1) CS2, LLC and the Turpin agree that this Agreement runs with the land and is binding upon them and their respective successors azul/or assigns, including any future Homeowner Association created by C82, LLC for the benefit of the Reardon Subdivision. 5. The Parties acknowledge and understand that CS2, LLC will use its best efforts and work with the City of Meridian to rename the new public roadway as West Jones Creek Way so that the Tutpins can maintain their current physical address. However, the Parties acknowledge and understand that CS2, LLC has no control over the naming of the public roadway and such control is vested with the City of Meridian which may object or desire a different naming of the new public roadway, 6. Each Patty hereby agrees to perform all further and necessary acts and to execute and deliver all further documents reasonably necessary to or in furtherance of the intent and purposes of this Agreement without demand for fittther consideration. This Agreement shall be governed and construed in accordance with the laws of the State of Idaho in all respects, including matters of consuuction, enforcement and performance.
