I E IDIAN DATE: June 6, 2014 TO: Renny Wylie FROM: Bill Parsons, Associate City Planner SUBJECT: Knighthill Center Multi -tenant Buildings - CZC-14-053 & DES -14-048 OWNER: Renny Wylie DESCRIPTION OF APPLICANT'S REQUEST The applicant, Renny Wylie, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct two (2) 7,106 square foot multi -tenant buildings within the Knighthill Center Subdivision. The site consists of 9.1 acres of land in the C -G zoning district and is located on the southwest corner of Chinden Boulevard and N. Linder Road. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 2. Business hours of operation within this development (C -G district) shall be limited from 6 am to I 1 pm as set forth in UDC 11-213-3A4. 3. Prior to the issuance of the building permit, the applicant shall record the Knighthill Center final plat. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-311- 14A. 4. The site plan prepared by JGT Architecture, dated May 28, 2014, labeled DR 1.0; is Conditions Document 1 Knighthill Center Multi -tenant Bldgs - CZC44-053 DES -14-048 approved on June 6, 2014 by the City of Meridian Planning Division with the following changes: a. A 5 -foot wide pedestrian walkways must be provided from the perimeter sidewalk to the main building entrances and distinguish the walkways from the vehicular driving surface through the use of pavers, colored or scored concrete, or bricks, per UDC 11 -3A -19A.4. 5. The landscape plan prepared by Mason and Stanfield, dated May 29, 2014, labeled sheets 1 and 2, is approved on June 6, 2014 by the City of Meridian Planning Division with the following changes: a. Provide a detail of the open plaza area located in the southwest corner of the development prior to the issuance of a building permit. b. All required landscape areas must be at least 70% percent covered with vegetation at maturity in accord UDC 11 -3B -5N. 6. The elevations prepared by JGT Architecture, dated May 28, 2014, labeled DR -3.0, are approved on June 6, 2014 by the City of Meridian Planning Division with the following changes: a. All roof top mechanical equipment shall be screened to the height of the unit as viewed from the farthest edge of the adjoining right-of-way in accord with UDC 11-3A-19A.1e. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACED requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. If the subject property is part of a final plat that has not yet recorded, the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -14-004; FP -14-020; PP -13-031; DA #114014784). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 23, 2014, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Chinden Boulevard and N. Linder Roads. The project under consideration is a multi -tenant commercial building located on Lot I which faces N. Linder Road to the east. The 14,212 SF multi -tenant building has been designed around a central outdoor plaza or courtyard (outdoor space); therefore, each section of building is 7,106 SF. The outdoor space will act as pedestrian access and area that can be used and enjoyed by the project tenants and customers. The site has been designed for parking on both the front and rear sides to minimize large expanses of asphalt and to encourage pedestrian access. The site has also been designed to accommodate a drive-through lane along the south side of the building. The owner is requesting conditional use approval of the drive-through lane due to proximity to the existing residential use to the south. Site circulation has been designed for one-way traffic through and around the drive-through lane to avoid traffic circulation conflicts. A landscape buffer will be constructed along the southerly drive lanes for separation to the residential to the south. The landscape buffer will be planted with evergreen trees to maximize buffering of sound and light. Another internal road is located on the westerly side of lot 1. Again, a landscape strip will be provided along with an outdoor gathering space used for pedestrians. The site will be properly landscaped and lighted for public enjoyment and safety. The multi -tenant building fagade primarily addresses N. Linder Road, however, the same architectural character and detailing continues on all sides of the project. The design creates a visual interest by breaking up the store entrances with decorative canopies and modulating elevation changes. The exterior has been designed using a combination of upscale, durable materials. Porcelain tile cladding, stucco finishes with accent relief, and metal canopies will create a new and inviting place for commercial business growth.
