DESCRIPTION OF APPLICANT'S REQUEST The applicant, Randy Arnzen, requests Certificate of Zoning Compliance (CLC} approval of a professional office use and for site improvements on .22 acres of land in the C-C zoning district. Furthermore, the applicant requests Alternative Compliance (ALT} approval fox a reduction to the required street landscape buffer adjacent to Meridian Road. The site is located at 1308 N. Meridian Road. ANALYSIS OF I1DC REQUIREMENTS RELATEll TO SITE SPECIFIC (yONDITIONS: The applicant requests alternative compliance to UDC Table 11-2B-3 which requires a 25 foot wide street buffer adjacent to arterial streets. The applicant proposes to construct a 13 foot wide buffer along N. Meridian Road instead of a 25 foot wide buffer as required. Because a buffer currently does not exist on the site, an alternative means of coxnplying with the intended purpose of the requirement, the applicant proposes to install a buffer adjacent to N. Meridian Road. The reason for the request is because the required 25 foot wide buffer would limit accessibility to the property given the size of the lot. In addition, the requested landscape buffer reduction would be generally consistent with neighboring properties. In order to grant approval far alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Because of site constraints and the reduction in usable area of the property, the Director Ends strict adherence to UDC Table 11-2B-3 is not feasible. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's alternative means far meeting the requirements of the Conditions Document 1 Arnzen Building - CZC-14-022 and ALT-14-004 UDC as discussed above provides an equal or superior means of compliance as a required buffer does not currently exist on the site and the site is currently developed. The proposed buffer is retrofit to accommodate existing site conditions to enhance site design. ~. The alternative means will not be matex•ially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. Business hours of operation uTithin the L-O and C-N districts shall be limited fiom 6 am to IO pm as set forth in UDC ll-2B-3A4. Process Conditions of Approval 1. Per UDC 11-3B-7Clc and 11-SB-SB2, the Director (at the applicant's request) approved alternative compliance regarding the reduced street buffer along n. Meridian Road. See Analysis above fot more information. 3. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall. submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 4. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-5C-3C. S. LJpon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in LJDC 11- 3B-14A. 6. The site/landscpae plan prepared by CAD Services, Inc. and stamped by Du Rite Nursery, Inc., on March 21, 2014, labeled 1.0, is approved (stamped "approved" on April 2, 2014 by the City of Meridian Planning Division) with the following changes; One decidzco~ts t~°ee shall beplanted in the buffer along Meridian Xoad. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 11 Ongoing Conditions of 1lpproval 4. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. 5. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 6. The applicant and/or property owner shall have an ongoing obligation to pz-une all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed featuz•es within the clear vision triangle consistent v,~ith the standards in UDC 11-3A-3. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before April 18, 2014, within. fzfteen (15) days after the written decision is issued, and contain the information listed in UDC 11~SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatozy taping analysis under Idaho Code 67-8003. Conditions Document 3 ,Arnzen Building - CZG14-022 and ALT-14-004 10. The applicant shall complete all required irnpzavements prior to issuance of a Ceztificate of Occupancy. Tt is unlawful to use oz• occupy any building or structure until the Building Oiiicial has issued a Certificate of Occupancy. . The applicant and/or assigns shaIl have the continuing obligation to provide izrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3I3-5, UDC 11-3B-13 and UDC 11-3B-14. EXYIIZATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certif cafes of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
