GARY LANE ···· BOISE, IDAHO 83714 (208) 861-5220 ···· BUNGER@ULCMANAGEMENT.COM MEMORANDUM OF UNDERSTANDING March 31, 2014 This a Memorandum of Understanding is between CS2, LLC (Developer), the developer of Bienville Square #3 (Centre Point Square) and the Jackson Square Homeowners Association (Association), Lots 1-22 & Lot 24, Block 1, and Lots 1-35, Block 2 of Bienville Square Subdivision a recorded Plat in Book 102 of Plats at Pages 13,495 thru 13,498 in the records of Ada County, Idaho, where as the following items are memorialized: 1. The Developer agrees to prepare and record such legal documents to remove the Association from any maintenance obligations and liability for the private roads (E. Picard Lane, E. Bourbon Lane, N. Cajun Lane) located within Bienville Square Subdivision. Said document to be approved by the Association and recorded prior to Final Plat approval by The City of Meridian. 2. The Developer agrees to install two (2) Meridian Fire Department approved traffic calming devices (Speed Cushions) on E. Picard Lane and one (1) Meridian Fire Department approved traffic calming devices (Speed Cushions) on E. Bourbon Lane as a part of the Centre Point Square construction. These Speed Cushions are to be installed as a deterrent to “cut through traffic” and to facilitate the reduction of vehicular speed on E. Picard Lane and E. Bourbon Lane. 3. The Developer agrees to make repairs to the existing pathway located on Lot 22, Block 1, Bienville Square Subdivision where adjacent to the proposed Centre Point Square development. 4. In exchange for the Developer agreeing to items 1-3 above, the Association agrees to support the Developer’s applications (PP 13-042 and MDA 13-025) currently before The City of Meridian. The Developer agrees that items 1-3 above may become a part of the PP 13-042 Application “Conditions of Approval” to assure that these items are completed prior to Final acceptance of Centre Point Square development by The City of Meridian. ____________________________ _____________________________ Cory Swain Date Date Manager, CS2, LLC President, Jackson Square HOA
