AMOUNT ,00 1111111111111111111111111111111111111 104027943 CITY OF MERIDIAN ORDINANCE NO. 04- 1&67 AN ORDINANCE FlliTIING THAT, CARL REITERMAN AND BONNIE REITERMi'lN, THE o\VNERS OF CERTAIN REAL PROPERTY GENERALLY LOCA TED ON THE WEST SIDE OF LOCUST GROVE, SOUTH OF EAST McMILLAN ROAD, MERIDIAN, IDAHO, TO BE KNOWN AS RAZZBERRY CROSSING SUBDNISION AND WHICH LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF LDAHO; HAVE MADE A REQUEST FOR ANNEXATION IN WRITING TO THE COUNCIL; AND THAT SAID LAND BE ANNEXED TO THE CITY OF MERIDIAN AND ZONING DESIGNATED MEDIUM DENSITY RESIDENTIAL DISTRICT (R-8) AND LIMITED OFFICE DISTRICT (L-O); AND DECLARING THAT SAID LAND, BY PROPER LEGAL DESCRIPTION AS DESCRlBED BELOW, BE A PART OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF MERIDIAN, IDAHO; AND DIRECTING THE CLERIZ OF THE CITY OF MERIDIAN TO FILE A CERTIFIED COpy OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH ADA COUNTY RECORDER, ACDITOR, TREASURER AJ\D ASSESSOR, AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE SECTION 50-223 AND SECTION 63-2215. BE IT ORDAINED BY THE MAYOR AND THE COLJl\JCLL OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO: SECTION I. FINDINGS: That the following described land is contlgLloLls and adjacent to the City of Meridian, Idaho, and that the City of Meridian has received a written request for annexation to the City of Meridian, Idaho, by the owners of said Property, to-wit: ANNEXATION AND ZONING ORDINANCE (AZ-O3-034) - 1 LEGAL DESCRIPTION RAZZBERRY CROSSING ANNEXATIOl\ DESCRIPTIOl\ A parcel of land being a portion of Lot 10, of Crestwood Subdivision No. l, as filed in Book 28 of Plats at page 1757, Records of Ada County, Idaho, and Locust Grove Road located in the Northeast V. of Section 31, T.4N., R.lE., B.M., Meridian, Ada County, Idaho, and being more particularly described as follows: Commencing at an aluminum cap monument marking the Northeast corner of said Section 31, from which the East II, comer of said Section 31 bears S 00"33 '41" W, 2659.03 feet; thence along said East boundary line, S 00"33'41" W, for a distance of 1329.42 feet; thence leaving said East boundary line, N 89"46'30" W, for a distance 01'33.00 feet to the Northeast corner of said Lot 10; thence continuing N 89"46'30" W along the North boundary of said Lot 10, for a distance or' 208.71 feet to the REAL PO1è'JT OF BEGfNN1NG; thence continuing along said North boundary N 89"46'30" W, for a distance of 1404.26 feel to a point on the South boundary ofHavasu Creek Subdivision No.2 as filed in Book 87 of Plats at Page 9875 of Ada County Records; thence S 00034' 16" W along the West boundary line of said Section 10, for a distance of 332.50 feet to the Southwest comer of said Lot 10 (fonnerly described as S 00°02'20" W, 332.36 feet); thence S 89°43 '01" E along the South boundary of said Lot 10, for a distance of 328.99 feet to a 5/8 inch diameter iron pin marking the Northwest comer of Lot 11 of said Crestwood Subdivision No.1 (formerly described as N 89°39'49" E, 329.31 feet); thence S 89°47' 46" E continuing along the South boundary of said Lot 10, for a distance of 1317.04 feet to the East boundary of said Section 31; thence N 00°33' 41" E along said East boundary, for a distance of 123.64 feet; thence leaving said East boundary N 89°46'30" W, for a distance of 241.71 reet; ANNEXATION AND ZONING ORDINANCE (AZ-03-034) - 2 thence N 00°33'41" E, for a distance of208.71 feet to the North boundary of said Lot 10, and the REAL POINT OF BEGINNING, containing 11.41 acres ofland, more or less. SECTION 2: That the above-described real property be, and the same is hereby annexed and made a part of the City of Meridian, Ada County, Idaho. SECTION 3: That the real property herein by this ordinance annexed to the City oL'v!eridian hereinabove described shall be zoned Medium Density Residential District (R-8) and Limited Office District (L-O). SECTION 4: That the City Engineer is hereby directed to alter all use and area maps as well as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City of Meridian in accordance with this ordinance. SECTION 5: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6 This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. SECTION 7 The Clerk of the City of\1eridian shall, within ten (10) days following the days following the effective date of this ordinance, duly tile a certitied copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries oCtile City of Meridian, including the lands herein annexed, with the following officials of the County of Ada, State ofIdaho, to- wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance and map with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63-2215 and §50-223.
