Our request is for an extension of the period of the CUP for an additional 18 months. As we have explained in our previous applications the end result of the mining and final reclamation and grading of the site by Idaho Sand will result in lowering of the base elevations over much of the property so that it is ready to be developed in accordance with the approved residential entitlements. Idaho Sand's work on the site will result in a residential development that is more compatible with the neighbors to the South. As we have stated in our previous applications and hearings, the mining and final grading of this site by Idaho Sand and Gravel for the property's ultimate residential use is a market driven process. There is approximately ten to fifteen percent of the material remaining to be mined from the site. Idaho Sand would like an additional sixty days to complete the processing and crushing of this remaining material. Those sixty days could commence upon the approval of this time extension request or be designated to occur during the winter or spring months when the soils are more damp. Although Idaho Sand would optimally request to be allowed the additional sixty days to crush the remaining material we acknowledge the concerns of some of the neighbors in the area has primarily been with the impacts associated with the crushing. If the city is not inclined to grant the time extension for the crushing of the remaining material to be mined then Idaho Sand is willing to forgo that request. Idaho Sand would mine the remaining material from the site without further crushing occurring on the property and have it crushed elsewhere if needed. Idaho Sand is not proposing to change any of the other existing conditions under the previous CUP. Idaho Sand is willing to be subject to a stipulation that no further time extensions will be applied for or granted to complete the mining of the site. Idaho Sand also states that the final grading and reclamation of the site will completed within the 18 month time extension requested. The reclamation Meridian Development Corporation March 25, 2014 Page 2 and grading of the site is not part of the mining of the sand and gravel but involves removing mined material and shaping the surface of the site following completion of the mining so that the site is ready for residential development. The Idaho Sand recognizes that only the mining is subject to a requirement for a Conditional Use Permit and is not waiving any rights it has to complete the reclamation and grading of the site; however, should the CUP extension be granted Idaho Sand will complete the final reclamation and grading of the site within the confines and operational conditions placed on the CUP. Approval of this application for an extension of time allows for the completion of the grading and reclamation that must be completed on the property to be completed subject to the conditions of and additional protections contained in the CUP.
