APPLICATION SUMMARY The applicant, Gary Lawson, is requesting approval to vacate two 5-foot wide public utility, drainage, and irrigation easements on the shared lot line between Lots 3 and 4, Block 3 of Leisman Addition Subdivision. 2. STAFF RECOMMENDATION Staff recommends approval of the subject vacation application. 3. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located east of N. Linder Road and north of W. Pine Avenue in the northwest Y4 of Section 12, Township 3 North, Range 1 East. (Parcel #'s: 85299980140 and 85299980130) B. Owner(s): Martin Landholm 2000 Blossom Place Meridian, Idaho 83646 C. Applicant's Statement/Justification: Please see applicant's narrative for this information and the application file for the applicable relinquishment approvals. 5. PROCESS FACTS The subject application is a request to vacate platted easements. Per Meridian City Code Title 11, Chapter 5, the City. Council is the decision making body on this matter. The UDC does not require the site to be posted with a public hearing notice sign. A. Newspaper notifications published on: February 24, and March 10, 2014 B. Radius notices mailed to properties within 300 feet on: February 20, 2014 6. LAND USE A. Existing Land Use(s): This property is consists of two (2) commercial lots, zoned L-O. Lot 4, Block 3 is developed with an office building. The other lot is vacant. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is primarily developed with office buildings and single family residences, zoned L-O and R-4. C. History of Previous Actions: In 1978, the PUDI easements were platted as part of the Leisman Addition Subdivision. Recently, a certificate of zoning compliance (CZC-14-018) has been approved to construct a new 1,500 square foot addition to the existing office building on Lot 3, Block 3. 7. AGENCY COMMENTS MEETING No comments were received by the Planning Division from other City departments for the subject application. 8. STAFF ANALYSIS The applicant requests approval to vacate the two (2) 5-foot wide permanent public utilities, drainage, and irrigation (PUDI) easements located on the common lot line between Lots 3, and 4, Block 3 of Leisman Addition Subdivision. The applicant is vacating the easement to construct a new 1,500 square foot addition across the shared property line. The Planning Division has approved a certificate of zoning compliance for the building addition however; a building permit cannot be issued until the easements are vacated. (see Exhibit A.2) All public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas) have given consent to relinquish their easements. NMID submitted a letter stating they have no facilities within the easement area. Staff recommends approval of vacating the easements as proposed in Exhibit A.3. 9. EXHIBITS A. Drawings 1.
