DESCRIPTION OF APPLICANT'S REQUEST T'he applicant, Engineered Structures, Inc., requests Certificate of 7_.oning Compliance (CZC} and Design Review (DES} approval for construction of a 4,894 square-foot daycare center on .942 acres of land in the L-O coning district. The site is located at 1771 E. Pine Avenue. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. General Conditions of Approval 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street bighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 1 i-3A-6B. 2. Business hours of operation within the L-O and C-N districts shall 6e limited from 6 am to 10 pm as set forth in UDC 11-2B-3A4. Process Conditions of Approval 1. No signs are approved with this application. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-5C-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-5C-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certiCcate of completion as set forth in UDC 11- 3B-14A. 4. The site plan prepared by LEI Idaho Consulting, I,I,C on :February 10, 2014, labeled C3.0, is approved (stamped "approved" on February 21, 2014 by the City of Meridian Planning Division) with no changes. 5. The landscape plan prepared by LEI Idaho Consulting, LLC on December 11, 2013, labeled L1, is approved (stamped "approved" on February 21, 2014 by the City of Meridian Planning Division) with no changes. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. Ongoing Conditions of Approval 1. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (R7.-13-012). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-I 1. b. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. CITY COUNCIL REVIIJW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before March 10, 2014, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. 'this new Daycare development, located at the northeast corner of Pine Stz•eet and Nola Road, is a new building in an I,-O Limited Office zone. Rezoned in 2013 the .942 acres from the I-L (Light Industrial) Toning district to L-O (Limited Office) zoning district for the purpose of developing the parcel with a daycare center under Application R7. 13-012, the 1.54-acre site and building follow the guidelines contained in the Meridian Design Manual and Meridian City Code. The property is not subject to a development agreement as a condition of rezone. Access to the propet•ty is provided by two driveways, one from Pine St. and one from Nola Rd. Internal drives will be owned and maintained by the property owners within the development. As designed, the site has excellent internal circulation and access to the public road system, which has adequate capacity to accommodate the trips generated by this development. A total of one building will be constructed on this site. The other two lots have yet to be developed and will not be considered as part of this project. Landscaping and the amenities will be maintained by a private, off-site landscaping company. Narrative describing compliance with the guidelines contained in the Meridian Design 1Vlanual: 1. ArchitectLZral Character: a} Facades. The building facade is modulated to create visual interest and shadow lines on all public visual sides of the building. The entrance and stone pop-outs at the three public view sides are designed to break up the facade Lines and cast vertical shadow on the adjacent stucco walls. b) Primary Entrance. The entrance is defined by a pitch roof covering and gabled facade. ~fhe entry doors are set back from the vertical plane to create a covering and delineate a path. The main entry door is distinguished from the others with a storefront glass system. ~~r~: {~u~~ ~~~~-~<a ~ ~ a=xe t~c~~~ ~~+~-~s~~~; c) Roof Lines. 7'he roof line of this structure is a hip roof system, overhangs, and the addition of higher covered entries for an inviting feel. d) Pattern Variations. The facade portion of the building is designed so that there is material and shadow variation to the design but yet kept simple and inviting for both parents and children. The cultured stone provides a unique texture and variation to the facade, and helps anchor portions of the building and also gives it an organic feel. The lighter cultured stone color give the building a feel of• it being Iarger than it really is. e) Mechanical t;quipment. AC condensers will be the only mechanical equipment not contained within the building and will be located on the northeast corner of the facility to keep away from the children. 2. Materials: Since this will be the only building in this subdivision, there are no other buildings that this boiling needs to contend or mimic in design. The building materials will be that of stucco, cultured stone and architectural black shingles. Colors to be selected are in the natural or neutral ranges. Light browns, greens, and/or grays. 3. Pat•]cing Lots:, Parking for this site will be located to the north and east of the building with a shared inlet/outlet with the other two parcels directly off of Pine Street. A shared access will also be available to the south part of all three parcels coming off Nola Road. The trash enclosure will be easily aecesable from the Nola Road inlet. 4. Pedestrian Walkways and. facilities:,, pedestrian walkways and drop-off zones are easily designated by parking layout and lighting design. Walkways are designed to provide efficient access to building entries and exits at all areas of the site. Also, will be provided a is 5'-0" wide concrete path leading north from the front entrance to the public sidewalk. 5. Playt;round screening_and child. safety. A 6'-0" high vinyl fence will be used to screen the playground area, the fence will be brown in color. It will surrotmd the entire south portion of the lot with a street light located at the southernmost portion of the playground to provide lighting for both the shared tear road access and playground for safety and security. A 4'-0" high wrought iron fence will 6e provided at the east end of the building to retain children on their path to the playground area.
