Re: Falconers Place
DMG is the owner/developer of the property at the southeast corner of Victory and Eagle Roads. We
oppose the granting of the preliminary plat and amendment of the Development Agreement proposed
by Falconers Place.
First, we believe the traffic generated by the proposed development could interfere with our existing
and approved right turn only entrance to our property from Eagle Road. Eagle Road is already extremely
high traffic, with more and mom traffic being added by developments to the south our intersection.
Additicnally, the roundabout at Amity and Eagle means that the traffic coming north on Eagle Rcad is
often continuous and at full speed. All of this will negatively impact our approved access to our
development. As we understand it, there are no current plans fcr the expansion of Eagle Road or for
additional turn lanes that might alleviate this problem.
Second, development agreements are serious and binding documents that are relied upon heavily in
development of properties. We are aware of the prior Development Agreement with Cottages !! iLC and
we did not object to that development because of the very clear limitations placed by the Development
Agreement; similar to the Development Agreement we entered into with the City of Meridian on our
property. We were also aware that the R8 zoning placed on the property was done only to allow the
development of the assisted living units as set Fortli in the Development Agreement. We have always
treated development agreements as not being solely for the developer, but also for the protection of
the public. To allow this R8 zoning to be translated into a completely different use is not fundamentally
Fair and questions the integrity of the development agreement process. We were not aware that the
Development Agreement with the Cottages had not been terminated, since the project had clearly been
abandoned.
We therefore ask that the request for development and for modification of the Development
Agreement be denied.
