Crimson Maple Townhomes� j d CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: February 12, 2014 TO: Todd Campbell FROM: Bill Parsons, Associate City Planner SUBJECT: Crimson Maple Townhomes - CZC-14-014 and DES -14-015 OWNER: Crimson Maple Townhomes, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Todd Campbell, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval for the overall site layout, amenities and building designs of the Crimson Maple multi -family development. At build -out, the proposed development will consist of seven (7) multi -family structures with a total of twelve (12) three-bedroom units and one (1) management office. Amenities proposed for the development are as follows: a community garden and a picnic area. For permitting and occupancy purposes, Phase 1 will consist of one (1) single -story duplex structure and all of the associated site work, landscaping and amenities. All improvements associated with phase 1 need to be completed prior to occupancy of the structure. Future CZC approval is required for the remaining multi -family structures and the management office prior to the issuance of a building permit. The property consists of 1.59 acres of land and is zoned R-15. The site is located at 1350 NW. 4th Street. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 for additional details about building permits and inspections. You must complete this process before you commence the use or construction. General Conditions of Approval 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Conditions Document Crimson Maple Townhomes - CZC-14-014 and DES -14-015 Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and I1 -3A -6B. 2. Maintenance of all common areas shall be the responsibility of the developer or assigns. The applicant shall record legally binding documents that state the maintenance and ownership responsibilities for the management of the development, including but not limited to structures, parking, common areas, common driveways, and other development features. A copy of the recorded document shall be submitted prior to issuance of Certificate of Occupancy for any structure. The responsible party shall be a single entity overseeing the entire multi- family development. 3. For permitting and occupancy purposes, Phase 1 approves the construction of one (1) single -story duplex structure. Future CZC approval is required for the remaining multi -family structures and the management office prior to the issuance of a building permit. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B - 14A. 4. The site plan prepared by J.J. Howard, dated February 12, 2014, labeled C-5 is approved on February 12, 2014 by the City of Meridian Planning Division) with no changes. 5. The landscape plan and site amenities attached in Exhibit C, dated February 12, 2014, are approved on February 12, 2014 by the City of Meridian Planning Division with no changes. 6. The elevations attached in Exhibit D, dated January 20, 2014, are approved on February 12, 2014 by the City of Meridian Planning Division with no changes. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawfid to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all Conditions Document 2 Crimson Maple Townhomes - CZC-14-014 and DES -14-015 landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC I1-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (RZ-13-011; CUP -13-011; DA #114004224). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-27. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before February 27, 2014, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Previous approvals for this project include a Rezone and Conditional Use Permit with case numbers RZ-13-011 and CUP -13-011. The City of Meridian's City Council approved the CUP on Dec. 3, 2013. The developer has also entered into a Development Agreement with the City, Instrument No. regarding this project and parcel. This project is located at 1400-1430 NW 4" Street, approximately 100 feet north of W Maple Ave. in Meridian. Crimson Maple Townhomes will be a multi -family residential development with a mix of one-story duplexes and single family homes and two-story duplexes. The proposed development does not require platting as we are not modifying the original parcel. All proposed buildings will be constructed on the existing, single lot and will remain under the ownership and maintenance responsibility of the developer/property management association. The existing 1.59 acre parcel was rezoned from R-8 to R-15 (RZ-13-011) to allow for multiple dwelling units on one lot. The enclosed application has been submitted in accordance with City of Meridian Ordinances. The conceptual development plan, civil construction documents, landscape plan, pictures of amenities and 4 -sided building elevations have been included and show that this project has been designed to the standards and policies set forth in the UDC, the Meridian Comprehensive Plan and the Meridian Design Manual. No request for variance is being submitted at this time. The existing site is relatively flat and consists of weeds and native vegetation. There are no structures on the site. There is an irrigation supply ditch that traverses the site from south to north and an irrigation drainage ditch at the northeast corner of the property. There are a few small trees that will likely need to be removed, however proposed landscaping will more than make up for the lost vegetation. There are also a few large trees adjacent to the site with overhanging foliage that may need to be trimmed prior to construction. The Meridian Fire Department has been contacted and has reviewed and approved of the proposed roadway layout with the condition that "No Parking" signs are placed along the service drive. Sewer and water service will be provided by the City of Meridian to all building units and will be constructed in accordance with the ISPWC and Meridian City standards. A utility easement will be granted to the City to access all public mains and service meters. A pressure irrigation system will be provided to all common areas and fenced backyards will be operated and maintained by the property management association. Irrigation water is proposed to be supplied by private well. The irrigation supply ditch which runs through the site does not provide a reliable source of water and will be piped through the site. These units are planned to be rented to families and individuals seeking comfortable living spaces, community and private open spaces with no landscaping maintenance responsibilities. There will also be an additional management office and maintenance storage building. The architectural character, including facades, primary entrances, roof lines, pattern variations and mechanical equipment for the proposed buildings have all been considered and conform to Meridian design guidelines for residential developments and applicable building codes. The materials and colors chosen promote architectural character and contribute to the aesthetics of the surrounding area. The proposed homes are of comparable size, but with newer, more appealing amenities than surrounding homes and therefore would likely increase local property values rather than diminish them. Each unit will provide the required off street parking for multifamily developments by use of the garages and driveways.
