Custom Care Dry Cleaner and ShellCERTIFICATE OF ZONING COMPLIANCE REPORT C�Q/�ETllIj IAN,;-- DATE: February 4, 2014 TO: Jeremy Putman, neU design architecture FROM: Kristy Vigil, Assistant City Planner SUBJECT: Custom Care Dry Cleaner and Shell - CZC-14-005 and DES -14-013 OWNER: Una Mas LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Jeremy Putman, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval for construction of a 3,288 square -foot building for a dry cleaner and an additional suite for a future tenant on .384 acres of land in the C -G zoning district. A drive-through establishment has not been approved with this Certificate of Zoning Compliance. An approved Conditional Use Permit is required for a drive-through establishment on the site. The site is located at 3471 E. Tecate Lane. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not u building permit. Please contact Building Services at (208) 887-2211 to verify f you need a building permit and/or inspection, If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services far additional details about building permits and inspections. General Conditions of Approval 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health Conditions Document 1 Custom Care Dry Cleaner and Shell - CZC-14-005 and DES -14-013 as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 1I - 3B -14A. 4. The site plan prepared by neU design architecture on January 9, 2014, labeled A101 and A-501, is approved (stamped "approved" on February 4, 2014 by the City of Meridian Planning Division) with no changes. 5. The landscape plan prepared by FarWest Landscape, dated January is approved (stamped "approved" on February 4, 2014 by the City of Meridian Planning Division) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The elevations prepared by neU design on January 9, 2014, labeled A-201, are approved (stamped "approved" on February 4, 2014 by the City of Meridian Planning Division) with no changes). 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (MFP-11-001, FP -07-020, PP -06-022, CZC-11-026 and DA #108080951). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. Conditions Document 2 Custom Care Dry Cleaner and Shell - CZC-14-005 and DES -14-013 CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before February 19, 2014, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. There is currently one building built on site, with approximately 19 remaining undeveloped pads. The entire site has already been approved through a previous Design Review processes, which included all civil drainage, overall site design, and other items associated to the remaining properties. Internal roads currently exist, curbs along E. Tecate Ln. currently exist, utilities stubbed to lot 4 currently exist, and the like. Specifically the items that will be new on this property will be street side sidewalks, interior sidewalks, interior paving and the building itself. It was our intent to have various building features to enhance and correspond to the surrounding buildings (exterior material, texture, varied elevations, etc.), while still ensuring the buildings character all mesh well together. In addition, we have addressed all four sides of the building to have similar design quality (not simply the front facade). Our true goal is Class A space, as our unique style within this subdivision allows us opportunities for doing more than just the regular. With cmu and stucco finishes, facade height variations, wall facade modulations, multiple fenestration assemblies, etc., we feel the beauty of the building is well within the guidelines as requested in the Meridian Design Manual. However, we will address each item below as it might relate to this building: 1. Architectural Character: a. Facades - there are many enhancements and changes in plane with recessed windows, stucco insets and the like. We have varied the roof overhangs as well. b. Primary Public Entrances - allowing the pronounced portions of the building to be the main entrances creates visual understanding as soon as one looks at the building as to where the entrances can be found at each end of the building. It enhances importance and creates symmetry. c. Roof Lines - wall undulations (horizontal and vertical elevation undulations) accomplishes, in an aesthetic way, variation that allows the buildings to show different forms as one travels by. d. Pattern Variations - the differences in cmu color and pattern, with stucco insets, creates pattern variations and visual texture. e. Some windows are doubled up for their own additional architectural appeal, and some windows are even provided as transom, adding natural light in tenant areas. Mechanical Equipment - all mechanical equipment will be located on the roof well back from the front facade, and will be screened by the parapets from both the street and properties behind. 2. Color and Materials - matching the same color qualities of the adjacent buildings, thus creating a cohesive appearance throughout the site, has been important in considering the overall character of the project site as well as of each building. The well composed mixture of multi -color cmu to stucco, with a darker plane of the stucco providing a visual top creates an overall highly attractive building with variations in textures, colors and materials - similar (and even improved) to other attractive buildings in the Meridian area. 3. Site Plan and Building Layout: a. Building Location - has been set back to create openness, not to overwhelm the street frontage. The building maintains visual connection with the street through the glazing. b. Parking areas - have been split between the front and back in order to not present a 'sea of parking' to the visitor. c. Access - one access is currently off of E Tecate Ln. At the time of construction adequate paving will be provided to encircle the building via the access agreements place on the property and adjacent properties. d. Street Layout and Internal Circulation - see above comments. e. Pedestrian Walkways and Facilities - concrete sidewalks will be added along all parking lot curbs and street side allowing for one to walk around the public access portions of the buildings with ease. Sidewalks are provided at all egress doors. Cohesive Design - This building is similar in finishes, style and scale to existing buildings near the subdivision/neighborhood. Connectivity is present through unified use of existing drives and walkways throughout the area. Additionally, landscaping will tie together spaces leaving only the need for buildings and people to complete the community feel. Our project building(s) relate well to the overall character and intent, while still allowing for some noticeable differences between each structure.
