RE: Heritage Grove Subdivision—Annexation, Rezone, Preliminary Plat, Planned Unit Development
Dear Mayor and Council,
After several months of careful planning we are pleased to submit this application for Heritage Grove — a
new single family detached neighborhood at the NW corner of Locust Grove and Ustick. Our vision is to
create a unique and very livable neighborhood utilizing many traditional neighborhood design (TND)
elements including, but not limited to, tree -lined
streets, landscaped berms and parks, and a
variety of lot and house types—traditional, alley
and alley -mew.
A subdivision known as Chalet Marseilles was
previously approved on this site with a similar
number of units and layout but with a mix of
public and private streets and attached units. We
are requesting approval for single family detached
units and public streets and public alleys.
This application includes a request for annexation, rezone, preliminary plat and PUD. The site includes
21.09 acres, nearly 20 acres of which is within the city's limits and zoned R15. Two small parcels (1.49
acres in total) are also part of this application but are currently not within the city limits. We are
requesting R15 zoning so that the zoning throughout Heritage Grove will be uniform. We are requesting
two separate Development Agreements — one specific to Lot 25 Block 6 (the Trail's property), and one for
the balance of the project. Any development or subdividing of Lot 25 Block 6 in addition to what is
provided for in this submittal will be subject to further application to and processing by the City.
Of the 121 dwelling units we are proposing, one is an existing home which is owned by Mr. and Mrs. Trail
(Lot 25 Block 6), 64 traditional lots are located around the perimeter of the site, and 56 are alley -loaded
lots located at the center of each 10 acre section. Of these 56 lots, 30 lots are alley loaded and front on a
public street and 26 lots are alley -mew lots where the lots front on a common park or "mew."
Traditional Lots
The traditional lots are adjacent to the neighboring properties are generally 46' to 54' wide. In keeping
with the green theme we wish to create, trees similar to those in the internal parkways will also be
planted on the traditional lot side of the streets at about four feet (4') behind the sidewalks. This will
provide shade and soften the street scape.
Within the Traditional segment of Heritage Grove will be two common driveways. Each common driveway
will provide access for two lots. The pairings are: Lots 11 and 12 Block 6; and Lots 6 and 7 Block 7
Alley & Alley -Mew Lots
This portion of Heritage Grove is similar to the
central portion of Heritage Commons and patterned
after local and regional neighborhoods that have
proven to be vibrant. Local examples include
Messina Meadows and Hightower in Meridian,
Hazelwood Village and Sonta Hills in SW Boise, and
Alderwood Village and Winding Creek in Eagle.
Regional examples include Stapleton in Denver,
Colorado; Issaquah Highlands outside Seattle,
Washington; Daybreak in the greater Salt Lake City,
Utah area, just to name a few.
The 56 alley and alley -mew lots are located within two separate blocks. The perimeter of each block will
be accented by tree lined parkway strips and detached sidewalks, the sides of each block will also be
flanked by landscaped common lots, and a
landscaped, mew -style park will be centered in each
block. The mew -style parks will include picnic areas.
The individuals and families we will serve with this
neighborhood are increasingly seeking a affordable
quality living environment with low exterior
maintenance requirements. This is especially true
for the alley type buyer. To this end, we may
structure the HOA to provide not only landscape
maintenance for the common areas but also for each
individual lot.
In order to maximize each alley owner's outdoor living space, we will utilize private cross -access
easements across common side property lines between alley lots and alley -mew lots as shown in the
graphic below. Each color in the graphic depicts the area an owner will live within including the area
across the common side lot line. The easement will extend to one inch (1") from the neighboring house.
This will allow each owner to an outdoor living space they can actually use - all on one side of the house.
Many of the alley or alley -mew plans will include a patio cove or courtyard within the building footprint
which will increase the outdoor living space even more. Our builders are well versed in designing and
building this type of product. It does require the careful placement of windows, doors, A/C units and
hose bibs so that they will not intrude upon the adjacent outdoor living space.
The cross access easements will also allow an owner the option of a concrete pad off of the alley,
adjacent to and outside the garage for the placing of trash cans, A/C units, and possibly the parking for a
third car or a visitor's car. Each alley house will have one or more narrow evergreen shrub near the
corners of the garage to provide some screening, color, texture and softening to the alley-scape.

As part of TND design principles we want to
create a strong connection between each park
and the alley -mew houses that front them. A
front setback of 5 -feet for these lots will
enhance this connection. We envision many of
these homes to have a front porch which will
promote greater interaction between the
residents. As with all the lots within Heritage
Grove, the side setbacks for the alley -mew lots
will be 5 -feet. As outlined below, the rear
setback for alley lots is proposed at 2 -feet.
PUD
The main reason for our PUD application is to allow reduced setbacks from the alley. Our TND design is
based on an alley -to -garage setback of two feet (2'), an alley -to -dwelling setback of four feet (4') for the
first level, and an alley -to -dwelling setback of two feet (2') for a second level. This is quite typical of TND
neighborhoods. One local example this type of reduced garage setback is Hazelwood Village in SW Boise.
The alley will be improved the full 20' width of the alley lot. The alley width plus the 2' garage apron has
proven quite sufficient for vehicles to enter and exit the adjacent garages. The demographic group that
will purchase an alley home includes those who own only one or two standard vehicles. As a general
rule, alley homeowners do not own monster trucks.

This property has been the home and farm of the Leon and LaRue Johnson family for SO years. They lived
on the property longer than any other previous owner. The
Johnsons have had a significant influence on families and individuals
in the area. Leon was a veterinarian by trade, but perhaps better
known as a community leader of many LDS congregations and other
groups. LaRue Johnson was the driving force behind Leon and the
reason their eleven children are such wonderful people today. We
intend to place a monument in the larger park (closest to their home
site) to pay tribute to their contributions and to honor the heritage
they leave.
Open Space and Amenities
Total of open space exceeds 15%. The ordinance requires 10% open space. The extra 5% of open space
may count as one of the required amenities. We are providing two picnic areas (one in each mew park)
as our required amenities.
We are actively working and coordinating with ACHD and the Ustick/Locust Grove widening project to
create tree -lined parkways which is a change from ACHD's original plans which show the sidewalk
adjacent to our project as being attached on Locust Grove and detached by only six feet along Ustick. The
HOA will enter into a license agreement with ACRD, and it will provide the continuous maintenance of
the berm and parkways.
Much of the boundary of the site already has a solid fence. Some of these fences are in good repair,
other are not. During the construction of each phase of Heritage Grove, we will work with neighbors to
retain or replace the fencing and share in the costs according to Idaho Code. We will also be installing a
solid privacy on the berm as part of our buffer from Ustick and Locust Grove,
Irrigation
The pressurized irrigation system will be privately owned and operated by the HOA. Surface water rights
are from Nampa Meridian via the milk lateral. The site is subject to a rotation with other users on the
same ditch. Because of this rotation and city ordinance, we are working with IDWR to update the permit
for one or both of the existing wells on site as our secondary source. If the necessary permits and well
improvement prove to not be cost effective, we will work with public works for a single cross connection
with the City's system. We have also designed an irrigation storage pond near the entrance which will
enhance the effectiveness of the system. The pond will be incorporated into the overall landscaping and
will be owned and maintained by the HOA.
Phasing
We anticipate that the construction of Heritage Grove will be divided into four phases.
Access to Trail Property
ACHD recently acquired additional right of way for Ustick Rd and Locust Grove from the previous owners
and the Trails. The current Ustick Rd. access to the Trail's property (Lot 25 Block 6) will be discontinued
once the new internal streets are constructed. The new access to the Lot 25 will be across Lot 23 Block 6
which is 42 -feet north to south. This lot will be deeded to either ACHD or the current owner of Lot 25
Block 6 at the time Lots 23 and 25 Block 6 are included in a final plat.
Development Agreement
The current DA connected with the property will need to be terminated and a two new DA's created due
in part to our street and alley network is public and our structures will all be detached, and the inclusion
of the Trail property in the preliminary plat. In summary, one DA will be for the Trails specific to and
limited to Lot 25 Block 6, and the second DA for the balance of the project.
We are excited to create this quality neighborhood within the City of Meridian in compliance with the

This Agreement is made by C. Leon Johnson and E. LaRue Johnson
("Grantors") and C. Leon Johnson and E. LaRue Johnson ("Trustee").
ARTICLE. 1. TRUST ESTATE
1.01. Conveyances to Trustee by Grantors. Grantors have transferred or
will transfer to the Trustee the property listed in Schedule A, attached hereto, and
the Trustee accepts such transfer, in trust, for the purposes and on the conditions
set forth herein. So long as this Agreement remains unrevoked, Grantors may
add other property acceptable to the Trustee to the trust or trusts created herein
by transferring such property to the Trustee, and if so added, such property shall
be subject to all of the provisions of this Agreement.
1.02. Other Additions to Trust. The Trustee, in the Trustee's discretion, is
authorized to accept assets by gift or inheritance from other sources, and such
assets shall be subject to the terms of this Agreement.
1.03. Trust Estate. Property subject to the terms of this Agreement will be
referred to herein as the "Trust Estate" and shall be known as the "LEON AND
LaRUE JOHNSON FAMILY TRUST".
ARTICLE 2. TRUSTEE
2.01, Original Trustee. C. Leon Johnson and E. LaRue Johnson, or the
survivor of them, are the original Co -Trustees of all trusts created by or to be
created in accordance with this Agreement. Either C. Leon Johnson or E, LaRue
Johnson may act as Trustee with or without the other.
2.02. Successor Trustee. Should C. Leon Johnson and E. LaRue
Johnson resign or become unable because of death, incompetency or other
cause to serve as Trustee, the Successor Trustee of all trusts provided for in this
Agreement shall be Ron S. Johnson. If Ren S. Johnson resigns or becomes
unable because of death, incompetency or other cause to serve as Trustee, the
Successor Trustee of all trusts provided for in this Agreement shall be Ellen
LEON AND LaRUE JOHNSON FAMILY TRUST - 1
the Grantors' desired distribution of the Trust Estate while minimizing the
imposition of federal estate tax and generation -skipping transfer tax.
9.06. No Contest Clause. In the event any beneficiary under this trust
shall, singly or in conjunction with any other person or persons, contest in any
court the validity of this trust or the last Wills of Grantors or shall seek to obtain
an adjudication in any proceeding in any court that this trust or any of its
provisions or that such Wills or any of their provisions are void, or seek otherwise
to void, nullify or set aside this trust or any of its provisions, then the right of the
person to take any interest given to him by this trust shall be determined as it
would have been determined had the person predeceased the execution of this
trust. The Trustee is hereby authorized to defend, at the expense of the Trust
Estate, any contest or other attack of any nature on this trust or any of its
provisions.
9,07. Governinq Law. This trust has been accepted by the Trustee in the
State of Idaho, and its validity, construction and all rights thereunder shall be
governed by the laws of that state,
CERTIFICATION OF GRANTORS
We certify that we have read this Agreement and that it correctly states
the terms and conditions under which the Trust Estate is to be held, managed
and disposed of by the Trustee. We approve this Agreement in all particulars
and, as the Trustee named in this Agreement, approve and accept the trusts

STEVE AND BETTE GIBSON CHARITABLE REMAINDER UNITRUST
THIS TRUST AGREEMENT is made thisday of
1993, by and between STEPHEN W. GIDSON, of Littleton, Colora o (hereinafter called the
"Donor") and STEPHEN W. GIBSON, of Littleton, Colorado (hereinafter called the
"Trustee"), with respect to the initial trust estate, described in Schedule A, which Donor
hereby transfers to the Trustee and which the Trustee hereby accepts and agrees to hold,
together with any future additions to the trust, upon the terms and conditions hereinafter
set forth. THIS TRUST IS IRREVOCABLE, AND THE DONOR SHALL HAVE NO
POWER TO ALTER, AMEND, REVOKE OR TERMINATE THE TRUST, EITHER IN
WHOLE OR IN PART.
Section 1. Payment of Unitrust Amount. In each taxable year of the trust, the
Trustee shall pay to the Donor during the Donor's lifetime a "unitrust amount" equal to
eight percent (8%) of the net fair market value of the trust assets valued as of the first day
of each taxable year of the trust (the "valuation date"), decreased as provided in Section 2
in the case where the taxable year is a short taxable year or is the taxable year in which the
survivor of the Donor and the Survivor Beneficiary dies, and increased as provided in
Section 4 in the case where there are additional contributions during the taxable year. The
unitrust amount shall be paid to the Donor in quarterly installments on the last day of
March, June, September - and December (with the first installment to be on the last day of
the first calendar quarter after the execution of the trust) from income and, to the extent
I,
to which Donor (and Donor's estate) may be entitled, Section 664 of the Code, the
regulations thereunder and the legislative and Treasury requirements shall govern.
Section 19. Definition of Incompetency. For all purposes under this Trust, a person
shall be deemed "incompetent" if and so long as:
a. a guardian or conservator of his or her person or estate duly appointed
by a court of competent jurisdiction continues to serve, or
b. two physicians (licensed to practice under the laws of the state where
the person is domiciled) certify that such person is unable properly to
care for his or her person or property.
Section 20. Limitations on Claims and Encumbrances. The interest of an income
beneficiary in trust income shall not be subject to the claims of any creditor, any spouse for
alimony or support, or others, or to legal process, and may not be voluntarily or involuntarily
transferred, assigned, encumbered or alienated.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement effective

Dear Neighbor,
We are writing to invite you to a neighborhood meeting regarding a new
development at the NW corner of Locust Grove and Ustick (see aerial map). The
meeting will be held at Prospect Elementary School located at 4300 N. Red Horse
Wy, Meridian on Tuesday, January 1&' at 6:30 pm and will last for 30 to 60 minutes.
A project by the name of Chalet Marseilles was previously approved on this
same site for 120 units (four-plex and duplexes) in the R-15 zone.
OUR PROPOSAL is for 120 single family detached homes within the R-15 zone.
Approximately half the homes will be traditional (garage at front of house) located
at the boundary of the site, and 50% will be alley loaded homes. The alley homes
will surround two interior neighborhood parks. Our proposal includes the addition
of about 1.5 acres for which we are requesting the same R-15 zone.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.

Conceptual Elevations and Materials
Heritage Grove will bean interesting and livable neighborhood of lasting value. We will achieve this
through the use of a variety of traditional neighborhood design elements including colors, textures,
materials, architectural styles, roof pitch, placement of living -space near sidewalks, and through artful
landscaping. Some other elements we will draw from include, but not be limited to, masonry (stone,
brick, or stucco), board and batten, cottage lap, plank, shingle siding, varied rooflines, as well pop -outs
and breaks in elevations and porches. Our plan is in compliance with the design principles outlined in
Meridian's Residential Design Guidelines. The following photos provide a sampling of our vision.

Request: (AZ): Annexation of approximately 1.49 acres from RUT in Ada County to the R-
15 (Medium High-density Residential) zoning district, by Tacker Johnson.
