Broadway Ave. Meridian, Idaho 83642 12E: Shery14-Plex (RZ 13-017) Update Dear Mayor and Members of the City Council, I am writing on behalf of my client JTC, Inc. who is the Applicant in this case. This application clearly and strongly conforms with the City's comprehensive plan and the city code. Staff recognized this in their analysis and recommendation of approval for the application. This small parcel is not a viable site for an office development in this area. The proposed rezone meets the goals and objectives of the city by providing in-fill development which fits well with the comprehensive plan and future land use map on a lot that under the existing zoning has remained vacant for approximately ten years. We wanted to give you an update as to my client's efforts since the Planning and Zoning hearing. During the previous hearing on December 19, 2013 one of the main concerns voiced by some commission members was a lack of communication with Tiburon neighbors. Though my clients held a proper neighborhood meeting subdivision residents complained that they had not been notified. This was due to the fact that they lived beyond the notification area, not because my client was trying to exclude them. They felt that because they were not notified they did not have an opportunity to provide input to the Applicant. In response to this concern and to show good faith my client followed up after the meeting with an invitation sent to ail residents in the Tiburon subdivision inviting them to another neighborhood meeting on January 15, 2014 at the Silvercreek Realty Group office. Five Tiburon residents or owners came and my client felt they had a productive hour of discussion. Those in attendance felt that progress was made and my client offered to hold a third meeting the following Saturday, January 18, 2014 at the Tiburon clubhouse in hopes of encouraging others to join the dialogue. On January 16, 2014 one of my clients, Mike Conklin, received a call from one of the Tiburon residents who had attended both neighborhood meetings. She informed him that there was no use in attempting to hold another meeting as the neighbors who are opposed to the project in essence were not willing to engage in discussion on the project, have their minds made up and were not willing to meet. Despite the comments made to the Planning and Zoning Commission, it is apparent that those opposed to the rezone are not interested in providing input or engaging in a discussion with my client.
