8206366 EASEMENT
THIS INDENTURE, made this fourth (4th) day of December, 1981, between
Joint School District #2, Meridian, Idaho the party of the first part, and here-
inafter called the Grantor, and the City of Meridian, State of Idaho, a municipal
corporation, the party of the second part, and hereinafter called the Grantee;
WITNESSETH
NOW, THEREFORE, in consideration for value received, the Grantors do
hereby give, grant and convey unto the Grantee, a permanent easement for the
operation and maintenance of a water well for domestic and fire protection purposes
on property located in the Southwest Quarter (SW 4), Section 8; Township 3 North;
Range 1 East BM, and more particularly described as follows:
WELLSITE: A portion of lot 7 and lot 8, block 1, LOCUST GROVE I1~DUSTRIAL
PARK, more particularly described as follows:
Commencing at a steel pin marking the most southerly lot corner
common to lots 7 and 8, block 1, LOCUST GROVE INDUSTRIAL PARK, according
to the official plat thereof on file in the Ada County Recorders Office,
Boise, Idaho in book 41, page 3391, instrument number 7720601, thence N.
00° 00' 48"W., along the westerly boundary of said lot 8, 90.00 feet to a
point, thence N.89° 59' 12"E. 19.00 feet to the REAL POINT OF BEGINNING;
thence N. 00° 00' 48"W., 100.00 feet to a point;
thence S. 89° 59' 12"W., 31.00 feet to a point;
thence S. 00° 00' 48"E., T00.00 feet to a point;
thence N. 89° 59' 12"W., 31.00 feet to the REAL POINT OF BEGINNING.
Said tract contains 3100 square feet more or less, subject to ease-
ments of record or in use.
THE EASEMENT HEREBY GRANTED is for the purpose of providing sanitary
protection of a domestic water well.
THE GRANTORS hereby covenant and agree that they will not place or
allow to be placed any permanent structures on the area described for this
easement which would interfere with the use of said described easement for the
purposes stated herein.
THE GRANTEES agree not to remove or relocate any existing fences or
other improvements and to allow the Grantor existing uses of the easement area.
TO HAVE AND TO HOLD, the said easement unto the said Grantee, its
successors and assigns forever.
IN WITNESS WHEREOF, the Grantor, pursuant to the resolution of its
Board, has caused its name to be hereunto subscribed by its Superintendent, and
attested by its Clerk.
