SUBJ: Hacienda -South Project Narrative for Final Plat Application
Dear Mayor and Council:
Please accept this application for the Phase 1 final plat of the proposed Hacienda -South Subdivision
(also known as Hacienda Subdivision 44). For clarity and for useful comparison to the preliminary
plat conditions, this narrative will describe aspects from the combined project phases. However, a
separate application will be submitted in the future for Phase 2 (also known as Hacienda Subdivision
#5).
This project is located at 5700 N. Meridian Rd, south of the existing Hacienda Subdivision and north
of Ventana Subdivision No. 1. Hacienda -South Subdivision is a residential development designed
for single-family detached homes. The 19.63 acre parcel was rezoned from RUT to R-8 by public
hearing before the Meridian Planning and Zoning Commission, Case No. AZ -13-007 and the
preliminary plat was approved by the Meridian City Council, Case No. PP -13-016. This project is
subject to the Development Agreement No.
In the preliminary application, the average residential lot size proposed was 5,888 SF and the gross
density is 4.74 dwelling units per acre. The lot sizes and density will not change for the combined
final plat phases except as it relates to the "future right-of-way" lot along N Meridian Rd. in the
preliminary application. This lot was requested by ACRD to be eliminated and the final plat instead
shows the requested 37 -ft dedication from centerline. The remainder of the "future right-of-way" lot
was incorporated into the landscape buffer with a sidewalk easement to maintain the proposed
residential densities.
The following narrative describes the project as proposed in the preliminary application. With the
exception of the "future right-of-way" lot mentioned above as well as changes to the originally
proposed street names as directed and approved by Ada County, the combined final plat phases
contain no significant deviations from the preliminary plat. The open space count and proposed
amenity have not changed and this development remains in conformance with requirements and
provisions of the UDC. The conditions of approval of the preliminary plat have or will be met by the
following means:
A. The applicant shall submit and receive approval of home elevations along Meridian Road
and Producer Drive prior to receiving building permits.
B. The open space and amenities of Hacienda Subdivision and the proposed Hacienda South
phases will be maintained by a single homeowner's association and the OCR's or other
documentation will be provided to the City by the applicant to verify these arrangements.

C. The Saguaro Canyon HOA has deeded right-of-way and a sidewalk easement to ACHD
as provided. ACHD is currently processing the dedications.
D. The applicant has provided documentation to the City that shows CDHD does not have
jurisdiction over subdivision pools and cannot dictate the size of the pool based on the
anticipated number of users. The applicant has also provided a vote from residents of
Hacienda subdivision on the addition of a new pool and the notion was almost
unanimously denied.
E. The developer shall abide by the terms of the by-laws and conduct annual HOA
meetings.
The project is in conformance with acceptable engineering, architectural and surveying practices and
local standards.
Preliminary plat narrative
The enclosed applications have been submitted in accordance with the City of Meridian Zoning
Ordinance. The preliminary plat has been designed to the standards and policies set forth in
Meridian City Code and the Meridian Comprehensive Plan. No request for variance is being
submitted at this time; however a request to combine the qualifying open space count for the existing
Hacienda Subdivision and the proposed Hacienda -South Subdivision has been made to the City and
was discussed at the pre -application meeting. It was concluded that a "net" 10% qualifying open
space would be reasonable for the combined subdivisions if both developments were part of the same
homeowner's association and residents would have access to all amenities therein. We are proposing
that the Hacienda -South development be added to the Hacienda Subdivision Homeowner's
Association and Exhibit -A has been included to clarify the open space count. Hacienda -South will
add 1.71 acres of qualifying open space to the existing 2.79 acres in Hacienda Subdivision for a net
percentage of 11.46%. A gazebo is proposed for the central common lot and will serve as an
additional amenity.
The existing site is primarily flat rangeland land for cattle. There is a large split-level brick home, a
barn, a riding arena, and several equipment sheds that will need to be demolished. A long paved
driveway and parking area provide access to the residence from Meridian Road and will also need to
be removed. There are a number of existing trees on site lining the driveway and surrounding the
house and barn. Much consideration was made in the design of the site to save as many trees as
possible for the proposed common areas. Trees that will need to be removed will be either
transplanted or replaced with new landscaping to the extent possible. Existing trees to be retained
will be protected during construction by placing temporary construction fencing around the base of
the tree near the drip line. Construction within the drip line of saved trees shall be in accordance
with 11-3B-573 of Meridian City Code.
All proposed streets will be public and dedicated to ACRD. Access will be provided to the site by
the existing street stubs on the north, south and east boundaries. No access can be provided from
Meridian Road without approval from the ACHD commissioners and the City of Meridian. We are
not requesting an exception to policy for an approach on Meridian Road with this application. The
primary entrance will instead be located on the existing Rio Vista Way on the south boundary of the
project. A request has been made to ACHD and the City of Meridian to resolve a right-of-way issue
at this entrance. It appears that right-of-way was not dedicated across a 24 -ft strip of land (Lot 7,
Block 28 of Saguaro Canyon Subdivision 44) that serves as an access to the irrigation district. It is
apparent that Rio Vista Way was intended to serve the future development of our parcel and that the
right-of-way should have been extended through the access strip. Contact has been made with
ACHD to resolve the issue and further coordination with the Saguaro Canyon H.O.A. will be
necessary as we move through the design and platting process.
The Meridian Fire Department has been contacted to address access concerns with the proposed
roadway layout. Sewer and water service will be provided by the City of Meridian to all residential
lots and will be constructed in accordance with the ISPWC and Meridian City standards. A pressure
irrigation system will be provided to all lots and will be operated and maintained by the
Homeowner's association. Storm water runoff will be captured, conveyed and disposed of on-site in
subsurface seepage beds constructed to ISPWC and ACHD standards.
The typical residential lot proposed is 50 -ft wide by 105 -ft deep designed for 40-11 wide patio homes.
Custom floor plans may be required for corner lots and other atypical lots. All homes will be
constructed within the R-8 setbacks.
In summary, the proposed Hacienda -South Subdivision will be a great addition to the Meridian. This
development will in essence complete the Hacienda Subdivision (also referred to as La Mirada) and
connect a member of currently dead-end residential streets and utilities. Open area landscaping, street
lighting and home styles will be very similar to the existing development to the north and will also be
harmonious with the subdivisions to the east and south. Growing demand for the patio home style
has driven the proposed lot layout and we are confident that this development will help meet this
demand. This development is planned to be platted and constructed in two phases as shown in the
preliminary plat drawing P.1.
This application submittal package addresses all items listed in the Meridian preliminary plat and

THIS RIGHT-OF-WAY EASEMENT (SIDEWALK) (the "Easement"), is made and
entered into this 18th day of December , 20 18, by and between Saguaro Canyon
Subdivision Homeowners Association, Inc., hereinafter referred to as "GRANTOR,"
Jayo Development, Inc., hereinafter referred to as "Developer", and ADA COUNTY
HIGHWAY DISTRICT, a body politic and corporate of the State of Idaho, hereinafter
referred to as "ACRD';
WITNESSETH:
FOR GOOD AND SUFFICIENT CONSIDERATION IT IS AGREED:
SECTION 1. Recitals.
1.1 GRANTOR owns the real property located in Ada County, Idaho more
particularly described on Exhibit "A" attached hereto and by this reference incorporated
herein (hereinafter "Servient Estate"), and on the terms and conditions hereinafter set
forth desires to grant an easement on, over and across the Servient Estate to Developer
for the construction and to ACHD for its and the public uses hereinafter described.
1.2 Developer is developing property adjacent to the Servient Estate, and on
the terms and conditions hereinafter set forth desires to construct an extension of the
sidewalks and, where applicable, traffic signal facilities it is constructing beyond its
development and on, over and across the Servient Estate,
1.3 On the terms and conditions hereinafter set forth, ACHD desires to extend
its system of public sidewalks and, where applicable, traffic signal facilities to include
that to be constructed by Developer on the Servient Estate, and upon Developer's
completion of construction of a concrete sidewalk and, where applicable, traffic signal
facilities including but not limited to conduit, wiring and equipment (hereinafter the
"Improvements") on, over and across the Servient Estate, and when ACHD has
accepted the same, ACHD desires that the Improvements and the Servient Estate
become a part of its system of Highways (hereinafter "Highways") as that term is
defined in Idaho Code, section 40-109(5), for ACHD and the public use hereinafter
described. ACHD's system of Highways is hereinafter referred to as the "Dominant
Estate".

1.4 As provided in Idaho Code, section 40-1412, ACHD Ordinance Number
190 and the ACHD Policy Manual, the adjacent property owner has the responsibility to
pay for the repair and maintenance of sidewalks.
1.5 ACHD shall repair and maintain any traffic signal facilities at its sole cost
and expense upon their acceptance.
SECTION 2. Grant and Authorized Use.
2.1 GRANTOR hereby grants to Developer an easement on, over, across and
under the Servient Estate for access by Developer and Developer's employees, agents
and contractors to construct the Improvements thereon.
2.2 Subject to the right to construct granted to Developer under Section 2.1,
GRANTOR hereby grants to ACHD a perpetual and exclusive easement for a public
right-of-way on, over and across the Servient Estate for the Improvements, for use by
those members of the public who are pedestrians (as defined in Idaho Code, section
49-117) and by bicyclists (if the Servient Estate is located in an area where bicycles are
allowed to be ridden on sidewalks), and the statutory rights, if any, of utilities to use the
public right-of-way, and for ACHD, its employees, agents and contractors access to
inspect, repair and maintain the Improvements.
2.3 The easement herein granted to ACHD is for the exclusive use of ACHD
and the public.
SECTION 3. Developer's Covenant to Construct. Developer covenants and agrees to
construct the Improvements on the Servient Estate in accordance with designs
approved in advance by ACHD, in writing, ACHD policies and good engineering
practices, at no cost or expense to ACHD.
SECTION 4. ACHD'S Covenant to Pay the Costs of Repair and Maintenance. So long
as GRANTOR owns the underlying title to the Servient Estate and the adjoining
property, ACHD shall repair and maintain the sidewalks at its sole cost and expense
and, in any case, shall repair and maintain any traffic signal facilities at its sole cost and
expense upon their acceptance.
SECTION 5. Developer's Indemnification. Developer shall indemnify and save and
hold harmless GRANTOR and ACHD, its Commissioners and employees, from and
against all claims, actions or judgments for damages, injury or death caused by or
arising out of the construction of the Improvements, and including reimbursement for
any costs of suit and fees of its attorneys which are incurred should ACHD be required
to defend any such claims or actions.

6.1 The Easement herein granted to Developer shall terminate and be of no

6.2 The term of the Easement herein granted to ACHD is perpetual.
SECTION 7. Covenants Run with the Land , This Easement is a burden upon the
Servient Estate and appurtenant to and for the benefit of the Dominant Estate, and shall
run with the land.
SECTION 8. Recordation.
This Easement shall be recorded in the Official Real Property Records of Ada
County, Idaho.
TO HAVE AND TO HOLD this Easement unto the ACHD forever.
GRANTOR covenants to ACHD and Developer that they shall enjoy the quiet
and peaceful possession of the Servient Estate throughout their respective terms of this
Easement; and, (b) GRANTOR warrants to Developer and ACHD that GRANTOR is
lawfully seized and possessed of the Servient Estate and has the right and authority to
grant this Easement to Developer and ACHD.
