the part of the first part, and hereinafter called the Grantor and the
City of Meridian, State of Idaho, a municipal corporation, the party of the
second part, and hereinafter called the Grantee;
W I T N E S S E T H:
WHEREAS, the Grantor , desires to provide a Temporary Construction
Easement across the premises and property hereinafter particularly bounded and
described; and
WHEREAS, a sanitary sewer is to be provided for through an underground
pipeline to be constructed by the Grantee, which will serve the property of the
Grantor ;
NOW THEREFORE, in consideration of the benefits to be received by the
Grantor , and other good and valuable considerations, the Grantor do es hereby
give and grant to the Grantee the right to use during initial construction of
said sewer line a strip of land described as follows:
A strip of land 30 feet in width adjacent to and Easterly of the follow-
ing described line:
Commencing at the Northwest corner of the Southwest one-quarter of Section
1, Township 3 North, Range 1 West, Boise Meridian Ada County, Idaho, and running
S. 0°19'14" W. 709.91 feet along the Westerly boundary of said Southwest Quarter
to the TRUE POINT OF BEGINNING OF THE EASEMENT;
thence continuing S. 0°19'14" W. 644.12 feet to the POINT ENDING OF THE
EASEMENT, said point being N. 0°19'14" E. 1293.96 feet from the Southwest corner
of the said Southwest Quarter of Section 1. '

IT IS UNDERSTOOD that the strip of land described in the previous
paragraph is for the purpose of constructing said sewer line herein described,
the same to expire when the initial construction is completed.
IT IS UNDERSTOOD and agreed that the Grantee will restore said strip

to a condition comparable to that existent prior to the undertaking of the con-
struction of such sewer line.
lawfully seised and possessed of the aforementioned and described tract of
land, and that _ it ha s a good and lawful right to convey said easement, and
that _ it will warrant and forever defend the title and quiet possession thereof
against the lawful claims of all persons whomsoever.
