Easement Deed with Upland Industries Corporation for Ada County Highway District` ORIGINAL ~.7J~r19~~~- UIC LAW DEPARTMENT DOCUMENT NO. 2-7566-1 Page 1 TV~rr~-a~- vpunnGl ~ase--nev,t avt ~,v~d E A S E M E N T D E E D ~ °~ h a r~-n 01 i v2, . aM.~ o~ pr,~ d o~ h o~t~t, ~1,~,~t,° THIS DEED, Made this ~~! day of 1984, between UPLAND INDUSTRIES CORPORATION, a co poration~ of the State of Nebraska, (hereafter "Grantor"), and ADA COUNTY HIGHWAY DISTRICT, a political subdivision of the State of Idaho whose postal address is 318 East 37th Street, Boise, Idaho, 83704 and CITY OF MERIDIAN, a municipal corporation of the State of Idaho, whose postal address is 728 Meridian Street, Meridian, Idaho 83642, (hereafter collectively "Grantees"): WITNESSETH, That Grantor, for and in considera- tion of the sum of One Dollar ($1.00), to it paid by Grantees, the receipt whereof is hereby confessed and acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell and convey unto Grantees an EASEMENT solely for public roadway and utility purposes, within, over and across those certain properties of Grantor situate in the City of Meridian, County of Ada, State of Idaho, described in Exhibit A hereto attached and hereby made a part hereof. This deed is made subject to all outstanding leases and other outstanding rights, including, but not limited to, those for highways and other roadways and rights of way for irrigation ditches, pipelines, pole and wire lines and the right of renewals and extensions of the same, and subject also to all conditions, limita- tions, restrictions, encumbrances, reser~aticns or inter- ests of any person which may affect the said land, whether recorded or unrecorded. It is expressly made a condition of this easement that upon acceptance by the City of Meridian of the dedication of North Hickory Avenue and North Olive Street as extended to East Pine Street, then and in that event all the rights herein granted shall cease and determine UIC LAW DEPARTMENT DOCUMENT NO. 2-7566-1 Page 2 with respect to the premises, and the title to said premi- ses shall be freed from the burden of said easement.
