Updates Prior to City Council Hearing on December 17, 2013

On behalf of BI-iH Investments I, LLC, this letter is to provide updates and clarifications
to our application prior to the City :Council hearing on December 17, .2013. We met with
the Parks, Planning, and,Legal staff on December 11, 2013 to discuss the status of the
proposed City Park and also the Development Agreement concerns we expressed at
Planning Commission. Based on the meeting, please include the following updates to our
application for the City Council hearing on December 17, 2013.
1. Requested Zoning: We are modifying our zone designation request to R-4 with a
Development Agreement on the. western 79 acres and R-2 with no development
agreement on the eastern 45 acre portion.
2. City Parks The City Park :requirement has been removed by Staff. As such, we
have modified the. preliminary plat to delete the, 3.5 acre city park and revised the
preliminary plat to include a 2.3-acre private park with. site amenities consisting of a
pool,,pool house, playground, picnic shelter. We are requesting that the pool and
.pool house amenities be optional until Phase 2.
3, _U~dated Site Statistics: The modified Preliminary Plat has 169 building lots instead.
of 162 originally proposed. The 89 acres of usable open space of consists of 3.4
acres of :detached :sidewalk park strips, 2.3 acre private park, and 3.2 acres of
pathways and other common areas yields 11.3% a.11d exceeds the open space
minimum of 10%. The overall density is 2,.13 DU/acre instead of 2.05 DU/acre. The.
increase in lots and density is minimal and not a substantial ..change to the original
application.
4. Multi-Use Pathway and Eagle Road Iandscayint: We are requesting those
conditions to be deleted with this application and not apply to the 79 acres with R-4
zoning.
5. Development Agreement. Section 1.1.1. Site Specific Conditions of Approval.
The Development Agreement shall, apply to :the western 79 acres to be purchased by
the Applicant only. The 12,000 SF lot minimum lot size, 2,OQ0 minimum house size,
and 169 building lot maximum residential lots shall be defined in the Development
Agreement. 'We are requesting that the eastern 45 acre portion (R-2 zoning) nat be
requited to have a Development Agreement.
6. Sewer. Section X. Exhibits. Whitebark Temporary Sanitary Sewer Plan.
a. Page 4. We aze requesting that the Whitebark Temporary Sewer Plan be
modified to include the entire 79 acres (1691ots) of the Southern Highlands
Subdivision and exclude the portion south of Taconic Road.
b. Page S. Table 1. We are requesting the Service Area Table be modified to
specifically list the 79 acres (1691ots) north of Taconic Road.
c. Section 2.1.1. Public Works Site Specific Conditions of Approval. The
.condition specifies sewer permits will be allocated on a first-come, first serve
basis. Ta be consistent with our Public Works discussions, we request the
condition be clarified that the allocation of 1.69 sewer permits will be vested to the
79 acre portion (1691ots) upon preliminary plat approval.
7. -Lift Station Land Swan . We ..are required to abandon the existing City sewer lift
station for the Blackrock property with our extension of gravity sewer with Phase 1.
The sewer :lift station is located on a 9,196 SF lot owned by the City of Meridian. We
are proposing to trade 9,196 SF of land around the existing City well lot on Taconic
Road in the southeast corner of our site. We are requesting City Council approval of
the land swap method to abandon the sewer lift station lot and incorporate the land
.into the :Southern Highlands entry road/building lot at that location.
Please include this letter in the documentation provided to Staff and City Council prior to
our :hearing on Tuesday night.. Please let me know if you have any questions or require
additional information.
