Broadway Ave., Suite 210 Meridian, Idaho 83642 DATE: November 5, 2013 RE: Da Vinci Park On behalf of CS2, LLC, we are submitting this Preliminary Plat, Rezone, Comprehensive Plan Map Amendment, and Development Agreement Amendment Applications for Da Vinci Park. The site is 7.76 acres in size and located at the southwest corner of Locust Grove Road and McMillan Road, Meridian, Idaho. We are proposing to develop 471ots (38 attached unit residential lots, 8 common lots, and 1 neighborhood friendly commercial lot). The property is currently zoned R-4 and R-8. The gross density for the project is 4.89 dwelling units per acre. Uses and zoning surrounding the site are Larkwood Sub. (vacant to the north and zoned R-4 & RUT), Woodland Springs Sub. (retail to the northeast zoned C-N), un-platted Idaho Power substation land to the east zoned R-8), Settlement Bridge Sub. (residential land to the southeast zoned R-8), Havasu Creek Sub. (residential land to the south zoned R-4) and Crestwood Sub. (vacant land to the west zoned RUT). Access to the site is via McMillan Road and the extension of Bright Angel Street from the south. All utilities are available to the site. All streets are proposed to public streets. The property has surface water irrigation rights from the Nampa-Meridian Irrigation District and a pressurized system will be installed. We are proposing a total of 1.29 acres of open space with .68 acres of useable open space within the project, which includes numerous amenities (covered picnic area, playground equipment, picnic tables, and benches). Drainage for the project will be retained on site with the use of drainage trenches. Design and locations will be submitted to the City Engineer for final approval prior to construction. Comprehensive Plan Man Amendment We are requesting this Map Amendment to provide for the rezone of 1.40 acres to Neighborhood. Commercial on the hard corner of McMillan and Locust Grove and to acknowledge the existing R-4 & R- 8zoning as Medium Density residential. The proposed commercial zoning would be neighborhood friendly zoning and compatible with the C-N Zone on the northeast corner of McMillan and Locust Grove. Such a zone restricts the hours of use from 7:00 am to 10:00 pm. iTLC MANAGEMENT • 6104 N. The requested zones are compatible with the surrounding land uses and zones. Development Agreement Amendment We are requesting an amendment to the existing Development Agreement between the City and Larry Harpe, recorded January 12, 2007. The proposed amendments are as follows: 4.1 The uses allowed pursuant to this Agreement are only those uses allowed under City's Zoning Ordinance codified at Meridian City Code Title 11, which are herein specified as follows: (Existing) Construction and development of a single family development consisting of 22 building lots and 3 common lots in the proposed R-4 and R-8 zones on 8.95 acres pertinent to this AZ06-041 application. (Proposed change) Construction and development of an attached single family and commercial development consisting of 38 attached residential building lots, 1 neighborhood commercial lot, and 8 common lots in the proposed R-8 and C-N zones on 7.76 acres pertinent to this application. 5.1.5 That the following shall be the only allowed uses on this property: (Existing) Single family homes and allowed accessory uses of the R-8 zone. (Proposed) Single family attached homes and allowed accessory uses of the R-8 zone and uses as allowed in the C-N zone. We are also requesting a waiver of the Uniform Development Code (11-3A-3) to allow a "right out only" access to Locust Grove Road for the commercial lot only. This access would allow better traffic flow through the commercial lot and prevent commercial traffic from travelling south on Bright Angel through the residential development to the south.
