APPLICATION SUMMARY The applicant, Madison Meridian, LLC, requests approval to vacate the 10-foot wide Public Utility, Drainage and Irrigation (PUDI) easement platted on the interior lot line between Lots 1 and 2, Block 1 of the Olson and Bush Industrial Park Subdivision. II. STAFF RECOMMENDATION Staff recommends approval of the subject application. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located on the northwest corner of North Eagle Road and East Lanark Street in the southeast 1/4 of Section 8, Township 3 North, Range 1 East. B. Owner/Applicant: Madison Meridian, LLC 10510 NE Northup Way, Ste. 120 Kirkland, WA 98033 C. Applicant's Statement/Justification: Please see applicant's narrative for this information. V. PROCESS FACTS The subject application is a request to vacate platted easements. Per Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site to be posted with a public hearing notice sign. A. Newspaper notifications published on: November 25, and December 9, 2013 B. Existing Land Use(s): The area is currently vacant and in the C-G zoning district. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is currently developed with industrial uses to the south and west in the C-G and I-L zoning districts. To the east is the RC Willey retail store and a vacant lot in the C-G zoning district. C. History of Previous Actions: • In 1978, the PUDI easements were platted as part of the Olson and Bush Industrial Park Subdivision. In 2007, City Council approved a Rezone for Lots 1 and 2, Block 1 from I-L to the C-G zoning district. In addition, a Development Agreement (# 107022432) was recorded for the site. D. Utilities: 1. Public Works: a. Location of sewer: Currently installed to each lot. b. Location of water: Currently installed to each lot. b. Issues or concerns: None. VII. AGENCY COMMENTS MEETING No comments were received by the Planning Division from other City departments for the subject application. Please refer to the public record for the application file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: The applicant requests approval to vacate the 10-foot wide Public Utility, Drainage and Irrigation (PUDI) easements platted on the interior lot line between Lots 1 and 2, Block 1 of the Olson and Bush Industrial Park Subdivision. Currently, the PUDI easement impacts only the subject lots and all applicable utility providers have consented to the relinquishment of the utility easement in accord with state statute. Because Public Works has no objections and the service providers have granted relinquishment of the easement, Staff recommends vacating the PUDI easement as proposed in Exhibit A.3. IX. EXHIBITS A.
