The proposed use is a principal permitted use in the I-L zoning dish•ict, per UDC Table 11-2C-2. 'The proposed hours of operation will be 24 hourslday. The site is located at 2751 E. Commercial Street (Parcel No. 51108428200), DI:CISLC)N The applicant's request for CZC & DES is approved with the conditions listed in this report. Note: This is riot a brrildiug perratit. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line. All rooftop rneehanical equipment shall be screened as viewed f7•orn the farthest edge of the adjoining right of way. 2. The applicant shall construct all proposed fencing andlor any fencing required by the UDC, consistentwith the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. Ail street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the 1S1'WC. 4. Prior to Certificate of Occupancy, the applicant shall submit a 20-foot wide public access easement to the Planning Division for amulti-use pathway along the south side of the property adjacent to the rail corridor; coordinate the location of this easement with Jay Gibbons, Meridian Parks Department (208) 888-3579. Construction of the patlarvay is not required; the easentetat tivill simply preserve a corridor ita the event the City is not able to obtain an easelatent withi~~ the rail corr°idor for the Rails to Trails pathr~~ay. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC I I-SC-3B. A surety agreement may be accepted for other improvements in accord with LJDC 11-5C-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by CTA on ld/14/13, labeled C-1; is approved as sho~~~n in Exhibit B. 5. The landscape plan prepared by CTA on 12/6/I3, labeled LI & L2, is approved as shown in Exhibit C. 6. The elevations prepared by CTA on 8/5113, labeled Al-W2 are approved as shown in Exhibit D. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shaII submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. I0. The applicant shall complete all required improvements prior to issuance of a Cet•tificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a CertiCcate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irt•igation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-38-13 and UDC 11-3814. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site. 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet. above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligations to comply with the outdoor Lighting provisions as set forth in UDC 11-3A-11. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC ll- 311-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-42. All requests for review shall be filed in writing with the Planning Department on or before December 21, 2013, within fifteen (15) days after the writiten decision is issued, and contain the information listed in UDC 11~SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXI'II2A.TIOI~1 Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Cet•tificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not conmlenced within one year of the date of issuance of the Certificate of 'Coning Compliance. DUTY OF INSURED CLAIMANT TO COOPERATE (a} In all cases where this policy permits or requires the Company io prose- cute arprovide for the defense of any action or proceeding and any appeals, the insured shalt secure to the Company the right to so prosecute or provide de- fense inthe action or proceeding, including the right to use, at its option, the name of the Insured For this purpose. All information designated as confidential by the insured Claimant provided to the Company pursuant to this Section shall not be dis- closed to athersunless, in the reasonable judgment ofthe Company, it is neces- sary in the administration of the claim. Failure of the Insured Claimant to submit for examination under oath, produce any reasonably requested infor- mation, or grant permission to secure reasonably necessary information from third parties as required in this subsection, unless prohibited by la~v orgovern- mentalregulation, shall terminate any liability ofthe Companyunderthis poli- cy as to that claim. ?, OPTIONS TO PAY OR OTHERWISE SETTLE CLAIMS; TERMINATION OF LIAI3ILITX In case of a claim under this policy, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Insurance. To pay or tender payment of the Amount of Insurance under this policy to- gether with any costs, attorneys' fees, and expenses incurred by the Insured Claimant that were authorized by the Company up to the time of payment or tender of payment and that the Company is obligated to pay. Upon the exercise by the Company ofthis option, all liability and obliga- tions of the Company to the Insured under this policy, other than to make the payment required in this subsection, shall terminate, including any liability ar obligation to defend, prosecute, or continue any litigation. (b) To Pay or Otherwise Settle With Parties OtherThan the Insured or With the Insured Claimant. (i) To pay or otherwise settle with other parties for or in the name afar Insured Claimant any claim insured against tinder this policy. Upon the exercise by the Company of either of the options provided for in subsections (b)(i) ar (ii), the Company's obligations #o the Insured under this policy for the claimed loss or damage, other than the payments required to 6e made, shall terminate, including any liability or obligation to defend, prosecute, or continue any litigation. S. DETERMINATION ANA EXTENT OF LIABILITY This policy is a contract of indemnity against actual monetary loss or dam- age sustained or incurred by the Insured Claimant who has suffered loss ar damage by reason of matters insured against by this policy. . (a} The extent of liability of the Company for lass or damage under this policy shall not exceed the lesser of (i) the Amount of Insurance; or (ii) the difference between the value of the Title as insured and the val- ue ofthe Tit[esubject to the risk insured against by this policy. (b) If the Company pursues its rights under Section 5 of these Conditions and is unsuccessful in establishing the Title, as insured, (i) the Amount of Insurance shall 6e increased by It)%, and (ii}the Insured Claimant shall have the right to have the lass or damage determined either as of the date the claim was made by the Insured Claimant or as of the date it is settled and paid. (c) In addition to the extent of liability under (a}and (b), the Company wiq also pay those costs, attorneys' fees, and expenses incurred in accordance with Sections 5 and 7 of these Conditions. 9. LIMITATION OF LIABILITY (a} If the Company establishes the Title, or removes the alleged defeat, lien ar encumbrance, or cures the lank of a right of access to or from the Land, ar cures the claim of Unmarketable Title, all as insured, in a reasonably diligent manner by any method, Including litigation and the completion of any appeals, it shal l have fully performed its obligations with respect to that matter and shall not be I fable far any loss or damage caused to the Insured. (b) In the event of any litigat€on, Including litigation by the Company or with the Company's consent, the Company shall have no liability for lass or damage until there has been a final determination by a, court of competent ju- risdiction, and disposition of all appeals, adverse to the Title, as insured. (c) The Company shall rat be liable far loss or damage to the Insured for liability voluntarily assumed by the Insured in settling any claim or suit without the prior written consent of the Company. I0. REDUCTION OF INSURANCE; REDUCTION OR TERMINATION OF LIABILITY All payments under this policy, except payments made for costs, attorneys' fees, and expenses, shall reduce the Amount of Insurance by the amount ofthe payment. I I. LIABILITY NONCUMULATIVE The Amount of Insurance shall be reduced by any amount the Company pays under any policy insuring a Mortgage to which exception is taken in Schedule B or to which the Insured has agreed, assumed, or taken subject, or which is executed by an Insured aRer Date of Policy and which is a charge or lien on the Title, and the amount so paid shall be deemed a payment to the In- sured under this policy. lz. PAYMENT OF LOSS When liability and the extent of Loss or damage have been definitely fixed in accordance with these Conditions, the payment shall be made within 30 days. 13. Arbitrable matters may include, but are not lim- ited to, any controversy or claim between the Company and the ]nsured arising out of or relating to this policy, any service in connection with its issuance or the breach of a policy provision, or to any other controversy or claim arising out ofthe transaction giving rise to this policy. All arbitrable matters when the Amount of Insurance is $2,000,000 or less shall be arbitrated at the option of either the Company ar the ]nsured. AlI arbitrable matters when the Amount of Insurance is in excess of $2,000,000 shall be arbitrated only tivhen agreed to by both the Company and the Insured. Arbitration pursuant to this policy and un- derthe Rules shall be binding upon the parties. Judgment upon the award ren- dered by the Arbitrator(s) may be entered in any court of competent jurisdiction. I5.
