PERMANENT SEWER AND WATER EASEMENT WITH
TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made this 27th day of September, 1988,
between Meridian School District No. 2, the party of the first
part, and hereinafter called the Grantor, and Jeffery J.
Sheirbon and Ronda M. Lowe two single persons, parties of the .
second part, hereinafter called the Grantees=

WHEREAS, the Grantor desires to provide a sanitary sewer
and domestic water line right-of-way across the premises and
property hereinafter particularly bounded and described: and
WHEREAS, the sanitary sewer and domestic water line is to
be provided for through underground pipelines to be constructed
by the Grantees= and
WHEREAS, it will be necessary to maintain and service said
pipelines from time to time by the Grantees]
NOW, THEREFORE, in consideration of the benefits to be
received by the Grantor, and for the sum of One Dollar (;1.00)
and other good and valuable consideration, the Grantor does
hereby give, grant and convey unto the Grantees the right-of-
way for an easement for the construction, operation and
maintenance of a sanitary sewer line and a domestic water line
over and across the following described property:
The west 10.00 feet of Lots 7 and 8 Block 4 of Midday's
Addition to Meridian.

TO HAVE AND TO HOLD, the said easement and right-of-way
unto the said Grantees, its successors and assigns forever and
shall be appurtenant to Lots 5 and 6 Block 4 of Nidday's
Addition to Meridian.
IT IS SBPRESSLY UNDERSTOOD AND AGREED, by and between the
parties hereto that the Grantees rill timely complete the rork
of laying the sanitary serer and domestic rater lines and
restore the premises used therefor to a condition comparable
rith that ezistinq prior to ezercfsinq this easement, right-of-
ray; that in the future if repairs would be necessary the
Grantees rill ezpediently replace and restore fntnre repairs
to a condition comparable to that ezistent prior to nndertaking
such repairs and replacesents. The Grantees further agree to
sake such ezcavation to the benefit of the Grantor and to take
into consideration that the sewer and domestic rater line be
laid at the edge or at a point as to not depreciate the valve
of the Grantors property. Grantees agree to install and
construct a one and one-half (1 1/2) inch rater line and a six
inch sewer line in the granted easement and further that the
Grantor or its successor nay connect to said lines for the use '~
of Lots 7 and B, Block 4, of l~fdday•s Piddition to Meridian.
THE GRANTOR, hereby covenants and agrees that they will
not place or allow to be placed any permanent structure on the
area for the purpose stated herein.
IT IS UNDERSTOOD;
This easement shall be for the purpose of constructing

said sanitary sewer line and domestic water line herein
described.
It is understood and agreed that the Grantees will restore said
strip to a condition comparable to that existent prior to the
undertaking of the construction of such sanitary sewer line.
The Grantor does hereby covenant with the Grantees that they
are lawfully seized and possessed of the aforementioned
described tract of land, and that they have good and lawful
right to convey said easement, and that they will warrant and
forever defend the title and quiet possession thereof against
the lawful claims of all persons whomsoever.
