Utility Permit with Idaho Department of Highways for Use Right of Way r • DH 243 3 State of Idaho DEPARTMENT OF HIGHWAYS 3-66»25 Utility Permit To Use Right of Way In accordance with Chapter 93, Idaho Session Laws, 1951, and subject to all the terms, conditions and provisions written or printed below or an any part o f this form PERMISSION IS HEREBY GRANTED TO______________~?tY_of_Meri_di_an._____________________________ hereinafter called "Grantee", to Install 3t4 sanitary sewer line 2 feet inside the right of way line on the east side of S.H. 69, in Meridian, at Stations 460+23 to 464+23, Project 5-3732(1), M. P. 52.52 to 52,60. The sewer line shall have a minimum cover of 3Qinches. All specifications shown in State of Idaho, Department of Highways Standard Specifications for Highway Construction shall be enforced. Warnin signs in accordance with the Manual on Uniform Traffic Control Devices shad be in place at all times during construction. GENERAL PROVISIONS APPLICABLE TO ALL PERMITS During the progress of the work such barriers shall be erected and maintained as may be directed for the protection of the traveling public; the barriers shall be properly lighted at night. In accepting this permit the Grantee, its successors and assigns, agrees to protect the State of Idaho, or its agents, and save it harmless from all claims, actions or damages of every kind and description which may accrue to or be suffered by any person or persons, corporation or property, by reason of the performance of such work, character of materials used or manner of installation, maintenance and operation, or by the improper occupancy of rights of way. or public place or public structure, and in case any suit or action is brought against said State of Idaho, its officers or agents, for damages arising out of or by reason of any of the above causes, the Grantee, its successors or assigns, will, upon notice to it of commencement of such action, defend the same at its o~vn sole cost and expense, and will satisfy any judgment after said suit or action shall have finally been determined if adverse to the State of Idaho, its officers or agents. If the work done under this permit interferes in any way with the drainage of the state highway, the grantee shall wholly and at its own expense make such provision as the engineer may direct to take care of said drainage. On completion of said work herein contemplated all rubbish and debris shall be immediately removed and the roadway and roadside shall be left neat and presentable and to the satisfaction of the State Highway Engineer. This permit or privilege shall not be deemed or held to be an exclusive one and shall not prohibit the State from grant- ing other permits or franchise rights of like or other nature to other public or private utilities, nor shall it prevent the State from using any of its ro?.ds, streets, or public places, ~r affect its right io full supervision and control over all or any part of them, none of which is hereby surrendered. The State Engineer may revoke, annul, amend, amplify, or terminate this permit or any of the conditions herein enumerated if grantee fails to comply with any or all of its provisions, requirements or regulations as herein set forth, or through wilful or unreasonable neglect, fails to heed or comply with notices given, or if the utility herein granted is not installed or operated and maintained in conformity herewith or at all or for any cause or reason whatsoever. If the work done under this permit in any manner involves the disturbance of the travelled surface of the road, said portion of the traveled surface of the road shall be restored at the completion of said work to the satisfaction of the State Highway Engineer, and if the Grantee should fail and/or refuse to restore said traveled surface to the satisfaction of the State Highway Engineer, said surface may be restored by the Highway Department at the expense of the Grantee. Neither the acceptance of this permit nor anything herein contained shall be construed as a waiver by the Grantee of any rights given it by the Constitution or laws of the State of Idaho or of the United States.
