The site consists of. four (4) parcels and is generally located near the northeast corner of S. Meridian Road and E. Overland Road. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note. This is not a building permit. Please contact Building Services at (208) 887-2211 to verify submittal requirements. You Hurst complete this process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about buildingpermits and inspections. Site Specific Conditions of Approval 1. The subject property abuts W. Overland Road which is designated a mobility arterial. Per ACHD's master street map (MSP), future right-of-way (ROW) width needed for preservation is 124 feet. If ACRD requires the dedication of additionally ROW per the MSP, the applicant shall submit revised plans (site and landscape) to the City of Meridian Planning Division for approval prior to commencing with site development. 2. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line and/or all rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way in accord with UDC 11-3A-19A.1e. 3. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Conditions Document I{endall Auto Group Sales and Service Bldg CZC & DES 4. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. The site plan prepared by Straightline Architects, dated 11/08/13, labeled A1.0, is approved (stamped "approved" on 11/12/13 by the City of Meridian Planning Division) with the following comments: a. Prior to the issuance of a building permit, the applicant must obtain approval of a flood plain development permit. b. Vehicle display is prohibited in the required landscape buffers in accord with UDC 11 -3B -7C.6 and UDC 11-4-3-38E. c. Vehicle display and vehicle parking is prohibited on retail pad site "M". d. A screened outdoor storage yard for inoperable vehicles is not proposed or approved with the subject application. All inoperable and/or dismantled vehicles shall be stored within the building and shall not be visible from the street in accord with UDC 11-4-3-38B. 6. The landscape plan prepared by Jensen Belts Associates, dated 11/08/13, labeled L1.0, is approved (stamped "approved" on 11/12/13 by the City of Meridian Planning Division) with the following comments: a. The applicant shall obtain ACHD approval (executed license agreement) of the landscape improvements within the S. Country Terrace Place right-of-way adjacent to the south and east boundary. If the right-of-way cannot be landscaped as proposed, the applicant must submit a revised landscape plan for Planning Division approval. NOTE. ACHD's approval of the proposed landscaping is critical to applicant's compliance with the landscape requirements associated with the vehicle sales specific standards set forth in UDC II -4-3-38D. b. Upon installation of the landscaping and prior to inspection by the Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 7. The building elevations prepared by Straightline Architects, dated 08/19/13, labeled Sheet A5.1, and A5.2 are approved (stamped "approved" on 11/12/13 by the City of Meridian Planning Division) with no changes. 8. The site plan, landscape plan and building elevations shall not be altered without prior written approval from the City of Meridian Planning Division. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site (CZC-13-103, AZ -06-037, PP -06-035, FP -07-007, MDA -13-004 and Development Agreement Instrument No. 113122972. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or properly owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-313. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the approved vehicle sales use as set forth in UDC 11-4-3-38. 8. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before November 27, 2013, within fifteen (15) days after the written decision is issued and contain the information listed in UDC 11- 5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure or site shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. There was an old development agreement (DA) in place (from 2005) between Van Auker & the City of Meridian which required on site work to be done. This work was bonded and was never done. When Kendall bought the property, they inherited the old requirements of the DA which was set to expire at years end. The old DA defined a hotel and various pad sites, which are not in-line with the intended automotive sales use. Straightline Architects & Quadrant Engineering filed and was granted approval of the DA modification September 17, 2013. DESIGN REVIEW NARRATIVE: Kendall Auto group will be developing the bare land south of Axiom gym on the corner of Overland and Meridian roads. It is the intent of Kendall Ford to construct an automotive sales facility and light maintenance shop on site. This sales and maintenance facility will conform to the Architectural Character, Color & Material intent of the City of Meridian Design Manual. Some design considerations that were taken into account prior to and during design are as follows: - The building sits low on the site when compared to the elevation of Overland Road. The finish floor when compared to the site access point is 8' lower in elevation. It was of primary concern that the roof of the facility have clean lines void of any obtrusive mechanical units for fear of them becoming a focal point. - The building has public roads an all four sides making conformance to the design manual challenging. It is understood that this facility, due to its location, has a high level of public awareness. This being understood it's important to deliver a meticulously designed facility. - The building will be expanding to the west in the near future so the layout and structure must be flexible and expandable - The Building is owned by the same group as Kendall Ford of Meridian, and thus certain design similarities between the two buildings are desired. Careful placement of all building components plays on the need to be technical in design and function very much like our automobiles. This visual linkage is important to the success of the buildings function. The Design - The fagade and roof line of the new facility varies and provides visual interest by having both linear parapet walls as well as having a rake with a gradual slope. This rake climbs to the center of the structure away from the front facing public elevation. This approach is an attempt to blend into the diverse fabric of adjacent building architecture, such as Axiom and caterpillar, as well as complement the existing Kendall Ford building immediately north. The main buildingfa�ade is clad in horizontally oriented metal panels which have a shadow lined joint edge. This edge creates a series of forms horizontally whilst separating the facade into more visually exciting segments. The metal panels act as a mechanism in which all other exterior building materials align. Paying homage to a technological approach and the automobile, the window mullions align perfectly with the panels further segmenting their shape. The Split face and honed face masonry base aligns its expansion joints to the panels above. The shift in coursing from running bond to stack bond is done to accentuate the strength of the corner panel forms above. Horizontal regulating lines are accentuated by way of the subtle continuation of the horizontal window members by shifting the masonry to half height at each intersection. On the west facing fagade a similar approach is taken using the same metal panel and masonry pallet. The South and west sides will have the most visual exposure to the corner of Meridian and Overland roads, so their materials must align and complement each other. The north and east elevations utilize a combination of metal panels and clean smooth metal siding to create visual rhythm and texture whilst offering a less expensive alternate. These elevations, although still highly visible will be screened somewhat from the adjacent streets because of elevation change and dense plantings. The function of this space will be more utilitarian in nature and so it's appropriate to have the materials be truthful to the surroundings. The entrance overhangs create building surface undulation as well as function to provide shelter, create human scale, and to mark the front entry of the facility. To define the primary public entrance further, the entry vestibule extends further outward at a more human scale making the transition more inviting while making it a recognizable point of access. Such elements should always serve to function and should not be added to simply create interest. Painstaking care was taken to examine the sun angles and height to depth proportion of the space to ensure it functions correctly. Additionally, there is both direct and indirect lighting at the shelf which will at night illuminate the entry and surrounding glass internally. Mechanical equipment is taken completely off the roof due to the building sitting low on the site. All equipment is located on the exterior walls and is screened by extensions of the building. Pedestrian Interconnectivity is accomplished by improvement of the perimeter roadway and improvement of the sidewalkjourney on overland. Internal to the site, the front concrete walkways are configured to create datum's and points of interestto adjacent destinations. For example, the east entrance has the sidewalk extended into the parking lot and runs adjacent to the building ending up at the entrance. The parking lot has internal planters at the building facade to mark the entrance or destination to the car traffic. Visual way finding is an extremely important aspect of the public, especially when confronted with as function such as this. Acknowledgment of the Distriet's Easement. I. Licensee acknowledges that the District's easement for the Ten Mile Drain includes a sufficient area of land to convey irrigation and drainage water, to operate, clean, maintain and repair the ditch or drain, and to access the ditch or drain for said purposes, and is a minimum of 100 feet, 50 feet on either side of the centerline of the ditch or drain facing downstream. LICENSE AGREEMENT - 1 B. Scope of License 1. The Licensee shallhave theright to modify the ditch or drain or encroach upon the District's easement along the ditch or drain in the manner described in the "Purpose of License" attached hereto as Exhibit C and by this reference made a part hereof. 2. Anycrossing, encroachment upon or modification ofthe ditch ordrain and/orthe District's easement shalt be perforated and maintained in accordance with the "Special Conditions" stated in Exhibit D, attached hereto and by this reference made u part hereof. Any difference or discrepancy between the items listed in Exhibit C, "Propose of License," and any plans or drawings referenced in or attached to Exhibit D shall be resolved in favor of Exhibit C. Licensee shall only be permitted to cross, encroach upon or modify the ditch or drain and/or the District's easement as described in Exhibit C even if any plans or drawings referenced or attached to Exhibit D provide or show otherwise. 3. This License Agreement pertains only to the Licensee's crossing, encroachment upon or modification of the ditch or drain and/or the District's easement forthe purposes and in the manner described herein. The Licensee shall not excavate, discharge, place any structures, nor plant any trees, shrubs or landscaping within the District's easement, nor perform any construction or activity within the District's easement for the ditch or drain except as referred to in this License Agreement without the prior written consent of the District. 4. The Licensee recognizes and acknowledges thatthelicensegrantedthis License Agreement pertains only to the rights of the District as owner of an easement. The District has no right or power to create rights in the Licensee affecting the holder of title to the property subject to the District's easement. Any such rights affecting fee title must be acquired by the Licensee from the holder of title to the property. Should Licensee fail to obtain such rights from the holder oftitte to the property or should the rights obtained prove legally ineffectual, Licensee shall hold harmless, indemnify and defend the District from any claim by any party arising out of or related to such failure of rights and at the option of the District this License Agreement shall be of no force and effect. C. Facility Construction, Operation, Maintenance and Repair L Licensee agreesthatthe work performed andthe materials used in anyconstruction permitted by this License Agreement shall at all times be subject to inspection by the District and the District's engineers, and that final acceptance of the such work shall not be made until all such work and materials shall have been expressly approved by the District. Such approval by the District shall not be unreasonably withheld. 2. Each facility ("facility" as used in this License Agreement means any object or thing installed by the Licenseeon, over or in the vicinity of the District's easement) shall be constructed, installed, operated, maintained, and repaired at all times by the Licensee at the cost and expense of the Licensee. 3. Licensee agrees to construct, install, operate, maintain and repair each facility and conduct its activities within or affectingthe District's easement so as not to constitute or cause: a. a hazard to any person or property; LICENSE AGREEMENT - 2 b. an interruption or interference with the flow of irrigation or drainage water in the ditch or drain or the District's delivery of irrigation water; c. an increase in seepage or any other increase in the loss of water from the ditch; d, the subsidence of soil within or adjacent to the easement; e. an interference with the District's use of its easement to access, operate, clean, maintain, and repair the ditch or drain; f. any other damage to the District's easement and irrigation or drainage works. 4. The Licensee agrees to indemnify, hold harmless, and defend the District from all claims for damages arising out of any of the Licensee's construction or activity which constitutes or causes any of the circumstances enumerated in the preceding paragraph, 3.a. through 3.E, or any other damage to the easementand irrigation or drainage works which may be caused by the construction, installation, operation, maintenance, repair, and any use or condition of any facility. S. The Licensee shall, upon demand of the District, remove any facilityor repair any alteration of the District's easement which interferes with the District's operation and maintenance of the ditch or drain, or causes or contributes to any of the circumstances enumerated in the preceding paragraph, 3.a. through V., cr any other damage to the easement mid or drainage works. The District shall give reasonable notice to the Licensee, and shall allow the Licensees reasonable period of time to perform such maintenance, repair, and other work, except that in cases of emergency the District shall attempt to give such notice as is reasonable under the circumstances. The District reserves the right to perform any and all work which the Licensee fai Is or refuses to perform within a reasonable period of time after demand by the District. The Licensee agrees to pay to the District, on demand, the costs which shall be reasonably expended by the District for such purposes. Nothing in this paragraph shall create or support any claim of any kind by the Licensee or any third party against the District for failure to exercise the options stated in this paragraph, and the Licensee shall indemnify, hold harmless and defend the District from any claims made againstthe District arising out of or relating to the terms of this paragraph, except for claims arising from any work which unreasonably exposes the District's employees and agents to the risk of harm from electric power lines, or arising solely out of the negligence or fault of the District. D. District's Rights Are Paramount 1. The Licensee understands and agrees that the ditch or drain is a manmade channel that was constructed and is used and maintained by the District for the exclusive purpose of conveying irrigation or drainage water to lands within the District. As such, Licensee further acknowledges and agrees thattheditch or drain does not constitute a natural or navigable watercourse or stream. 2. The parties hereto understand and agree that the District has no right in any respect to impair the uses and purposes of the irrigation or drainage works and system of the District by this License Agreement, nor to grant any rights in its irrigation or drainage works and system incompatible with the uses to which such irrigation or drainage works and system are devoted and dedicated and that this contract shall be at all times construed according to such principles. 3. Nothing herein contained shall be construed to impair the ditch or drain or the District's easement, and at[ construction and use of the District's easement by the Licensee and the license herein LICENSE AGREEMENT - 3 provided therefor shall remain inferior and subservient to the rights of the District to the use of the ditch or drain for the transmission and delivery of irrigation or drainage water, 4. The Licensee agrees that the District shall not be liable for any damages which shall occur to any facility in the reasonable exercise of the rights of the District in the course of performance of maintenance or repair of the ditch or drain. The Licensee further agrees to suspend its use of the said easement areas when the use of the easement areas is required by the District for maintenance or repair under this or any other paragraph of this License Agreement. S. In the event of the failure, refusal or neglect of the Licensee to comply with all of the terms and conditions of this License Agreement, the license of the Licensee under the terms hereof may be terminated by the District, and any facility, structure, plant, or any other improvement in or over the ditch, and the right of way therefor, which may impede or restrietthe maintenance and operation of such ditch or drain by the District with its equipment for the maintenance of the ditch or drain shall be promptly removed by the Licensee upon demand of the District. L. Applicable Law and Jurisdiction Unaffected, I. Neither the terms of this License Agreement, the permission granted by the District to the Licensee, the Licensee's activity which is the subject of this License Agreement, nor the parties exercise of any rights or performance of any obligations of this License Agreement, shall be construed or asserted to extend the application of any statute, rule, regulation, directive or other requirement, or the jurisdiction of any federal, state, or other agency or official to the District's ownership, operation, and maintenance of its drains, drains, irrigation or drainage works and facilities which did not apply to the District's operations and activities prior to and without execution of this License Agreement. 2. In the event the District is required to comply with any such requirements or is subject to the jurisdiction of any such agency as a result of execution of this License Agreement or the Licensee's activity authorized hereunder, Licensee shall indemnify, hold harmless and defend the District from all costs and liabilities associated with the application of such laws or the assertion of such jurisdiction or, at the option of the District, this License Agreement shalt he of no force and effect and the Licensee shall cease all activity and remove any facility authorized by this License Agreement, F. Indemnification 1. In addition to all other indemnification provisions herein, Licensee further agrees to indemnify, hold harmless and defend the District from any injury, damages, claim, lien, cost and/or expense (including reasonable attorney's fees) incurred by, or asserted against, the District by reason ofthe negligent acts or omissions of Licensee or its agents, contractors or subcontractors in performing the construction and activities authorized by this License Agreement. G. Fees and Costs 1. The Licensee agrees to pay attorney fees and engineering fees charged by the attorney for the District or by the engineers for the District in connection with the negotiation and preparation of this LICENSE AGREEMENT - 4 License Agreement. 2. Should either party incur costs or attorney fees in connection with efforts to enforce the provisions of this License Agreement, whether by institution of suit or not, the party rightfully enforcing or rightfully resisting enforcement of the provisions of this License Agreement, or the prevailing party in case suit is instituted, shall be entitled to reimbursement for its costs and reasonable attorney fees from the other party. H. Miscellaneous I. No Claims Created. Nothing in this License Agreement shall create or support a claim of estoppel, waiver, prescription or adverse possession by the Licensee or any third party against the District. 2, Assianment. Neither this License Agreement nor any agreement entered pursuant to this License Agreement may be assigned or transferred without the prior written approval of the Parties, which approval shall not be unreasonably withhold. 3. Amendment and Modification. Any amendment or modification of this License Agreement must be in writin and signed by all parties to be enforceable. 4. Interpreted. This License Agreement shall be interpreted and enforced in accordance with the laws of the State of Idaho. This License Agreement is not intended for the benefit of any third party and is not enforceable by any third party. If any provision of this License Agreement is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, all remaining provisions of this License Agreement shall remain in frill force and effect. The parties represent and warrant to each other that they each have authority to enter this License Agreement. EXHIBIT C Purpose of License The purpose of this License Agreement is to permit Licensee to: j; construct and install a retaining wall, along with landscaping on top of said retaining wall, within the District's easement for the Ten Mile Drain; and 2. construct and install an asphalt parking area, along with eight (8) light poles, within the District's easement for the Ten Mile Drain, all within Licensee's real property described in Exhibit A, Cope Subdivision, located northeast of the intersection of Overland Road and Meridian Road in Meridian, Ada County, Idaho. No other construction or activity is permitted within or affecting the Ten Mile Drain or the District's easement. EXI-l1BIT D. Special Conditions a. The construction described in Exhibit C shall be in performed in accordance the plans attached hereto as Exhibit D-1 and by this reference incorporated herein. b. Licensee shall notify the District prior to and immediately after construction so that he or the District's engineer's may inspect and approve the construction. C. Licensee acknowledges and agrees that should any vehicles, whether owned by Licensee, Licensee's customers or guests, which are located within the asphalt parking area and within the District's easement, need to be removed in order for the District to access, operate, maintain or repair the Ten Mile Drain, Licensee shall immediately remove said vehicles upon the request of the District and it shall be Licensee's obligation and cost of removing said vehicles from the District's easement. d. Licensee further acknowledges andagrees thatshould the retainingwall or landscaping need to be removed in order for the District to access, operate, maintain or repair the Ten Mile Drain, it shall be Licensee's obligation and cost of removing or replacing the retaining wall or landscaping. Licenseefurther agrees that the District shall not be liable for any damages which shall occur to the retaining wall, landscaping, lights or parking area in the reasonable exercise of the rights of the District in the course of performance of maintenance or repair of the Ten Mile Drain. e. Construction shall be completed within one year of the date of this Agreement.
