Strict adherence or application of the requirements are not feasible; or Staff finds it is not feasible to require strict adherence to the UDC in this case as the requirement for a gate at the entries of the private streets would create an unnecessary separation and barrier between 1 S of the 26 homes in this development. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and Staff finds the proposed monuments placed at each corner of the intersecting public/private streets will distinguish the private from the public streets without creating a barrier within the subdivision. Therefore, Staff finds the proposed alternative provides an equal means of complying with the intent of the UDC in this instance. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. Staff finds the alternative means of complying with the intent of the ordinance will not be detrimental to the public welfare nor will it impair the residential use of the property or the character of surrounding properties. The applicant, Director, or a party of record may request City Council review of a decision of the Director. Broadway Ave Meridian, Idaho 83642 RE: Bellabrook Villas Subdivision (aka Brookside Square) Dear Staff, Please accept this Alternate Compliance application for Bellabrook Villas (aka Brookside Square), which is located at 300 S. Locust Grove Road, approximately 900 feet south of Franklin Road in Meridian, Idaho, Section 17, Township 3 North, Range 1 East of the Boise-Meridian. The site is 4.38 acres in size and is currently zoned R-15. We are requesting acceptance of an alternative to the gate requirement found in UDC 11.3F.5 which requires gates to be installed 50 feet back of the intersections of the private and public streets in this development. Strict adherence to these requirements would create an unnecessary separation between the neighbors of this small development. By substituting the proposed monuments at each corner of the intersections of the private and public roads within the development, the desired distinction between the private and public road is achieved without creating a physical barrier between the homes of the subdivision.
