AN ORDINANCE AMENDING ORDINANCE N0.03-1039
AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, AMENDING
ORDINANCE NO. 03-1039 FIRE CODE ORDINANCE ADOPTING THE
INTERNATIONAL FIRE CODE 2000 TO AMEND SUBSECTION 104.1 GENERAL
OF 10-4-2 OF THE MERIDIAN CITY CODE OF THE CITY OF MERIDIAN TO
PROVIDE FOR RE-LETTERING OF THE A-H SUBSECTIONS TO LETTERING
OF A-G; TO PROVIDE FOR VALIDITY, PENALTY, SEVERABILITY, CONFLICT,
SAVINGS CLAUSE, AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Section 10-4-2 of the Fire Code Ordinance Adopting The International
Fire Code 2000 to amend subsection 104.1 General of the Meridian City Code of the City of
Meridian, be, and the same is hereby amended to read as follows:
104.1 General. The code official is hereby authorized to enforce the provisions of this code
and shall have the authority to render interpretations of this code, and to adopt policies,
procedures, rules and regulations in order to clarify the application of its provisions.
Such interpretations, policies, procedures, rules and regulations shall be in compliance
with the intent and purpose of this code and shall not have the effect of waiving
requirements specifically provided for in this code.
The fire chief is authorized to administer and enforce this code. Under the chief s
direction, the fire department is authorized to enforce all ordinances of the jurisdiction
pertaining to:
a. the prevention of fires;
b. the storage, use and handling of hazardous materials;

c. the installation and maintenance of automatic, manual and other private fire
alarm systems and fire-extinguishing equipment;
d. the maintenance and regulation of fire escapes;
the maintenance of fire protection and the elimination of fire hazards on
land and in buildings, and other property, including those under
construction;
f. the maintenance of means of egress, and
g. the investigation of the cause, origin and circumstances of fire and
unauthorized releases of hazardous materials, for authority related
to control and investigation of emergency scenes, see Section 104.11.
SECTION 2: VALIDITY: Should any section, paragraph, sentence, clause or phrase of this
Chapter or of the Code hereby adopted be declared unconstitutional or invalid for any reason
or cause, the remainder of said Chapter or Code shall not be affected thereby and the same
shall not invalidate or void the remainder of this Chapter or said Code. (2002 Code)
SECTION 3: PENALTY: Any person violating the provisions of this Chapter shall be
deemed guilty of a misdemeanor. (2002 Code)
SECTION 4: SEVERABILITY: The provisions of this chapter shall be deemed severable
and a finding by a court of law that a provision of this chapter is unlawful shall have no
effect on the remaining provisions.
SECTION 5: All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6: SAVINGS CLAUSE: This ordinance does not affect an action or proceeding
commenced or right accrued before this ordinance takes effect.
SECTION 7: DATE OF EFFECT: This ordinance shall be in full force and effect after its
passage, approval and publication, according to law.

This ordinance amends Ordinance No. 03-1039 of 10-4-2 of the Meridian City
Code, and provides for the amendment to the adoption of the 2000 Edition of the
International Fire Code into the Meridian City Fire Code, to amend subsection 104.1 to
provide for re -lettering from a-h to a-g.
A full text of this ordinance is available for inspection at City Hall, City of
Meridian, 33 East Idaho, Meridian, Idaho. The ordinance will be effective after its
passage.
