04-424 Non Discrimination RESOLUTION NO. 04--.-fl1- BY: /:ú tA Ih 'r- tL- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MERIDIAN, SETTING FORTH CERTAIN FINDINGS AND PURPOSES; PROVIDING FOR THE ADOPTION OF THE POLICE REGARDING NON-DISCRIMINATION ON THE BASIS OF DISABILITY FOR THE CITY OF MERIDIAN. WHEREAS, the Mayor and Council have the authority [pursuant to Ie. ~ 50- 302J to establish resolutions not inconsistent with the laws of the state of Idaho"s may be expedient, in addition to the special powers therein granted, to maintain the peace, good govemment and welfare of the corporation and its trade, commerce and industry; and WHEREAS, the Mayor and Council have deemed it expedient and in the best interests of the City of Meridian to adopt a Policy Regarding Non-Discrimination On The Basis OfDisability. WHEREAS, the Congress of the United States has passed Section 504 ofthe Rehabilitation Act of 1973 which requires that "No otherwise qualified individual with handicaps in the United States...shall, solely on the basis of his or her handicap, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving federal financial assistance"; and, WHEREAS, the City of Meridian is applying for an Idaho Community Development Block Grant and is required to comply with Section 504 of the Rehabilitation Act of 1973; and, WHEREAS, the failure to comply with the terms and conditions of Section 504 of the Rehabilitation Act may cause the City to lose its grant or eligibility for future grants; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AJ\D CITY COUNCIL as follows: 1. It is the policy of the City that all programs and activities shall be accessible to, and usable by qualified persons with disabilities. 2. That the City shall undertake an evaluation conducted in consultation with citizen groups involving persons with disabilities, of its programs, policies, procedures and facilities in order to determine those areas where discrimination may occur. 3. The City shall, upon completion of said evaluation, make such revlsions, modifications, or other changes so as to fully comply with the letter and intent of Section 504. 4. Further, the City shall, where building modifications are required, develop and implement a transition plan for the timely elimination of structura] barriers to citizens with disabilities. 5.
