A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MERIDIAN, SETTIl\G
FORTH CERTAIN FINDINGS AND PURPOSES; PROVIDING FOR THE ADOPTION
OF A RESIDENTIAL ANTI-DISPLACEMENT AND RELOCATION ASSISTANCE
PLAN (UNDER SECTION 104(d) OF THE HOUSING AND COMMUNITY
DEVELOPMENT ACT OF 1974, AS AMENDED) FOR THE CITY OF MERIDIAN.
WHEREAS, the Mayor and Council have the authority [pursuant to I.C. § 50-302] to
establish resolutions not inconsistent with the laws of the state of Idaho as may be expedient, in
addition to the special powers therein granted, to maintain the peace, good government and
welfare of the corporation and its trade, commerce and industry; and
WHEREAS, the Mayor and CounciJ have deemed it expedient and in the bcst interests of
the City of Meridian to adopt a policy regarding residential anti-displacement and relocation
assistance.
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN,
IDAHO:
1. The City of Meridian will replace all occupied and vacant occupiable low.and.
moderate income dwelling units demolished or converted to a use other than as low/moderate
income housing in connection with an activity assisted with funds provided Llilder the HoLLsing
and Community Development Act of 1974, as amended, as described in 24 CRF 570.606(b)
through (g).
2. All replacement housing will be provided within three (3) years after the
commencement of the demolition or conversion. Before entering into a contract committing The
City of Meridian to provide funds for an activity that will directly result in demolition or conversion,
the City will make public by publication in a newspaper of general cirCLllation and submit to the
Idaho Depmiment of Commerce the following infonnation in writing:

A description of the proposed assisted activity.

Tbe location on a map and number of dwelling units by size (number ofbcdrooms)
that wiJl be demolished or converted to a use other than as low/moderate income
dwellings units as a direct result of the assisted activities.

3.
A time schedule for the commencement and completion of the demolition or
converSIOn.
The location on a map and the number of dwelling units by size (number of
bedrooms) that will be provided as replacement dwelling units. Jf such data is not
available at the time of the general submission, the County will identify the general
location on an area map and the approximate number of dwelling units by size and
provide information identi fying the specilìc location andl1LlIllbcr of dwelling units by
size as soon as it is available.

The source of funding and a time schedule for the provision of the replacement
dwelling units.

The basis for concluding that each replacement dwelling unit will remain a
low/moderate income dwelling unit for at least ten (10) years from the date ofinitial
occupancy.
7.
Information demonstrating that any proposed replacement of dwelling units with
smaller d welling units, e.g., a two-bedroom unit w jth a 2 0 ne-bedroom u nit, is
consistent with the housing needs of lower income households in the jurisdiction.
3. The City of Meridian, (208) 888-4433, is responsible for tracking the replacement of
housing and ensuring it is provided within the required period.
4. Thc City of Meridian, (208) 888-4433, is responsible for ensuring requirements are
met lor notilication and provision of relocation assistance, as described in CFR 570.606(b) through
(g). to any lower income person displaced by the demolition of any dwelling unit or the conversion
of a low/moderale income dwelling unit to another use in connection with an assisted activity.
5. Consistent with the goals and objectives of activities assisted under the Act, the City
will take the following steps to minimize the displacement of persons from their homes.
1.
Coordinate code enforcement with rehabilitation and housing assistance programs
2.
Evaluate housing codes and rehabilitation standards in reinvestment areas to prevent
placing undue financial burden on long-established owners or tenants ofmulti-family
buildings.
3.
Stage rehabilitation of apartment units to allow tenants to remain during and after
rehabilitation by working on empty units or buildings first.

Adopt public policies to identify and mitigate displacement resulting from intensive
public investment in neighborhoods.

Adopt policies that provide reasonable protection for tenants faced with conversion
to a condominium or cooperative.
7.
To the extent pennitted by law, adopt tax assessment policies (such as deferred tax
payment plans) to reduce impact of rapidly increasing assessments on lower income
owner-occupants or tenants in revitalizing areas.
8.
Establish counseling centers to provide homeowners and renters with information on
the assistance available to help them remain in their neighborhood in the face of
revitalization pressures.
6. By passage of this Resolution, the City of Meridian hereby certi tics it has officially
adopted and hereby publishes said Residentia] Anti-Displacement and Relocation Assistance Plan.
The City of Meridian shall include one or more of the above to implement the planning for
minimizing the direct and indirect displacement of persons ITom their homes as a result of an assisted
acUvity.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY

1. EFFECTIVE DATE. This Resolution shall be in full force and effect
immediately upon passage.
