APPLICATION SUM_YIARY `.' ~. The applicant, Silver Oaks Apartments, LLC, requests approval of a two year time extension in order to obtain the City Engineer's signature on a final plat for Avendale Subdivision. The preliminary plat (PP-l 1-001) for Avendale Subdivision was approved by the Meridian City Council on July 26, 2011. Per Unified Development Code (LTDC) 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signatuure on the final plat within 2 years of the approval of the prclirninary plat. Per the conditions of approval, the preliminary plat would otherwise expire on Juiy 26, 2013. The Applicant states in the application narrative that the project has been delayed due to economic and real estate market conditions that have impacted the development timetable. Because the Applicant is unable to meet the time requirements specified in the UDt;, a time extension is requested. A time extension will allow the applicant to continue with development of the project. The subject property is located north of W. Franklin Road and west cif N. Ten Mile Road, in the SE of Section 10, T.3N., R.1 W. The applicant also rega~ested a time extensive on the conditional ~atse permit (C."UP-1 D-Ol ~) approved for the nsulti family development. II. STAFF RFCOMMIJNDATION Staff recommends approval 01' a. two year time extension on the preliminary plat to obtain the. City Engineer's signature on a final plat for Avendale Subdivision to expire on July 26, 2015. III. STAFF AIoTALYSIS The City of Meridian's Unified Development Code (UDC 11-6B-7C and UDC 11-SB-bF) allows the Director to authorize one administrative time extension to obtain City Engineer's signature on a final plat, not to exceed two years, when the applicant tiles a written request for an extension prior to the expiration of the approved preliminary plat. 'The applicant has met the necessary deadline by filing a written request be-fore the preliminary plat expires. Additional time extensions up to two years may be granted if approved by City Council. With all extensions, the City may require compliance with the cur<•ent provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Irr addition, the City Council provided staff with guidelines to use when evaluating time extension requests. These guidelines are meant for guidance anti not as a mandate. Staff has reviewed the aforementioned guidelines provided by City Council in relation to this project Avendale Sub TED-13-001 PAGE 1 and believes the project complies with current provisions of the UDC; however, because the City utilities were never completed, Staff recommends as a condition of the subject time extension that the applicant comply with current standards. The City of Meridian requires that the owner post to the City a performance surety in the amount of 125% ofthe total construction cost for all incomplete sewer, water and reuse infrastructure prior to final plat signature. This surety will be verified by a line item cost estimate provided by the owner to the City. The surety can be posted in the form of an irrevocable letter of credit, cash depositor bond. "1'he City of Meridian requires that the owner post to the City a warranty surety in the amount of 20% of the total construction cost for all completed sewer, wafer and reuse infrastructure foz• duration of two years. Please contact Land Development Service for more information at 887- 2211. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required nn all public roadways per the City of Meridian Improvement Standards for Stz•eet Lighting, All street lights shall be installed at developer's expense. Final design shall be 5trbmitted as part of the development plan set for approval, which must include the location of any existing street lights. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC.
