Heron Village Apartments Building ACERTIFICATE OF ZONING COMPLIANCE REPORT /� Cif fEf IDIAN�, - IDAHO DATE: October 9, 2013 TO: Dave Evans Construction FROM: Kristy Vigil, Assistant City Planner SUBJECT: Heron Village Apartments Building A - CZC-13-120 and DES -13-117 OWNER: Heron Village Apartments, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Dave Evans Construction, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval for construction of a 22,528 square -foot multi -family apartment building with 24 dwelling units. This building is proposed to develop with (6) 1 -bedroom units and (18) 2-3 bedroom units. The gross density is 19.63 dwelling units per acre. The site is on 5.5 acres of land in the R-40 & C -G zoning districts. This CZC and DES approval are for building elevations, garage elevations, and carport elevations only. Site layout and landscaping for Heron Village Apartments have been approved with CZC-13-038 and DES -13-039. The site is located at 51 E. Blue Heron Lane. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Division plans, stamped and signed by the architect and/or civil engineer as applicable. You must provide these plans in PDFformat and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. Conditions Document 1 Heron Village Apartments Building A - CZC-13-120 and DES -13- 117 3. The approved elevations may not be altered without prior written approval of the City of Meridian, Planning Division. 4. The elevations prepared by Dave Evans Construction on August 27, 2013, labeled A2.4, A4.0, A4.1, and color renderings are approved (stamped "approved" on October 9, 2013 by the City of Meridian Planning Division) with no changes. 5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -12-021, CZC-13-038, and DES -13-039). 2. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 3. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11 -4-3 -27. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before October 24, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Broadway Avenue Meridian, Idaho 83642 Re: Heron Village Apartments Design Review/Certificate of Zoning Compliance The proposed project is for five Multi -Family Apartment Buildings consisting of four 25,603 SF 24-Plex buildings and one 16,185 SF 12-Plex building as well as six garage buildings on a 5.5 acre site. It is located on the corner of North Meridian Road and East Blue Heron Lane in the J E Pfosts Subdivision. The zoning designation is General Commercial (C -G) and Residential (R-40). The site layout is based on the approved CUP -12-021, CZC-13-038, DES -13-039 and development construction plans for the subdivision. The building design responds to the city's adopted design manual. As instructed by staff the applicant used the Residential Design Guidelines. All of the facades are designed to address site influences as well as building scale and form. The facades of the building are broken up using pop -outs at the second and third level clad in hardi-shake siding along with gables to break up the roof line. The entry features also extend away from the building to to break up wall planes and roof lines. Where walls are continuous the use of two types of siding, horizontal hardi-plank and vertical hardi-board and batt, are used to break up the planes and add definition. The roof material is thirty year asphalt composite shingle. The garage buildings are of two types. The four buildings along Meridian Road are designed with an articulated wall broken up with material changes and gables to provide interest. The carports will be constructed of prefabricated steel construction, however the fascia & columns will be painted to match the trim & accent colors of the apartment buildings. Mechanical equipment will exist along the North, South, East and West of each 24-plex, and the east of the 12-plex. The equipment will be screened by a four foot high vinyl fence. This will include air conditioning condensers mounted at grade and a gas meter. Please refer to the attached submitted materials for additional information. Thank you for your time and consideration.
