Broadway Ave. Meridian, ID 83642 Re: Creekstone Subdivision Project Narrative To Whom It May Concern: This letter is to inform the City of Meridian's Planning and Zoning Department that Dave Yorgason with Tall Timber Consulting, LLC is an agent acting on behalf of the Boslau Family Trust that is requesting annexation and a preliminary plat approval for the Creekstone Subdivision. The following is a narrative to accompany the applications for this subdivision. Rod and Nanci Boslau have lived at this site on 3800 W. Pine Ave for nearly 20 years. As they are approaching retirement and as development is to the north, west and south of their property, they are ready for their property to be developed. The site is approximately 6.9 acres and is located on the north side of Pine Avenue between Ten Mile Road and Black Cat Road. The property is currently zoned RUT (Rural Urban Transition). It is our desire to have this property annexed into the City of Meridian and zoned R-8 (medium density residential). We are proposing to construct thirty two (32) residential lots, and six (6) common lots. West of this site is the Castlebrook subdivision (zone R-8) and to the south is the Chesterfield subdivision (zone R-8). North and east of this site is the Ten Mile Drain ditch. North of the drain ditch is a Meridian City park - Fuller Park, and to the east of the drain ditch are existing small agricultural home sites near Ten Mile Road. The comprehensive plan designation for this site is Medium Density Residential. The requested R-8 zone is consistent with City's planned density for this site. We are not requesting any special variances. As this site does not own any portion of the adjacent Ten Mile Drain ditch, the access for this development will come from the west on Pine Avenue. There is a stub street from the adjacent subdivision (Castlebrook) to the west that will also provide connectivity for the Creekstone Subdivision. Page 1 of 4 The Creekstone Subdivision has over 10 percent open space (approximately 12.7 percent counting only half of the common area along Pine Avenue and excluding the common lot for a shared driveway). The one required amenity is the installation of a pathway along the Ten Mile Drain ditch, which will connect to the existing pathway to the west that leads to the City of Meridian's Fuller Park. Another pathway is added from within the subdivision to the pathway along the Ten Mile Drain to enhance connectivity and access. These pathways will enhance the walkability and livability of the area and will serve as a place for residents and surrounding neighbors to walk and enjoy the community. The Creekstone HOA will have the responsibility to maintain the six (6) common lots within the subdivision, including the landscape frontage along Pine Avenue and along the Ten Mile Drain. The HOA will also maintain the landscape island within the public right-of-way that is internal to the subdivision. Included in this application are color renderings of sample single -level and two-story homes that are anticipated to be similar to homes that will be in Creekstone. These renderings show the anticipated size and style of homes and details of the elevations. The colors of the homes are planned to be earth tone and each home is planned to have stone accents or other details to enhance the front elevations. As we have discussed developing this site with various builders, one builder recently expressing interest in building on this site stated they would offer up to 6 different house plans and many varying color choices. This variety is important to us as the Boslau's have lived on this site for many years and they desire to have a quality development that they can reflect upon and appreciate in the future. Each lot in this development is proposed to be served by irrigation from the Nampa -Meridian Irrigation District. Based on initial discussions with the irrigation district, we will connect to the existing pressure irrigation lines from adjacent developments and if necessary upgrade the pumps at existing pumping stations. The building lots will be served with utilities from the City of Meridian and the streets will be dedicated to the public, owned and maintained by the Ada County Highway District. All design standards in the application for the Creekstone Subdivision are consistent with the City of Meridian's Uniform Development Code. For clarification, there are two home sites in the northwest corner of this subdivision that are designed to take access off of a common, or shared, driveway. When we met with City staff, staff suggested the City is considering changing the design standard for common driveways and to have them within a common lot, which is what our design provides. If the City prefers these common driveways to not be in a common lot, we are ok with that as well. The plan is to develop the Creekstone Subdivision in one phase. Site Challenges As is typical with many infill development sites, this particular site has a few challenges that we are addressing. Two of these challenges are: 1) the Pine Avenue improvements along the southern property boundary and 2) the lack of an irrigation easement along the Ten Mile Drain ditch. Page 2 of 4 The southern boundary is not located along the future centerline of Pine Avenue; instead it is about 10 -15 feet south of the centerline of the road. Apparently, not all the property boundaries in this area go to the section line or the current alignment for Pine Avenue. Due to the current alignment of Pine Avenue, the development to the south (Chesterfield) has minimal improvement requirements for Pine Avenue. As we have discussed this with ACHD, our site will most likely have the burden to build its proportionate share of the street improvements plus the remaining portion of the asphalt to the southern boundary. The net result is an added burden of cost to our parcel that is smaller than the surrounding developments. Nonetheless, our design for Pine Avenue meets ACHD's requested road width and improvements. The other primary concern we have addressed is the lack of an official irrigation easement along the Ten Mile Drain ditch. We had several discussions with Greg Curtis and Nampa -Meridian Irrigation District and met him on site to discuss their concerns. This site does not include the drain ditch as it is off our property. The property boundary is actually fairly close to the top of the ditch bank and there is a separate parcel, not owned by this owner, which includes the ditch. The irrigation district would like to have a 50 foot easement from the center of the drain ditch. We would like to accommodate as much as we can, however we are intending to extend the existing pathway from Castlebrook along the Ten Mile Drain and landscape it as an amenity for this site and our neighbors. Another problem is the existing home would be within the 50 foot easement. By bringing this development forward we think we are able to resolve these problems. Based on our conversations with the irrigation district, the following are the parameters we anticipate will be in a license agreement with Nampa Meridian Irrigation District: 1. At final plat (or through the license agreement process), we will provide a 50 foot easement from the centerline of the ditch. 2. Within the 50 foot easement, a. There will be a maintenance access area for the irrigation district that is a minimum of 18 feet from top of ditch bank. b. The development and/or the HOA will not install additional trees in this 18 foot wide maintenance access area. c. The ditch company will allow an asphalt pathway within the 18 foot maintenance access area. This will be allowed under the terms of the master agreement between the City of Meridian and the irrigation district. d. The irrigation district will allow the following encroachments outside of the 18 foot maintenance access area (but in still in the 50 foot easement): i. Landscaping, including trees, grass and sprinklers, H. Fencing iii. Existing home e. The Creekstone HOA will maintain the entire common lot, including the pathway and the 18 foot clear access area. Nearly all of the irrigation district's easement will be in a common lot and the HOA will have the responsibility to maintain this common lot. Most of the lots will have about 5 feet of this irrigation district Page 3 of 4 easement in the building lots, and the pressure irrigation mainline will be within this easement like any other normal easement. The only exception is the 3 lots where there is an existing home and some mature trees. The irrigation district has stated they will accept this encroachment as we are improving their access along the ditch. In summary, we believe our plan provides the needed maintenance access easement for the irrigation district and it enables the subdivision to have a nice amenity, including fencing, trees and a pathway that will connect from Pine Avenue to the existing pathway behind Castlebrook and to Fuller Park. We are pleased to bring these applications for Annexation and Zoning and a Preliminary Plat for the Creekstone Subdivision to the City of Meridian for consideration and approval.
