DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Cary Hooper, requests Certificate of Zoning Compliance (CZC) and Alternative
Compliance (ALT) approval for construction of a new parking lot for the existing building in the
C -G zoning district.
The site is located at 44 and 52 S. Meridian Road,
ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC
The applicant requests alternative compliance to UDC Table 11-2B-3 which requires a 35 foot
wide street buffer to entryway corridors. The applicant proposes to construct a 25 foot wide
buffer along S. Meridian Road instead of a 35 foot wide buffer as required. As an alternative
means of complying with the intended purpose of the requirement, the applicant proposes to
install additional trees and shrubs within the street buffer along S. Meridian Road and the
required parking lot landscape buffers.
The reason for the request is because the required 35 foot wide buffer would reduce the actual usable
property by 26 percent. In addition, the required parking lot landscape buffers along the south and east
property lines would exceed 44 percent of the site and hinder any effective use of the site. Furthermore,
the requested landscape buffer reduction would bring continuity to the street frontage of the adjoining
property.
In order to grant approval for alternative compliance, the director shall determine the
following findings:
1. Strict adherence or application of the requirements is not feasible; OR
Because of site constraints and the reduction in usable area of the property, the Director finds
strict adherence to UDC Table 11-2B-3 is not feasible.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The Director finds the applicant's alternative means for meeting the requirements of the UDC as
discussed above provides an equal or superior means of compliance as additional trees and shrubs
will be provided on the site.
3. The alternative means will not be materially detrimental to the public welfare or impair the
intended uses and character of the surrounding properties.

The Director finds that the proposed alternative will not be detrimental to the public welfare or
impair the use/character of the surrounding properties since additional trees and shrubs beyond
the required amount will be provided on the site.
DECISION
The applicant's request for Certificate of Zoning Compliance and Alternative Compliance is
approved with the conditions listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-22II to
verb if you need a building permit and/or inspection. If you do need a building permit, you
must complete that process before you commence fire use or construction. As part of the
application submittal, you will need to provide one set of the final, stamped "approved"
Planning Department plans, stamped and signed by the architect and/or civil engineer as
applicable. You must provide these plans in PDFformat and hardcopy as specified in the
Building Services "Plan Intake Checklist" and include them with your building submittal set.

Process Conditions of Approval

compliance to UDC Table 11-2B-3 regarding the reduced street buffer along S. Meridian
Road. See Analysis above for more information.
3. No signs are approved with this application. Prior to installing any signs on the
property, the applicant shall submit a sign permit application consistent with the
standards in UDC Chapter 3 Article D and receive approval for such signs.
4. The applicant shall complete all improvements related to public life, safety, and
health as set forth in UDC I1 -5C -3B. A surety agreement may be accepted for other
improvements in accord with UDC 11 -5C -3C.
5. Upon installation of the landscaping and prior to inspection by Planning Division
staff, the applicant shall provide a written certificate of completion as set forth in
UDC 11 -3B -14A.
6. The site/landscape plan prepared by Architecture Northwest, PA on May 15, 2013,
labeled L-3.0, is approved (stamped "approved" on August 27, 2013 by the City of
Meridian Planning Division) with no changes.
7. The approved site/landscape plan may not be altered without prior written approval
of the City of Meridian Planning Division.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
9. If any changes must be made to the site plan to accommodate ACHD requirements,
the applicant shall submit a new site plan to the City of Meridian Planning Division
for approval prior to issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a
Certificate of Occupancy. It is unlawful to use or occupy any building or structure
until the Building Official has issued a Certificate of Occupancy.

Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide
irrigation that meets the standards as set forth in UDC 11-313-6 and to install and
maintain all landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-
313-14.
2. The project is subject to all current City of Meridian ordinances and previous
conditions of approval associated with this site (CZC-01-059).
3. The issuance of this CZC does not release the applicant from any previous
requirements of the other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all
trees to a minimum height of six feet above the ground or sidewalk surface to afford
greater visibility of the area.
5. The applicant has a continuing obligation to comply with the outdoor lighting
provisions as set forth in UDC 11-3A-11.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with
the standards in UDC I 1-3A-3.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director.
All requests for review shall be filed in writing with the Planning Department on or before
September 11, 2013, within fifteen (15) days after the written decision is issued, and contain the
information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the
use has not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.

Certificates of Zoning Compliance issued in conjunction with construction or alteration of a
structure shall expire if the construction or alteration has not commenced within one year of the
date of issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
August 27, 2014.

REQUEST: Specific requirements proposed to be modified:
Item 1. 35' Entryway corridor requirement per table 11-26-3 of Meridian City Code
M.C.C. is proposed to be reduced to 18'.
The proposed reduction to the Entryway corridor landscape buffer was determined by
matching the existing landscape buffer, this existing 18' buffer extents South for the
length of approx. 180' and North from the proposed property to the intersection of S.
Meridian Road and E. Franklin Road. Also, if the required 35' landscape buffer was
installed, it would reduce the actual useable area of the property by 26% with the
other landscape buffers on the South and East property lines the total landscaped
area of the site would exceed 44% extremely hindering any effective use of the site.
The proposed landscape reduction would bring continuity to the street frontage
adjoining the property. Our understanding of the requirement for the landscape buffer
is to bring an attractive continuity to the entryway corridor of Meridian. The 17' jump in
landscape buffer to meet the required code would cause visual irregularity within the
corridor as well as potential confusion with the lot being a place of public refuge or a
"pocket park" due it the substantially larger expanse of landscape compared to the
adjoining properties.
The proposed landscape reduction provides visual clarity, eliminating the confusion of
visual irregularity and still allows the owner to provide enough appropriate
landscaping to make an attractive and inviting parking lot for his customers.
