DESCRIYTIOI`i ()F AYPI.,ICANT'S REQUEST The applicant, Copper Basin HOA, zequests Certificate of toning Compliance (CLC} and Design Keview (DES) approval for construction of a new swimming pool, kiddie pool, and restroom/equipment building and Alternative Compliance (ALT) approval to reduce the number of required parking spaces on an existing common area in the R-4 zoning district. The site is located at 827 E. Kaibab Trail Drive (Parccl# R1487730470). ANAL~'SIS OF UDC REQUI1tEME1~ITS RELATED TO SITE SPECIFIC COl®1DITIOIVS: The applicant z•equests alternative compliance to UDC 11-3G6B which requires one parking space for every 500 square feet of gross floor area for nonresidential uses in residential districts. CuzTently, a 605 square-foot gazebo is located on the site and the applicant is proposing a 489 square-foot restroom/equipment building. Therefore, the applicant would be required to install 2 parking spaces on the site. As an alternative means of complying with the intended puzpose of the requirement, the applicant proposes a private neighborhood pool to exclusively serve the residents of the Copper Basin Subdivision. The swimming pool facility will he enclosed with six-foot tall wrought iron fencing and card-access gates. Additionally, the applicant anticipates the lack of parking on the site will encourage the community to walk or bike to the facility and has proposed to install five bicycle parking spaces in lieu of the one required by UI)C 11-3C-6G. The reason for the request is because the lot includes a lazge unusable area with an AC1 ID retention basin and installing the required parking spaces diminishes the ability to provide an adequate sized facility for the neighborhood. In order to grant approval for alternative compliance, the director shall detef•rninc the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Because of site constraints and the reduction in usable area of the property, the Director finds strict adherence to UDC 11-3C-6B is not feasible, 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Director finds the applicant's alternative means for meeting the requirements of the UDC as discussed above provides an equal or superior means of compliance as the Conditions Document 1 Copper Basin Pool - CZC-13-169; DES-13-104; ALT-13-017 neighborhood pool is for the exclusive use of the residents of the subdivision and additional bicycle parking will be provided on the site. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. These will all be enclosed with a new wrought iron fence with card-access gates. At the request of the adjacent home owners, we have located the restroom/equipment building at the back of the site, away from both of their property lines. All mechanical equipment will: be located within the building, so no additional screening is needed. The site of our proposed project is located at the center of our small subdivision. In the initial development of the neighborhood, a network of asphalt #rails connecting the entire neighborhood to this site were installed. Additionally, concrete sideways line both sides of all streets in the neighborhood. There is no proposed change to these trails or sidewalks. There is currently not a parking lot associated with the neighborhood's sprayground/splashpad. and no new parking lot is proposed. The splashpad was not required to be fenced and thus allowed users from outside of the neighborhood (and city) access to the gazebo and splashpad. The new fencing will limit users to only those living in Capper Basin, thereby greatly reducing motorized traffic. Since the existing gazebo on the site wi11 remain, we have designed the restroom/pool equipment room in a similar style and clad it in similar materials. The roof profile of the gazebo is a hip roof with copper-colored metal roofing. The restroom will also have a hip roof with copper-colored metal roofing. Due to the small scale of the project and even smaller scale of the new building, some of the design manual's intent is not applicable. Where it does apply, we have attempted to follow its guidelines. At the request of the adjacent home owners, we have located. the restroom/equipment building at the back of tl~e site, away from both of their property lines. This follows the intent of the Design Manual to locale mechanical spaces away from public roadways. As described on the attached elevation, (Cobre Basin) Copper Basin Home Owners Association as a representative of the (Cobre Basin) Copper Basin Horne Owners is petitioning to construct a community pool. Pw•suant to city code, calculating the square footage of covered sh'ucture, i.e., Gazebo, Bathroom, and Storage building, 3 parking spaces are required, including one handicapped space. We respectively submit the following solutions in lieu of the designated parking spaces on the property in question. 1. (b} "Site involves space limitations or an unusually shaped lot" The lot includes a large unusable portion set aside as an ACRD required detention basin. Providing tlae parking stalls diminishes the ability to provide an adequately-sized facility for the neighborhood. 2. (c) "Safety considerations make altet7iative compliance desirable;" The location ofthe lot would require that the parking stalls be close to the intersection of E. Kaibab Trial Dr. and N. Red Horse Way causing both a safety hazard for the pedestrians that would be in the area as well as the traffic patterns as the patrons exit. (e) "The proposed design includes innovative desigm features based on "new urbanism", "neotradtitional design", or othez• architectural and/or site designs that promote walkable and mixed use neighborhoods" Given that the entire Copper Basin Subdivision, i.e. homes authorized for use of the facility, is under 214 total homes and located within 4/10 of a mile of the facility we propose a design that encourages alternative means to auto transportation. With the lack of parking on-site we feel that the community would walk, or bike to the facility in lieu of driviz~zg, promoting better health and less enviz~onmental impact. We have incorpoz•ated bicycle parking spaces into the design. While a limited few may need the ability to drive to the facility, we believe this will require less need for parking than the existing splash park as the proposed pool facility will be a private, closed facility limited to the exclusive use of Copper Basin residents. The existing splash park is opened and therefore does not require any type of lcey to access, thus bz•inging in patrons from outside the neighborhood, who often drive to the park. 4. (g) "Additional environmental quality improvements would result fiom the alternative compliance. (Ord.0 09-1394, 3-3-2009, eff Retroactive to 2-4-2009)" The limited area that allows :for the driveway to be 75 feet away fiom the intersection requires little to no landscaping buffer between the community lot and the adjacent private lots owned by members of our association. Without the parking stalls, we are able to blend the landscaping with that recommended in our adopted CC&R's recorded with Ada County. Upon review of the attached plans and the above explanations we request a variance of 13- 3C-6, Meridian City Code. Under the provisions of 1 ] -3C-7, we feel the burden of proof has been met via provisions; A. Favorable Conditions: 1. Shared Use: a. There are convenient pedestrian connections between community facility and its members that will be using the area. b. Although all properties are not within the one thousand feet (1.000') area, there is adequate parking within the one thousand feet standard as provided by the provision. 2. Alternative transportation: a. Alleviating the parking spaces from the plans, promotes alternative forms of transportation to include, but not limited to, bicycle, walking, etc.....
