Christian Bros AutomotiveCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: August 27, 2013 ";- _ TO: Jonathan Wakefield FROM: Bill Parsons, Associate City Planner SUBJECT: Christian Brothers Automotive — CZC-13-105; DES -13-096 OWNER: Brighton Investments LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant requests certificate of zoning compliance (CZC) and administrative design review (DES) approval to construct a new 5,007 square foot minor vehicle repair facility in Commercial Southwest Subdivision. The proposed use is principally permitted in the C -G zoning district. The site is located at 1402 W. McMillan Road. DECISION The applicant's request for CZC and DES are approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services Division at (208) 887-2211 to verify submittal requirements. You must complete this process before you continence the use and start construction. As part of the application submittal, you will need to provide plans, stamped and signed by the architect and/or civil engineer as applicable. You mustprovide these plans in PDF format and hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your building submittal set. Please contact Building Services for additional details about building permits and inspections. Site Specific Conditions of Approval 1. All ground level mechanical equipment shall be screened to the height of the unit as viewed from the property line and/or all rooftop mechanical equipment shall be screened as viewed from the farthest edge of the adjoining right of way in accord with UDC 11-3A-19A.1e. 2. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Contact the City of Meridian Transportation and Utility Coordinator at 898-5500 for information on the locations of existing street lighting. 3. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. 4. A screened outdoor storage yard for inoperable vehicles is not proposed or approved with the subject application. All inoperable or dismantled vehicles shall be stored within the building and shall not be visible from the street in accord with UDC 11-4-3-37B. Conditions Document Christian Brothers Automotive CZC & DES Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan prepared by Cortland Morgan Architect, dated 07/19/13, labeled A-0.1 and A-1 is approved (stamped "approved" on 08/27/13 by the City of Meridian Planning Division) with the no changes. 4. The landscape plan prepared by Cortland Morgan Architect, dated 08/21/13, labeled L1.01 is approved (stamped "approved" on 08/27/13 by the City of Meridian Planning Division) with the following comment: The perimeter landscaping adjacent to W. McMillan Road and the east boundary must remain protected during construction on the site. 5. The elevations prepared by Cortland Morgan Architect, dated 07/19/13, labeled A-4, are approved (stamped "approved" on 08/27/13 by the City of Meridian Planning Division) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 8. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -03-006; CUP -03-008; PP -07-011; MI -07-007; FP -08-001; FP -10-007; TE -09-023; FP -12-019 and PBA -13-014). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. Conditions Document 2 Christian Brothers Automotive CZC & DES 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 7. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-37, 8. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use (minor vehicle repair) as set forth in UDC 11-4-3-37. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before September 11, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. McMillan Road The proposed project is a 4,921 square foot Christian Brothers Automotive shop, which sits on the East side of a 38,169 square foot site near the intersection of West McMillan and North Linder Roads. This narrative will describe how the proposed building complies with the Meridian Design Manual and UDC 11-3A-19 guidelines, as required by Design Review. 1. The architectural character of the building is in line with the Christian Brothers brand, as well as the standards provided by the City of Meridian. These include: a. The building facades are broken up with changes in material, roof heights, and roof volumes. A limestone veneer base separated from a red -brown brick upper by a cream - colored brick band also helps to articulate the bottom and top halves of the building and unify the facades. Glass garage doors leading to the service bays on the West side march down the fagade and create a pleasing rhythm. While the garage doors are utilitarian in nature, the glass panel inserts make them an aesthetic highlight as well. b. The South and East elevations, which face oncoming traffic along McMillan Road, highlight the primary public entrance with a smaller volume than that used for the service bay portion. This helps to transition from the street up to the volume of the service area. Signage is inserted below the gable roof, above the entry on this portion, and between the garage doors and eave on the service portion. A projecting gable roofed portico protects patrons as they enter. This secondary roof helps to call attention to the entry and also gives it a residential feel. c. Roof lines are formed by three different volumes and heights: a gable roof whose ridge runs parallel to the long side of the service volume, a squared -up gable over the waiting room/office portion, and a secondary gable, perpendicular to squared one, over the entrance. d. The building exterior is comprised of a limestone veneer base, cream -colored brick band and red -brown brick veneer upper half that run consistently around the building, tying everything together. On the West side of the service portion, the glass garage doors are outlined with the cream -colored brick veneer and topped with a keystone. This articulation helps the building appear organized and interesting. e. All of the mechanical equipment will be screened by an enclosure with brick veneer that matches that on the upper half of the exterior. The mechanical equipment and trash enclosure are located on the North end of the site, (furthest from McMillan Road) for minimal visual impact. 2. Materials: The exterior materials are primarily limestone and brick veneers, highlighted using contrasting brick colors at the base and around the doors and windows. Marble tiles in the green color of the Christian Brothers brand are turned forty-five degrees to form diamonds that accent the spaces between service bay doors. 3. Site Design + Parking: Because the property is less than two acres, there is only one drive aisle with parking stalls off of one side of it. This drive aisle will be shared with a development to the West once that site is developed. The building sits on the East side of the site and the parking on the West, eliminating parking between the building and the street. 4. Pedestrian Walkways: a raised concrete sidewalk connects to the existing sidewalk along McMillan Road and links to the main entrance of the building. The path is six feet wide and connects to a layout of herringbone -pattern -laid pavers. This layout of pavers highlights the entrance and is protected, along with the door, by the gabled portico. S.
