Spurwing Way, which has been vacated and is now a private drive. This easement is depicted on the attached Exhibit B, and was created through a note on the Spurwing Subdivision plat. The note reads as follows: "All lots are hereby designated as having a permanent public utilities, drainage, and irrigation easement over the twelve (12) feet adjacent to any street that is dedicated to the use of the public or private use. This easement shall not preclude the construction of hard -surfaced driveways and walkways to ease lot." Dear Mr. Christensen: This is in response to the Relinquishment Application submitted to Idaho Power Company that was on received March 28, 2013, regarding the possible relinquishment of a certain area of utility easement along North Spurwing Way as described in Exhibit A and shown in Exhibit B (the "Utility Easement Area"). Idaho Power's review of the relinquishment request indicated that there are utilities within the Utility Easement Area along the western boundaries of Lots 1-3.
