The original Oaks development was annexed and zoned with a development agreement and concept plan on January 6, 2009. An additional 99.96 acres has been acquired by the applicant and is included as part of the overall project. An application for annexation and zoning of 99.96 acres with R-4 (56.64 acres) and R-8 (43.32 acres) zoning is included with this request. The Oaks development is separated by McMillan Road, requiring two preliminary plats which are called The Oaks North and South. The Oaks North Subdivision consists of 252.12 acres and The Oaks South Subdivision includes 135.93 acres. A rezone application is a component of this application, allowing the zoning boundaries to coincide with the proposed preliminary plats. The zoning designations requested include R-8, R-4, R-15, and L -O as a component of the application. A development agreement modification is included as part of this application. The original development agreement included provisions which no longer apply. The Oaks North and South preliminary plats require some modification to the development agreement. A new development agreement will be necessary with the addition of 99.99 acres; therefore, we respectfully request a new development agreement covering the entire 388.05 acres be substituted for the original development agreement. Project History Annexation and zoning of The Oaks and Oakcreek (AZ -08-004) was approved by the Meridian City Council in 2008. The 318.74 -acre (including right-of-way) development was annexed with a conceptual plan. The requested zoning included 69.72 acres of R-4 (21.87%), 492.20 acres of R-8 (60.31%) and 56.82 acres of R-15 (17.82%). A preliminary plat (Oakcreek Subdivision) consisting of 118 single-family lots was approved on a 30.72 acre portion of the property. The applicant has constructed and recorded Oakcreek Subdivisions Nos. 1 and 2. The last phase of Oakcreek Subdivision has been submitted and the final plat is scheduled before the City Council on July 2, 2013, Project Overview The Oaks neighborhood design reflects a diversified residential community that appeals to a larger group of homebuyers. The neighborhood design will provide options for young and growing families, as well as those looking to simplify and downsize. The development achieves this by providing an assortment of housing types and lot sizes within each individual neighborhood. The identity of the neighborhood is focused around an interconnected open space and pathway system. Significant amenities will be provided at The Oaks. These amenities include two central parks with swimming pool facilities, playground equipment and picnic The Oaks Narrative 1 of 7 shelters, eight pocket parks that include bocce courts, picnic shelter/barbeque areas, tot lots, fitness trail amenities and 10 -14 -foot multi -use pathways. A future park for the Western Ada Recreation District is also included in the project. The applicant will donate 5.69 acres to the District for a park and swimming facility. The developer will provide the infrastructure improvements which include public streets, sewer, water and pressure irrigation. The Oaks will be characterized by its high-quality design and mixed -density synergy. A variety of housing types and sizes will be offered at a series of price points. Regardless of size, all homes will exhibit thoughtful design and distinct architectural features. All homes constructed in the community must be approved by an architectural committee through an internal design review process. This will ensure consistent quality throughout The Oaks. The Oaks is designed with a collector system, which includes a central landscaped boulevard within the community. The main boulevards are designed as a parkway with landscape buffers between 25 and 30 feet in width with entryway medians. The primary collectors for The Oaks North and South are aligned at the one-half mile on McMillan Road. The primary collector within The Oaks North extends through the project to the northern boundary for future extension and connection to State Highway 20/26. The secondary collector extends east to The Oaks North boundary for future extension and connection to Black Cat Road. The east portion of the collector would align with the future one-half mile Volterra collector. A future elementary school will be located on the east side of Black Cat Road adjacent to the Volterra collector road. The zoning request of R-4, R-8, R-15 and L -O is consistent with the Meridian Comprehensive Plan Land Use Map designation of Medium Density Residential and Office. The gross density of the community is approximately 4.04 dwelling units per acre, which complies with the City's designation of Medium Density Residential and is less than the allowable 8 dwelling units per acre, Mixed -Use Development The Oaks incorporates a mixture of single-family, multi -family, neighborhood mini -storage, office and daycare uses. Single-family Neighborhoods The single-family neighborhoods include innovatively designed single-family homes in a mixed - density setting, primarily located in neighborhoods surrounding the central core of the community. These neighborhoods are defined by an appealing street scene with detached sidewalks, 8 -foot parkways and street trees. There are 963 homes proposed in these single- family areas. The single-family area within The Oaks North and South consists of 330.46 acres. The zoning designations for the single-family area are R-4 and R-8. The proposed R-4 portion of the development will encompass 218.47 acres (56.28%) and the R-8 sections consist of 111.99 acres (28.86%). The Oaks Narrative 2 of 7 Multi family Neighborhoods The higher density multi -family neighborhood is proposed along the future State Highway 16 corridor and adjacent to existing arterials. The multi -family neighborhood will include imaginatively designed attached residences and/or multi -unit structures which may be up to 15 dwelling units per acre. These neighborhoods are integrated into the community with access to collectors, open space, amenities and designed as pedestrian friendly. The four multi -family areas of the project include 44.22 acres (11.39%). The anticipated number of dwelling units is 488 dwelling units. The R-15 rezone request is 52.05 acres, with 7.83 acres proposed as neighborhood mini -storage. Neighborhood Office The project has incorporated 5.54 acres (1.43%) of neighborhood office located at McMillan Road, McDermott Road and adjacent to the fire station. The Comprehensive Plan Land Use Map identifies a cluster of neighborhood office at the half -mile. However, with the realignment of McDermott Road and inclusion of a fire station, the more appropriate location was moved slightly west. The office allowed for a buffer between the residential uses and the fire station. The L -O zoning would allow for professional office or daycare facility that would complement the development and provide essential services. Neighborhood Mini -Storage A neighborhood mini -storage area is proposed on 7.83 acres (2.04%). The mini -storage will be an accessory use to the development. It was the applicant's desire to identify a use that would not be adversely affected by a future overpass at McMillan and McDermott Roads. Through significant analysis, it was determined a mini -storage would serve the needs of The Oaks community, provide a buffer and would not be negatively impacted by the installation of the overpass or State Highway 16. There are successful examples of mini -storage facilities at or near a residential development in the Treasure Valley. The Bridgetower developer constructed Ten Mile Mini -Storage to serve the project and provide convenient storage of recreational vehicles. Cloverdale Mini Storage was designed in conjunction with the Ironwood Subdivision and intended as a buffer to the Cloverdale Road overpass and Interstate 84. The requested zoning for the storage area is R-15. Community Amenities The applicant, Coleman Homes LLC, has worked with the Western Ada Recreation District Board to identify a future site for a multi -use swimming facility within The Oaks. The parties selected a 5.69 -acre site near the southeast corner of McMillan and McDermott Roads. The site is located along an arterial, McMillan Road, with access off of a collector roadway making the site easily visible and accessible. The swimming and recreation facility is shown as conceptual with a site plan provided by Western Ada from another site. Coleman Homes LLC intends to donate the property to the Western Ada Recreation District and to install the necessary utilities, public roads and exterior landscaping along the roadways. The Oaks Narrative 3 of 7 Recreational and open space amenities within The Oaks include an expansive 10 -foot -wide, multi -use pathway system, a 14 -foot -wide Five Mile Creek greenbelt, central common areas and pocket parks. The 10 -foot -wide multi -use pathways (5,856 linear feet) extend north, south, east and west within the development. A 14 -foot -wide multi -use greenbelt (3,997 linear feet) along Five Mile Creek is proposed providing active recreation opportunities such as walking, biking and jogging along the Creek. The five -foot -wide pedestrian paths (29,191 linear feet) constructed along the arterials, collectors and common areas will allow residents to enjoy a walk throughout the community with connections to linear, central, public, and smaller open spaces. The pathways include distinctive road crossings to facilitate a pedestrian-fiiendly and interconnected system. The pathway system will connect amenities within the community, including two central parks and swimming pool facilities and neighborhood pocket parks providing an abundance of open space. Each pocket park will be individually designed to serve the adjacent residents, as well as the entire community. The overall proposed open space encompasses more than 43.45 acres, or 11.2 percent, of The Oaks development area. Traffic Impact Study A combined Traffic Impact Study (TIS) for The Oaks North and South has been provided with this application. As stated in the TIS, upon completion, The Oaks is projected to generate an average daily traffic volume of approximately 13,341 vehicles, of which the a.m. and p.m. peak hour traffic is 1,056 and 1,374 vehicles per hour, respectively. Consequently, although roadway improvements will be required to accommodate the traffic generated by The Oaks and other proposed and approved developments, the existing roadway system will be sufficient to support development of the community as these improvements are completed. Furthermore, the proposed future extension of State Highway 16 will provide access to the State highway system through interchanges at Ustick Road and State Highway 20/26. The applicant has coordinated with the Idaho Transportation Department and Ada County Highway District planning for the State Highway 16 extension and the impact on the existing roadway network. The Oaks has planned for future right-of-way to accommodate the eventual McMillan Road overpass at State Highway 16. The uses that adjoin the future overpass include a neighborhood mini -storage facility and Western Ada Recreation District park site. These uses would not be negatively affected by installation of an overpass in the future. The project has incorporated McDermott bypass roads north and south of McMillan Road. These bypass roadways will function as collectors, allowing traffic to continue north or south on McDermott Road after construction of the State Highway 16 improvements. Transitional uses have been included in the development with multi -family and office lots adjacent to the future State Highway 16 corridor. A small pod of single-family lots lies adjacent to the corridor in the northwest portion of The Oaks. A 60 -foot -wide landscape lot has been provided, allowing for an extensive berm and vegetative buffer. The Oaks South utilizes a multi -family parcel and the Western Ada Recreation District Park as buffers for the single-family residential. The Oaks North has a multiple collector system which maximizes the number of routes for the traffic generated by the development. Continuous collectors are provided from McMillan Road to the north and east boundaries. A second, non -continuous collector is included adjacent to the neighborhood mini -storage, multi -family and provides the bypass for McDermott Road. The project includes ten stub streets to adjoining properties for extensions of collector roadways to The Oaks Narrative 4 of 7 Black Cat Road and State Highway 20/26. Multiple local street connections will provide future interconnectivity, reducing the trips on the arterial roadways. The Oaks North has an interim roadway connecting the project with Black Cat Road. The east portion of the temporary road would be eliminated when the one-half mile collector is extended east through an adjoining property connecting at the Volterra signalized intersection. The Oaks South has a loop collector from McDermott Road to McMillan Road. This will provide the future bypass for the McDermott Road, south of McMillan Road. A central collector is the primary entrance into the development. The two Oaks South collectors align with The Oaks North collectors at McMillan Road. These collectors will accommodate the traffic generated by this project. The Oaks South provides three local street stubs which include connection of two roadways in Oakcreek and one stub south at Five Mile Creek. Two local streets are single -loaded with homes, providing visibility and integration of Five Mile Creek into the project. The exposure of the creek will allow for improved safety and provide an inviting atmosphere along with parking on the south side of the roadway for the public. The proposed development will provide five -foot -wide detached sidewalks throughout the project. The 10 -foot -wide, multi -use pathways which adjoin the collectors, a local street and Five Mile Creek will be installed in lieu of the standard five -foot -wide walk. The recommended improvements, discussed in detail in the TIS, include turn lanes and intersection improvements. The improvements will be installed when ACHD deems it necessary, based upon build -out of the community and neighboring developments and as traffic warrants are met. Infrastructure and Phasing The City of Meridian will provide central sewer and water service for The Oaks. The applicant will design and construct a lift station at McDermott Road and Five Mile Creek along with a pressure line to Black Cat Road. Analysis and preliminary design of the lift station has been completed by J -U -B Engineers and has been summarized in the Lift Station Report. The report has been approved by Meridian Public Works and Department of Environmental Quality. The final design of the lift station and pressure line is underway by J -U -B. The lift station and wet well will be designed to accommodate future expansion of the system. The pressure line will run along the north side of Five Mile Creek and will cross Black Cat Road and discharge into the existing regional Black Cat lift station. A 12 -inch water main is located in Black Cat Road and along the McMillan Road frontage of Oakcreek. A future 12 -inch water main at Ten Mile and McMillan Roads will be extended west by others. The development has provided a well lot located on the north boundary and adjacent to the collector road in The Oaks North. A second, dedicated lot located on the east side of the collector will allow for access and discharge to an existing drain. Meridian Public Works will determine the schedule for City installation of the municipal well. The development is intended as multi -phased project with approximately 21 phases in The Oaks North and 9 phases within The Oaks South. Development will begin on the south side of McMillan Road and will include the central open space and amenities. Since phasing may vary The Oaks Narrative 5 of 7 due to market conditions, the applicant requests that flexibility be allowed on the phasing plan, which may increase or decrease the size and number of phases. Preliminary Plats Coleman, Homes LLC requests preliminary plat approval of 963 single-family lots, 4 multi- family lots 1 neighborhood mini -storage lot, 1 well lot, 1 Western Ada Recreation lot, 1 fire station lot, 1 lift station lot, 5 office lots and 73 common lots on 388.05 acres. The proposed overall gross density of the project is 4.04 dwelling units per acre. The total common area proposed in The Oaks Subdivision is 43.45 acres, or 11.20 percent, of the project. The eligible open space, which includes the residential street landscape buffers, is 46.32 acres and comprises 11.94 percent of the site. The eligible open space includes the pocket parks, pool facilities, a portion of the arterial buffers, collector buffers, pedestrian paths, Five Mile Creek and the 10 -foot -wide multi -use pathways. The applicant is providing a 5.69 -acre lot for the Western Ada Recreation District for a future park and swimming facility. The WARD lot is not included in the common area calculations. The Oaks includes 37 -foot exterior landscape buffers along McMillan Road, consistent with the exterior buffer provided in Oakcreek Subdivision. A 35 -foot landscape buffer adjoining Black Cat Road and 60 -feet adjacent to McDermott Road for the single-family area. The primary open space for The Oaks North consists of a 5.71 -acre park centrally located in the neighborhood. The primary open space for The Oaks South is 1.28 acres in size. These areas are visible and easily accessible by all residents, providing for active recreational opportunities. Each central area will be improved with a swimming pool facility, play equipment, a picnic shelter and pathways. The neighborhood will be constructed with detached sidewalks, street trees and eight - foot -wide landscape parkways throughout. The project lies within two irrigation jurisdictions. The Oaks South lies within Settlers Irrigation District and is served by the Settlers Canal. The canal enters the subject site along the common boundary with Oakcreek Subdivision and turns south, terminating or discharging into Five Mile Creek. A 50 -foot easement and separate lot has been provided for the Settlers Canal. The applicant will coordinate with the District on access along the facility. The applicant requests a waiver for piping the Settlers Canal since it would require a 60 -inch to 72 -inch reinforced concrete pipe, making it cost prohibitive. A pressure irrigation pump station will be constructed along the Settler Canal with access provided by the existing maintenance road. The pump station will be connected to the Oakereek pressure irrigation main lines looping the two systems. Five Mile Creek adjoins the south boundary of The Oaks project running east to west. Nampa - Meridian Irrigation District owns a portion of the waterway in fee simple and has a 100 -foot easement from the centerline of the creek. An open space corridor has been incorporated into the design which provides vehicular and pedestrian access along the waterway. Installation of a 14 - foot -wide multi -use pathway along the creek will provide access for maintenance and a bike/walking path. Five Mile Creek is a year round waterway with a floodway and floodplain boundary identified on the FEMA Maps.
