DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Eaglewood Homes, requests Certificate of Zoning Compliance (CZC) and Design Review
(DES) approval to construct a new 4,209 square foot office building within the Gramercy development.
The site is located at 2490 E. Gala Street.
DECISION
The applicant's request for CZC and DES is approved with the conditions listed in this report.
Note. This is not a building permit. Please contact Building Services Division at (208) 887-2211 to
verify submittal requirements. You must complete this process before you commence the use or
construction. As part of the application submittal, you will need to provide plans, stamped and signed
by tlae architect and/or civil engineer as applicable. You must provide these plans in PDF format and
hardcopy as specified in the Building Services "Plan Intake Checklist" and include them with your
building submittal set Please contact Building Services for additional details about building permits
and inspections.
Site Specific Conditions of Approval
1. All ground level mechanical equipment shall be screened to the height of the unit as
viewed from the property line in accord with UDC 11-3A-19A.1e.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with
UDC 11 -5C -3C,
3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the
applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A.
4. The site plan prepared by kin Engineering, dated 7/31/13, labeled Sheet CLO, is approved
(stamped "approved" on 7/31/13 by the City of Meridian Planning Division) with the following
comment:
• The bicycle parking facility located near the northwest corner shall be relocated so
that the pedestrian walkway is unobstructed to the main entrance in accord with

UDC 11 -3C -5C.1. Mahe corrections to plans with the submittal of the building
plans.
5. The landscape plan prepared by km Engineering, dated 7/31/13, labeled L1.0, is approved
(stamped "approved" on 7/31/13 by the City of Meridian Planning Division) with the following
comments:
• Except for the removal of the landscaping for the new Gala Street curb cut, the
existing landscaping along E. Gala Street must remain protected during
construction on the site.
• Protect any existing trees on the subject property that are greater than four -inch
caliper and/or mitigate for the loss of such trees as set forth in UDC 11-311-10.
6. The elevations prepared by Dave Evans Construction, dated 6/05/13, labeled A4.0, are approved
(stamped "approved" on 7/31/13 by the City of Meridian Planning Division) with no changes.
7. The approved site plan, landscape plan and/or elevations may not be altered without prior written
approval of the City of Meridian Planning Division.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
9. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant
shall submit a new site plan to the City of Meridian Planning Division for approval prior to
issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-311-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (CZC-13-048, AZ -06-021; DA # 106141056; PP -06-019 and
FP -06-048).
3. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.
4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the
area.
5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC 11-3A-11.
6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping
and constructed features within the clear vision triangle consistent with the standards in UDC 11-
3A-3.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director. All
requests for review shall be filed in writing with the Planning Division on or before August 15, 2013,

within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-
5A-613.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under
Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Zoning Compliance.
The administrative design review shall be exercised with the approval period of the underlying permit
(CZC) or the approval shall expire.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until July
31, 2014.

Re: Eaglewood Homes Design Review/Certificate of zoning Compliance
The proposed project is a 4,209 square foot single story commercial office building. It will
be located at 2490 E. Gala St., Meridian ID 83642 also known as Lot 7, Block 1 of
Gramercy Subdivision No. 1. The zoning designation is General Commercial (C -G).
The site layout is based on the approved preliminary plat and development construction
plans for the subdivision which is intended to house an office park. The entrance faces
the parking lot to the north and will address cars as they enter the development off of E.
Gala St. and E. Overland Rd.. The site work will include parking, vehicle drives and some
landscaping. This additional constructing is depicted in the site and landscape plans.
The building design responds to the city's adopted design manual. As instructed by staff
the applicant used the Urban/Suburban Design Guidelines. All of the facades are
designed to address site influences as well as building scale and form. This is done with
the use of a predominant main entry for clients/customers and a side entry for employees.
At the rear of the building, which faces East Gala Street, to break up the plain we used a
taller wall feature set back for signage. The entry feature is clad in brick, stucco and
limestone. The building's facades include consistent window layouts and additional
masonry accents at building corners. The roof is hipped with its fascia line broken up by
the rear wall and main entry cornice. The materials used tie in with surrounding
architecture and help provide articulation to the fagades with a two toned stucco cladding
system, masonry and an architectural composite shingle roof.
Mechanical equipment will exist along the west and east elevations. This will include air
conditioning condensers mounted at grade and a gas meter. All of this equipment will be

Interest on all such sums of the rate therein provided. Provided, however, that the making of such further loans,
advances or expenditures shall be optional with the Beneficiary, and provided, further that it is the express Intention
of the parties to this Deed of Trust that it shall stand as continuing security until paid for all such advances together
with interest thereon.
A. To protect the security of this Deed of Trust, Grantor -Agrees:
1. To keep said property in good condition and repair, not to remove or demolish any building thereon; to complete or
restore promptly and in good and workmanlike manner any building which may be constructed, damaged or destroyed
thereon and to pay when due all claims for labor performed and materials furnished therefore; to comply with all laws affecting
said property or requiring any alterations or improvements to be made thereon; not to commit or permit waste thereof; not to
commit, suffer or permit any act upon said property In violation of law; to cultivate, irrigate, fertilize, fumigate, prune and do all
other acts which from the character or use of said property may be reasonably necessary, the specific enumerations herein
not excluding the general.
2. To provide, maintain and deliver to Beneficiary fire insurance satisfactory to and with loss payable to Beneficiary. The
amount collected under any the or other Insurance policy may be applied by Beneficiary upon any Indebtedness secured
hereby and in such order as Beneficiary may determine, or at option of Beneficiary the entire amount so collected or any part
thereof may be released to Grantor. Such application or release shall not cure or waive any default or notice of default
hereunder or invalidate any act done pursuant to such notice.
J. To appear in and defend any action or proceeding purporting to affect the security hereof or the right$ or powers of
Beneficiary or Trustee, and to pay all costs and expenses, including cost of evidence of title and attomeys fees In a
reasonable sum, in any such action or proceeding in which Beneficiary or Trustee may appear.
4, To pay: at least ten days before delinquency all taxes and assessments affecting said property, when done, all
encumbrances charges and liens, with Interest, on said property or any part thereof, which appear to be prior or superior
hereto; all coals, fees and expenses of the Trust. In addition to the payments due in accordance with the terms of the note
hereby secured the Grantor shall at the option, and on demand of the Beneficiary, pay each month 1/12 of the estimated
annual taxes, assessments, Insurance premiums, maintenance and other charges upon the property, nevertheless In bust for
Grantor's use and benefit and for the payment by Beneficiary or any such Items when due. Grantor's failure so to pay shall
constitute a default under this trust.
5. To pay immediately and without demand all sums expended by Beneficiary or Trustee.pursuant to the provisions
hereof, with interest from date of expenditure at the highest lawful rate permissible under Idaho Law.
0. Should grantor fail to make any payment or to do any act as herein provided, then Beneficiary or trustee, but without
obligation so to do and without notice to or demand upon Grantor and without releasing Grantor from any obligation hereof,
may: make or do the same in such manner and to such extent as either may deem necessary to protect the secudly hereof,
Beneficiary or Trustee being authorized to enter upon said property for such purposes; appear in and defend any action or
proceeding purporting to affect the security hereof or the rights of power of Beneficiary or Trustee; pay, purchase, contest or
compromise any encumbrance, charge or Ilen which In the judgment of either appears to be prior or superior hereto; and , in
exercising any such powers, or in enforcing this deed of trust by judicial foreclosure, pay necessary expenses, employ
counsel and pay his reasonable fees.
B. It is mutually agreed that:
1. Any award of damages in connection with any condemnation for public use of or injury to said property or any part
thereof is hereby assigned and shall be paid to Beneficiary who may apply or release such monies received by him in the
same manner and with the same affect as above provided for disposition of proceeds of fife or other insurance.
2. By accepting payment of any sum secured hereby after Its due date, Beneficiary does not waive his right either to
require prompt payment when due of all other sums so secured or to declare default for failure so to pay.
3. At any time or from time to time, without liability therefore and without notice, upon written request of Beneficiary and
presentation of the Deed of Trust and said note for endorsement, and without affecting the personal liability of any person for
payment of the indebtedness secured hereby, Trustee may: reconvey all or any part of said property; consent to the making of
any map of plat thereof; join in granting any easement thereon; or join in any extension agreement or any agreement
subordinating the lien or charge hereof.
4. Upon wrillen request of Beneficiary slating that all sums secured hereby have been paid, and upon surrender of this
Deed and said note to Trustee for cancellation and retention and upon payment of its fees, trustee shall reconvey, without
warranty, the property then held hereunder, The recitals in any reconveyance executed under this Deed of Trust of any
matter of facts shall be conclusive proof of the Truthfulness thereof. The grantee In such reconveyance may be described as
"the person or persons legally entitled thereto".
5. As additional security, Grantor hereby gives to and confers upon Beneficiary the right, power and authority, during the
continuance of these Trusts, to collect the rents, Issues and profils of said propedy, reserving unto Grantor the right, prior to
any default by grantor In payment of any Indebtedness secured hereby or in performance of any agreement hereunder, to
collect and retain such rents, Issues and profits as they become due and payable. Upon any such default, Beneficiary may at
any time without notice, either In person, by agent, or—by a receiver To be appol hied by a court, and without regard to the
adequacy of any security for the Indebtedness hereby secured, enter upon and take possession of said properly or any part
thereof, in his own name sue for or otherwise collect such rents, issues and profits, including those past due and unpaid, and
apply the same, less costs and expenses of operation and collection, Including reasonable attorneys fees, upon any
indebtedness secured hereby, and In such order as Beneficiary may determine. The entering upon and taking possession of
said property, the collection of such rents, issues and profits and the application thereof as aforesaid, shall not cure or waive
any default of notice of default hereunder or Invalidate any act done pursuant to such notice.
B. Upon default by Grantor in payment of any indebtedness secured hereby or in performance of any agreement
hereunder, all sums secured hereby shall Immediately become due and payable at the option of the Beneficiary. In the event
of default. Beneficiary shall execute or cause the Trustee to execute a written notice of such default and of his election to
cause to be sold the herein described property to satisfy the obligations hereof, and shall cause such notice to be recorded In
the office of the recorder of each county wherein said real property or some part thereof is situated.
Notice of sale having been as then required by law, and not less than tha time then required by law having elapsed,
Trustee, without demand on Grantor, shall sell said property at the time and place fixed by it in said notice of sale, either as a
whole or in separate parcels and In such order as it may determine, at public auction to the highest bidder for such In lawful
money of the United States, payable at the time of sale. Trustee shall deliver to the purchaser Its deed conveying the property
so sold, but without any covenant or warranty expressed or implied. The recitals In such deed of any matters orfacts shall be
conclusive proof of the truthfulness thereof. Any person, including Grantor, Trustee, or Beneficiary, may purchase at such
sale.

provision hereof or thereof shall result In payment of amount In excess thereof, then such provision shall be deemed
appropriately modified to the extent necessary to reduce such amount to that not in excess of such rate, and any excess
