The applicant, Jason Smith, requests Certificate of Zonhzg Compliance (CZC) and Design Review
(DES) approval of a 6,947 square foot restaurant with a 783 s.f. patio in Building B (CZC-12-023; DES-
I2-020), amulti-tenant building at The Village at Meridian Town Center.
This C7,C is for the facade improvements of the subject tenant space and the proposed use; all site
planning and Landscaping was previously approved under the master plan (CZC-1 I-021).
The site is generally located northeast of the N. Eagle Road and E. Fairview Avenue intersection
at 3573 E. Longwing Lane, Ste. 140.
DECISION
The applicants request for CZC & DES is approved with the conditions Listed in this report.

Site Specific Conditions of Approval
1. All ground level mechanical equipment shall be screened to the height of the unit as viewed from
the property line: in accord with UDC 11-3A-19A.1 e.
Process Conditions of Approval
L No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3
Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health as set forth
in UDC 11-SG3I3. A surety agreement may be accepted for other improvements in accord with
UDC I1-5C-3C.
3. 'Che site plan. prepared by Aria Group Architects, Inc., labeled Sheets SP1.1 SP1.2 is approved
as shown in Exhibit A with no changes.
4. The building elevations prepared by Aria Group Architects, Inc., are approved as shown in
Exhibit B with no changes.

5. The approved site plan & elevations may not be altered without prior written approval of the City
of Meridian Planning Division.
6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
7. The applicant shall complete all. required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. 'The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets
the standards as set foz`th in UDC 11-3B-6 and to install and maintain all landscaping as set forth
in UDC 11-3I3-5, UDC I 1-3B-13 and UDC I 1-3B-14.
2. 'The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site (AZ-07-012; VAR-07-017; MDA-11-002; CZC-1 t-021;
CZC-12-023; and DES-12-020).
3. The issuance of this CZC does not release the applicant From any previous requirements of the
other permits issued for the site.
4. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set
forth in UDC l 1-3A-11.
CITY COUNCIL REVIEW
The applicant or a party of record may request. City Council review of a decision of the Director. All
requests for revict~v shall be filed in writing tivith the Planning Department on or bei'are June 19, 2013,
within fifteen (15) days after the written decision is issued, and contain the information listed in UDC ll-
5A-6B.
If City Council z•eview of the decision is not requested, the action of the Director represents a final
decision on a land use application. You ]nave the right to request a regulakary taking analysis under
Idaho Cade 67-8003.

Certificates of Zoning Compliance issued in conjunction witlt a proposed use shall expire if said use has
not commenced within one year of the date of issuance of the Certificate of Toning Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure
shall expire if said construction or alteration has not commenced within one year of the date of issuance
of the Certificate of Toning Compliance.
In accord with the above provisions, the subject Cc~t-tificate of7,oning Compliance is valid until June 4,
2014.
