The site is located on the west side of N. Meridian Road, east side of NW. 1S` Street. between Vi/. Elm Avenue and W. Maple Avenue. DECISION The applicant's request for CZC and DES are approved with the conditions listed in this report. Site Specific Conditions of Approval 1. The applicant shall comply with the access to street standards as set forth ill UDC 11-3A-3. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related. to public life, safety, and health as set forth in UDC 1 1-SC-3B. A surety agreement maybe accepted filr other improvements ill accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by B ~ A Engineers, dated 05/31/13, labeled Sheet 1, is approved (stamped "approved" ot107/24/13 by the City of Meridian Planning Division) with no chatlges. 5. The landscape plan prepared by Montgomery Inc., labeled Sheet L-1 is apl}roved (stamped "approved" on 07/24/13 by the City of Meridian Planning Division) with the following COmi11e111S: • The submitted landscape plan does not match the lay-out of the proposed parking lot. Since the perimeter landscaping and the planter island dimensions are generally consistent with the submitted site plan staff is not requiring a revised landscape plan to match the site plan. I'he perimeter landscaping and interior planter islands shall. be installed consistent with the landscape plan attached as Exhibit C, ® All existing landscaping adjacent to the construction zone must remain protected during eonstntction on the site. • Protect any existing trees on or adjacent to the subject property that are greater than four- inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10. Conditions Document Legacy Church Parking Lot CZC and DES 6. The approved site plan and Iandseape plan may not be altered. without prior written approval of the City of Meridian Planning Division. 7. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all cui7~ent City of Meridian ordinances and previous conditions of approval associated with this site (CUP in 1998, CZC-O1-053 and RZ-13-001). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a -ninimltm height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant. has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC ll- 3 A-3. CIrI'Y COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for rc;view shall be filed in writing with the Planning Division on or before August 8, 2013, within fifteen. (1 S) days after the written decision is issued, at~d contain the inforn7ation listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction ar alteration has not cottnnenced within one year of the date of issuance of the Certificate of Loring Compliance. Based on our last meeting we have revised the entire set of plans and re-configured the parking lot layout to better serve the Church and based on adherence to the City of Meridian Policy's. ~.• Parking Lot Overview The proposed parking lot is shown on the attached plan proposes the addition of 42 spaces. These 42 spaces have been provided in two separate areas divided by an existing alleyway. West of the alleyway an entrance is proposed to NW First St. to provide access from a public street and to the existing parking area. The parking Iot addition utilizes the existing traffic pattern and allows for the entrance and exit to and from NW First St. All access from the parking lot has been restricted from N. Meridian Road. The alleyway is proposed to be paved within the limits of the project. All planter islands within the parkuig Iot have been bounded by curb and gutter and contain a minitnurn of 50 square feet of planting area. The landscape buffers on the south side of the parking are Located south of the property line and are located on lauds the church owns. On the northeast side of the parking lot, wheel stops have been added as required adjacent to a 5-foot landscape buffer. Landscape buffers located oi~ the north side of the project site have been shown to accommodate and preserve existing trees. Meridian Road. •3 12ecent Site gIistory In 2011 the Ada County Highway District (ACRD) approached the church regarding the expansion of N. Meridian Road. This work by the Ada County Highway District is currently underway. While the widening of Meridian Road. will certainly, benefit the conununity, this public street improvement has had a definite impact on how the church operates. Many parking spaces have been lost and access to the front entrance of the sanctuary has been dramatically affected. Notwithstanding these impacts, the Church has conveyed the necessary right-of--way and construction easements to the ACRD for the widening and ultinate public benefit. The MGT Legacy Church is now compelled to replace the loss of the parking areas to accommodate the services it provides to its congregation. These services are in part related to weekly church services, extracurricular activities in the gymnasium, weddings and funerals. The Meridian Road widening has caused the lass of more than 20-parking spaces both adjoining the church and in its existing parking areas. The existing parking area has also been affected by disturbing the traffic pattern within the existing parking lot. The MGT Legacy Church has provided a parking lot expansion plan with this re-zone request application. A recent demolition permit was issued fiom the City ofMeridian to remove an existing building located at 1419 N. Meridian Rd. This was an existing residential structure which has been removed in anticipation of expanding the parking area for the Church. :• Parking Lot Design elements Page 1 oft C~ ~ We have attached the construction plans for the development of an additional parking area. This new parking area seeks to provide a conforming parking area conforming to the city's requirements. This will include landscaped street buffer adjacent to N. Meridian Road. The parking area will include a pressurized irrigation system to irz•igate the landscaping. In compliance with city ordinance, the landscaped areas will be protected by curbing. e Landscaping A landscape plan has been submitted to enable a more comprehensive representation of the overall development scheme. The improvements now under construction by ACRD far the Meridian Split Corridor Project have impacted the existing parking areas and drive isles. The Meridian Split Corridor project has removed the landscaping buffer between the sidewalk and existing parking area. As shown on the landscape plan this landscaping buffer is intended to be re-installed and fully improved beyond what originally existed. Please contact me with any questions you may have. We have also based this narrative on specifc review comments received in an e-mail dated May 8, 2013 (attached). • Parl~ing Lot Overview The proposed parking lot is shown on the attached plan proposes the addition of 35 spaces. These 35 spaces have been provided in two separate areas divided by an existing alleyway. West of the alleyway an entrance is proposed to NW First St. to provide access from a public street and to the existing parking area. The parking lot addition utilizes the existing traffic pattenl and allows for the entrance and exit to and from NW First St. All access from the parking lot has been restricted from N. Meridian Road. The alleyway is proposed to be paved within the limits of the project. All planter islands within the parking lot have been bounded by curb and gutter and contain a minimum of 50 square feet of planting area. The travel ways within the proposed parking addition have been designed to work with the existing parking area to the extent feasible. The landscape buffers on the south side of the parking are have been increased in width to a minimum of 7-feet to accommodate bumper overhangs. Parking stall have been reduced to accommodate bumper overhangs on the project site. Landscape buffers located on the north side of the project site have been shown to accommodate and preserve existing trees. • Landscaping Page 1 of 2 The attached landscaping plan has been prepared, to the extent feasible, in conformance with the applicable codes of the City of Meridian and is shown on the plan. It has been communicated to us that the widening of N. Meridian Rd. by the Ada County Highway District has impacted the landscape buffer adjacent to N. Meridian Rd. During construction ofN. Meridian Rd. the Ada County Highway District has relocated an irrigation pipe line within the landscape buffer, behind the sidewalk, parallel to N. Meridian Rd. The existence of tl>zs irrigation pipeline has required that trees and shrubs are excluded from the landscape buffer. A small planter area has been designed near the southwest corder of the site to allow a tree to be planted, outside of the irrigation pipeline. :• Alternative Compliance Specifics The City of Meridian Code requires that the east landscape buffer, adjacent to N. Meridian Rd., insta112 trees. l is currently proposed to be located in the small planter area within the landscape buffer adjacent to N. Meridian Rd. The other required tree has been relocated to the west buffer adjacent to NW First St. The specific counts have been shown in tables adjacent to each buffer area on the landscape plan. Summary We believe that the attached plan is an acceptable feasible alternative to the strict adherence ofthe requirements afthe landscape requirements for the site. Due to the site conditions imposed on the project by the widening of N. Meridian Rd. and its appurtenances, the relocation of one required tree to the west side ofthe site, is equal means of meeting the intent and purpose of the regulation. We ask that the City of Meridian consider this this request, and to approve tl~e attached site plan, landscape plan and alternative compliance application as shown.
