DESCRIPTION OP APPLICANT'S REQUEST The applicant, Maverik, Inc., requests Certificate of 7_,oning Compliance {C7C} and Design Review (DES} approval of a 4,630 square foot convenience store and fuel facility on 1.14 acres of land in a C-G zoning district. The Maverik is pz•oposed to operate 24 hours aday/7 days a week as previously approved. The site is located at 3202 W. Tlstick Road. Al\rALYSIS OF UDC REQULftEMENTS RELATED TO SITE SPECIFIC CONllITIOIYS: The applicant requests alternative compliance to UDC 'T'able 11-2B-3 which requires a 25-foot wide street buffer to arterial streets. The applicant proposes to construct a 20-foot wide buffer along N. Ten Mile Road instead of a 25-foot wide buffer as required. As an alternative means of complying with the intended purpose of the requirement, the applicant proposes to install two (2) additional trees within the street buffer along Ten Mile; and, plant up to five (5) trees within the rear yard of the property located at 3139 W, Pudu Court to the east across Ten Mile Road to assist in buffering the residence from the convenience store/fuel facility. The reason for the request is that when Maverik originally received CZC 8i DES approval in 2008, ACRD did nat require additional land to expand the right-of--way (ROW) for Ten Mile Road at that time. Because the store was not constructed at that time, the requirement for ROW has changed and ACRD is now requiring additional ROW to be provided. Due.to the location of an existing sewex and water line easement, the structure cannot be shifted further to the west to allow additional area for the full buffer. In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Because of site constraints due to the location of an existing water and sewer line easement and the ACRD requirement for additional ROW dedication for the eYpaz~ion of Ten ivlile Road, the Director finds strict adherence to UDC Table 17 -2B-3 is not feasible. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and `T'he Director finds the applicant's alternative means for meeting the requirements of the UDC as disci>ssed above provides an equal or superior means of compliance as additional trees will be provided as a buffer. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 2. The convenience store and fuel facility is allowed to operate 2~1 hours/day per the approved development agreement, 3. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Ilnprovement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Street lighting is required at intersections, careers, cul-de- sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the 1SPWC: and the City of Meridian Supplemental Specifications to the ISPWC. Contact the City of Meridian Transportation and Utility Coordinator at 898-5500 for information on the locations of existing street lighting. 4. All. ground level mechanical equipment shall be screened to the height of the units as viewed from the property line, per UDC l t-3A-i9A.le. 5. Prior to issuance of building permits, the applicant shall obtain final approval of the property boundary adjustment (PBA-13-012). Process Conditions of Approval 1. Per UDC 11-SB-SB2, the Director (at the applicant's request} approved alternative compliance to UDC Table '11-2B-3 regarding the reduced street buffer along N. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with fhe standards in UDC Chapter 3 Article D and receive approval for such. signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-5C-313. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 4. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3 B-14A. The landscape plan prepared by D]YOn Architecture, Planning, interiors on March 18, 2013, is approved (stamped "approved" on Jtzly 16, 2013 by the City of Meridian Planning Department) with no changes. 7. The elevations prepared by DI:YOn Architecture, Plazuzing, Interiors on May 1, 2013, labeled Sheets A-2. I, A-2.2, & A-2.3, are approved (stamped "approved" on July 16, 2013 by the City of Meridian Planning Department) with no changes. 8. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 9. The applicant shall pay any applicable impact tees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site pCan to the City of Meridian Planning Department for approval prioz• to issuance of the building permit. t 1. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site [AZ-04-404 (Development Agreement #104093293); PP-04- 004; FP-05-047; KL-11-001; MDA-11-001 (Development Agreement #112054b21); PBA-13- 012]. 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The property is zoned CG. A pervious conditional use permit for a Maverik was approved at this location. The new plans comply with old plan; except that this plan includes a building that is approximately 400 sq ft larger. in addition the trees shown on the landscape plan Maverik has also agreed to planting trees in the rear yard of 3139 W Pudu Ct. The planting of these trees are to help buffer the residence from the Maverik parking lot lights. These trees will be planted at the same time the Maverik landscaping will be installed. The proposed C-store building will be approximately 4630 square with an additional 160 square feet of cooler spaces. The building has 22 ft high walls with 28 ft 7 inch high wall at the public entrance. The entrance will include glass doors and store front glass on both sides of the doors. A green canopy wilt hang above the store front glass to shade the sidewalk and also to call attention to the front entrance. The building exterior includes a stone veneer and also board and batten. The board and batten can change to stucco if preferred by the City. The build has a flat roof with parapet walls to screen the mechanical equipment. Typically a Maverik site plan includes picnic table with trellis, however they have been removed from this plan at the request of at least one of the neighbors. At the City's request the picnic table with trellis could be added to grass area on the west side of the building. The site plan includes a bike rank near the southeast corner of the build. Comments from Lighting Engineer: 1) All fixtures meet cut-off requirements. 2) All lights are directed to prevent light trespass into residential area. 3) No floodlights or spotlights facing residences. 4) No light poles adjacent to residential area. The residential areas are separated by two arterial streets. 5) All gas canopy lighting is recessed into the canopy. The two accesses will be shared and were previously approved by ACRD. The ACHD impacts fee were paid but will be revaluated because of the increase in the building square footage. In July 2008 the Maverik project was approved through the City Design Review process, but was not built because of the down turn in the economy. Approximately 18 months ago the ACHD acquired additional land to expand the right-of~way for 10 Mile to meet the future public transportation needs. This right-of--way expansion reduced the landscape strip from the required 25 ft to approximately 16 ft.
