Development Agreement Modification, Rezone and Preliminary Plat Project Narrative H. D. Fowler Company, Inc., hereby applies for a comprehensive plan amendment, rezone and preliminary plat for Baltic Place Addition Subdivision. The property is adjacent to Medimont Subdivisions Nos. 1 and 2 (zoned I -L) on the east, and adjacent to Baltic Place Subdivision No. 1 (zoned C -G) to the north. To the west lies unplatted property zoned R-6 and RUT in Ada County, The R-6 area is developed with a residential groupo home and the RUT property is the Meridian Cemetery. The project lies immediately north of the Hunter Lateral. H. D. Fowler Company, Inc., has been in business since 1911, and is the oldest and largest independent, family-owned distributor of waterworks, irrigation, pumps and wastewater treatment equipment in the Pacific Northwest, and one of the largest in America. The applicant's current location on Taylor Avenue in Meridian has become less than ideal, and the applicant's intent is to build a new facility on one of the lots proposed in the two -lot subdivision to be platted as Baltic Place Addition Subdivision. The applicant is under contract with the owner, L. C. Development, Inc., to purchase the property. The Meridian Comprehensive Plan currently designates the site as High -Density Residential, as the property was previously zoned and approved in 2002 for 228 apartment units. The location of the parcel is not conducive to a multi -family development. The general area is predominately commercial and industrial. The applicant requests a change to the Meridian Comprehensive Plan Map from High -Density Residential to Light Industrial consistent with the adjoining designation, along with rezoning of the 9.397 -acre property from R-40 to I -L. The request for change is due to abandonment of the previously approved site plan for apartments and to allow for construction of a new facility for H. D. Fowler Company. Light industrial uses will be much less intrusive on the neighboring property owners and less demanding on traffic, both of which were concerns during the public hearings for the previously approved apartments. The property can be adequately served by essential public facilities and services. Franklin Road has already been constructed to 5lanes. The proposed Baltic Place Addition Subdivision is a two -lot industrial subdivision on 9.397 acres, with one of the lots being 5 acres and the other lot 3.93 acres. Access will be provided via extensions of S. Baltic Avenue and E. Kalispell Street, with cul-de-sacs terminating each stub street. The Hunter Lateral lies adjacent to the southern boundary and was piped by Nampa & Meridian Irrigation District (NMID). No encroachment of their easement will be allowed by NMID. No variances are being requested as part of this preliminary plat. The applicant proposes to build a new facility similar to that depicted in the attached photograph. A development agreement was entered into between the City of Meridian and L.C. Development on July 9, 2002, and recorded as Instrument No. 102090926, records of Ada County, Idaho. The property was rezoned to R-40 in 2003 under Ordinance 03-997 and recorded as Instrument No. 103012600. The First Addendum to the Development Agreement (AZ -01-008) was approved on January 21, 2003, and recorded as Instrument No. 103012599. It would be the applicant's preference to either enter into a new, separate development agreement for the proposed industrial property or delete the requirement for a development agreement altogether. Existing ordinances cover the majority of the conditions noted in the original development agreement and there are numerous references to Franklin Road improvements, all of which have been constructed. The First Addendum only addressed the rezoning of the property to R-40, with no additional conditions. If modification is considered necessary by the City Council, the following change to Section 4.1 of the original development agreement (page 3) would need to be revised as follows: Construction and development of a planned unit development consisting of 9 commercial building lots; and 4 common lots and 1 Fesidential apa4me4# In construction and development of 2 industrial lots on the southerly 9.397 acres of the development. Also, any reference to the R-40 zoning would need to be amended to the I -L zoning designation. The proposed subdivision is located outside the city limits of Meridian, Idaho, in the NW%, NW'/a, Section 7, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho. The existing site was mostly flood irrigated pasture and included several single family residences with outbuildings. After site development, flood irrigation activities will cease, which will likely further reduce existing ground water elevations. Three test pits were excavated by the client on January 4, 2001 in pre -selected locations and at depths of approximately 8.5 feet. MTI visited the site on January 5, 2001 to observe stabilized ground water conditions in each test pit and log the soils. Test Pit (TP) -1 was located in the southern portion of the site (west of 1215 North Locust Grove Road); TP -2 was in the central portion of the site and TP -3 was at the north end of the site. Each test pit location had similar depth to ground water measurements of 7.5 feet. No evidence of iron -staining or mottling was observed in soils above the current water table in each of the test pits. Historical ground water monitoring data from an MTI piezometer located approximately 800 feet south of the site showed seasonal high groundwater depths at 7.37 feet in August, 2000. Based on the observations made from the test pits on-site and data from nearby sites, the average maximum seasonal high ground water depth for the site is likely to be within 7.0 to 7.5 feet. MTI will be conducting periodic ground water monitoring at the site from three piezometers installed in each test pit to confirm our observations. Soil profiles encountered at the site were generally consistent in each test pit with a sandy lean clay topsoil layer, a weakly cemented silty sand horizon, a moderately cemented silty sand and an underlying poorly graded sand with silt and gravel. Based on soil logs of the test pits and others previously excavated at other project sites in the immediate area, the cemented zone encountered at approximately 5.5 feet in depth is likely to be discontinuous throughout the site. In areas where the cemented zone is well developed, infiltration rates of surface water would be greatly reduced. Descriptions of general site characteristics and the proposed project are available in the previous report. Groundwater was not encountered during our investigation. Soils moistures in test pits were generally moist within the surficial silty soils and dry to slightly moist below. Groundwater levels in the project vicinity are likely primarily a function of local irrigation activity. The estimation of the extent to which groundwater levels fluctuate under seasonal influences is problematic without regular monitoring. Iron staining, which is often an indicator of high groundwater was encountered within test pit 1 at depths as shallow as 5.5 feet. However, this is likely indicative of historic high groundwater levels, and groundwater shallow at any time during the year. is not anticipated to be this Groundwater monitoring of a well located at Troutner Business Park, approximately ''/a of a mile west of the project site, indicates that groundwater was encountered at depths as shallow as approximately 12 feet below the ground surface during the monitoring period from March 1997 to January 2001. The existing ground elevation for the on-site monitor well is 2564.5 feet above sea level (as provided by Landmark Engineering). Groundwater levels in the site vicinity are controlled in large part by residential and commercial irrigation activity and canal leakage in the local area, and are likely at their maximum elevations during the irrigation season. Based on the evidence of this investigation, and background knowledge of the area, it is unlikely that groundwater will be encountered during construction. For design oumoses it is anticipated that groundwater will remain at an elevation of at least 2554.5 feet above sea level throughout the year. Mr, Centers: Materials Testing & Inspection (MTI) has performed a limited subsurface soils evaluation and prepared soil. logs (see attached) For three test pits located at the referenced property in Meridian,, Idaho. The property is located outside the city limits of Meridian Idaho, in the N112 of Section 18, Township 3 North, Range 1 East, Boise Meri.dian, Ada County, Idah..o. The existing site is presently occupied by abandoned .residential structures on the northern portion of the property with the remainder established as pasture land. Soil and Sediment Profile: Three test pits were excavated by die client .ira pre -selected locations at depths ranging from approximately. 10 to 11 feet. MTI visited the site on February 7, 2001 to log the soils exposed in test pit walls. Because of the aerial extent of the studied parcel, the developed soil profile represents only a generalized case and variability in soils between test pit locations should be anticipated: Surficial Sandy Silt (ML) - This soil was encountered at the ground surface across the site and generally consists of dark brown., very stiff,. sandy silt (ML). Silty soils were found to be dry to moist with moisture content decreasing with depth. Organic material occurred through the upper. 8 to 12 inches, with some .fine detected sand throughout. Silt was encountered to depths of 1.,8 to 3.5 feet, and was found to be weakly cemented below 1..8 feet in the vicinity of Test Pit 3. Cemented Silty Sand (SM): This soil was encountered. in all. test pits underlying the surficial silt and generally consists of light brown., dry to slightly moist, very dense, silty sand with strong calcium carbonate (Caliche) cementation. Silty sand (SM) extended to depths of 4.3 to 7.8 feet during tbe.ield investigation, becoming deeper in the southern. portion of the site. Poorly Graded Gravelly Sand (SP) - This soil was encountered underlying the cemented silty sand below depths of 4.3 to 7.8 feet across the site, extending through the termination depths of all three test pits. Poorly graded gravelly sand (SP) was found to be slightlymoist, dense, and moderately cemented to 5.3 to 8.3 feet with Six-in.ch minus gravel throughout. Walls of test pits were stable with the exception of some min.oT sloughing of the poorly graded sands. Excavation through these granular soils, particularly after penetrating groundwater, will lead to an increased propensity for sloughing or caving.
