1. APPLICATION SUMMARY
The applicant, The Fields at Gramercy, LLC, is requesting to vacate the following easements:
• City of Meridian water and sewer easements platted on the north boundary of Lots I, 2 and
3, Block 7 of Gramercy Subdivision No.l;
• A portion of the existing public utility, drainage, irrigation (PUDI) and landscape easement
platted on the south boundary of Lots 2 and 3, Block 7 of Gramercy Subdivision No. 1 and;
• A 25-foot wide emergency access easement along Che shared boundary of Lots 2 and 3,
Block 7 recorded as insG•ument #108073634.
2. STAFF RECOMMENDATION
Staff recommends approval of the vacation application.

4. APPLICATION AND PROPERTY FACTS

5. PROCESS FACTS
The subject application is a request to vacate platted and recorded easements. Per Meridian City Code
Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not
require the site to be posted with a public hearing notice sign.

B. Radius notices mailed to properties within 300 feet on: June 20, 2013
6. LAND USE
A. Existing Land Use(s): The property is currently being developed with a 276-unit aparhnent
complex.
B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrowrding area has
transitioned into a mixed use area. A wide variety of commercial uses, public quasi/public uses
and residential neighborhoods are located in close proximity to the subject site.
C. History of Previous Actions:
• hr 2006, City Council approved Gramercy Subdivision No. ] (FP-06-048) which created the
easements proposed for vacation.
• hr 20]3, a final plat (FP-13-022) was approved by City Council consisting of one (1) multi-
familylot and one (1) common lot on approximately 11.23 acres in an R-40 zoning district.
• A certificate of zoning compliance (CZC-12-090) has also been approved for the construction
often (10) apartment buildings, a chrbhouse/office building, and multiple garages and carport
structures related to the aforemeutiorred applications.
7. AGENCY COMMENTS MEETING
No comments were received by the Planning Deparfirent from other City deparhnents for the subject
application.
8. STAFF ANALYSIS
As noted above, the applicant is proposing to vacate several easements platted with Gramercy
Subdivision No. 1. The easements were created to facilitate the development of three (3) commet•eial
lots approved with the Gramercy Subdivision and the emergency access easement was required by the
Fire Department to provide a secondary means of access for the residential portion of the
development.
In 2012, the Council approved the site to develop with a 276-unit apartment complex. Now that the
site is no longer approved for commercial uses and secondary access has been addressed with the
approval of the development, the existing easements and the 25-foot wide emergency access are no
longer necessary to serve the multi-family development (see Exhibit A.3).
Conditions of approval for the nuilti-family development require the applicant to vacate any unused
utility easement or portion thereof platted with the Gramercy development and construct an
emergency access adjacent to the south boundary with the development of the apartment complex.
The applicable utility providers have reviewed the applicants vacation request and have granted
consent to relinquish the easements. During the development review, the Public Works Department
approved the location of the new water and sewer mains and the Fire Depar-huent approved the
location of the new emergency access point. The new PUDI and water and sewer easements will be

established with the recordation of the Accolade final plat. Certificate of occupancy will not be issued
for any struchu~e within the development until the vacation process is completed and the final plat is
recorded.
Since new easements will be established with the new plat, Public Works and the Fire Departtnent
have uo objections and the service providers have granted relinquishment of the easements, Staff
recommends vacating the excess easements and the 25-foot emergency access easement as proposed
in Exhibit A.2.
