Advanced TherapyCERTIFICATE OF ZONING CO1dIPLIANCE ~`° REPORT DATE: July 8, 2013 TO: Robert Powell, Dave Evans Construction FROM: Kristy Vigil, Assistant City Planner SUBJECT; Advanced Therapy -CZC-13-086 and DES-13-080 OWNER: Lee Centers DESCItIPTIOlY OF APPLICANT'S REQUEST The applicant, Robert Powell, requests Certificate of Zoning Compliance (CZC} and Design Review (DES) approval of a S,O50 square-foot healthcare building for a therapy office on .189 acres of land in the GG zoning district. The site is located at 68 S. Baltic Avenue. DECISIOlmt The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a Building permit. Please contact Building Services at (2U8) 887-2211 to verify if you need a building permit and/or inspection. If you Flo need a building permit, yocc must complete that process before yoga commence the arse oa• construction. As part of the application submittal, you will need to provide one set of the final, stamped "approved" Planning Department plans, stamped and signed by the architect and/or civil engineer ns applicable. You must provide these plans in PDFformat anti liardcopy as specked in the Badlding Services "Flan Intake Cleecklist" and include them wit/e yoaar Building suBntittal set. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 1. The site plan shows the lot line on the west boundary proposed to be moved to the west, which requires a Property Boundary Adjustment approval. Such appraval shall be completed prior to occupancy of Advanced Therapy ar assigns. Site Conditions of Approval Business hours of operation within the GC and C-G districts shall be limited from 6 am to 11 pm when the property abuts a residential use or district as set forth in UDC 11-2B- 3A4. ~°° Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. Conditions Document } Advanced 'T'herapy-- C7.C-13-085 and DES-}3-080 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3I3-14A. 4. The site plan prepared by Dave Evans Construction on June 5, 2013, labeled A1.0, is approved (stamped "approved" on July 8, 2013by the City of Meridian Planning Division) with no changes. 5. I"he landscape plan prepared by ISM Engineering on June 26, 2013, labeled L 1.0, is approved (stamped "approved" on July 8, 2013 by the City of Meridian Planning Division) with no changes. 6. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 7. The elevations prepared by Dave Evans Construction on June 5, 2013, labeled A4.0, are approved (stamped "approved" on July 8, 2013 by the City of Meridian Planning Division) with no changes. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accom>.nodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete alI required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or shucture until the Building Official has issued a Ce~~tihcate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-38-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ-O1-008, PP-01-009, CUP-01-015, FP-03-054, and DA# 102090926). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. Conditions Document 2 Advanced Therapy - GZG-13-U86 and DES-13-Q8~ CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before July 23, 2013, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the constz~.iction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. It will be (orated at 68 S. I~altic Ave, Meridian ID 5364-2 also known as lot 4, Slocl< 1 of Baltic Place Sub. lVa. 1. The coning designation is ~ene~°al Commercial (C~~). The subdivision is existing with neighboring commercial buildings already in place. The existing site work includes parking, vehicle drives, sidewalks and landscaping. Additional landscaping will be added as well as sidewalks to access the proposed structure. This additional construction is depicted in the site and landscape plans. The building design responds to the city's adopted design manual. As instructed by staff the applicant used the Urbanl~uk~ur~ban taesign Guidelines. All of the facades are designed to address site influences as well as building scale and farm. This is done with the use of a predominant main entry feature for tenant. The building's facades include consistent window layouts and masonry accents at the second and third entry doors. The roof is hipped with its fascia line broken up by the entry gables. The materials used tie in with surrounding architecture and help provide articulation to the facades wsth a three toned stucco cladding system, brick and an architectural composite shingle roof. Mechanical equipment will exist along the east and south elevations. This will include air conditioning condensers mounted at grade and a gas meter.
