The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and I I-3A-6B. 2. All ground level mechanical equipment shall he screened to the height of the unit as viewed from the property line in accord with UDC 11-3A-19A.1e. 3. Prior to the issuance of a certificate of occupancy, the applicant shall provide recorded legally binding documents that state the maintenance and ownership responsibilities for the management of the development, including but not limited to, structures, parlang, common areas, and other development features. The responsible party shall be a single entity overseeing the entire multi-family development. 4. The applicant shall record a final plat prior to the issuance of a huilding permit for any structure within the proposed development. Conditions Document MulUeny Apaitmcnts CLC & DES Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement maybe accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The site plan prepared by Houston and Bugatsch Architects, dated 06/03/13, labeled Sheet. A0.1 and A0.2 are approved (stamped "approved" on 06/27/13 by the City ofMeridian Planning Division} with the following changes: • Coordinate with the Parks Department on the pathway connection to the park. s The approved CUP requires a children's play structure within the play area. Prior to the issuance of a building permit, the applicant shall provide a detail of the play structure and include the amenity on the site plan and landscape plans submitted to the Building Division. 5. The landscape plan prepared by Houston and Bugatsch Architects dated 03/U8/13, labeled Sheet L1.0 is approved (stamped "approved" on 06/27/13 by the City ofMeridian. Planning Division} with the following comment: o All existing (street buffers) landscaping adjacent to the construction zone must retrain protected during construction on the site. Protect any existing h•ees on or adjacent to the subject property that are greatc,r than four- inch caliper and/or mitigate for the loss of such trees as set forth in UDC 11-3B-10. 6. The elevations prepared by Houston and Bugatsch Architects, dated 06/03/13, labeled A2.0, are approved (stamped "approved" on 06/27/13 by the City ofMeridian Planning Division) with the following comment: o At a minimum the apartment buildings shall have three color schemes and include two field colors and one trim color. The carports shall be painted and/or powder coated to match the color scheme of the development. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City ofMeridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City ofMeridian Planning Division for approval prior to issuance of the buildingpermit. 10. The applicant shall complete all required improvements prior to issuance of a Certifcate of Occupancy. It is unlat ful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. If the subject property is part of a final plat that has not yet recorded, the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. Conditions Document 2 Mulberry Apartments CZC & DES Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set. forth in UDC 11-38-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (PP-12-010, CUR12- 006 and FP-13-006). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. The building and perimeter outdoor lighting shall have downward shielding and shall not impact the ssingle-family residences to the north of the development. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-27. 9. The conditional use approval shall be null and void if the applicant fails to 1) commence the use within two years as set forth in UDC 11-SB-6F1 or 2) gain approval of a time extension as set forth in UDC 11-SB-6P4. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before July 12, 2013, within fifteen (15}days after the written decision is issued, and contain the information listed in UDC 11- SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Toning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Cerkif cate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with conshuction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Rezoned in 2005 under Application RZ 04- 014, the 2.4-acre site and buildings follow the guidelines contained in the Meridian Design Manual and Meridian City Code. The property is not subject to a development agreement as a condition of rezone. The gross density of the development is 15 units per acre, with 1.06 acres of open space provided (44.17%} and 4.67 acres of useable open space provided (27.91 %). Access to the property is provided by a single driveway to Ashby Drive, a residential collector providing access to Meridian Road. Internal drives will be owned and maintained by the property owners within the development. As designed, the site has excellent internal circulation and access to the public road system, which has adequate capacity to accommodate the trips generated by this development. A total of nine fourplex units will be conshucted on the site. One of the units will house an on-site property manager's office for the entire development. Landscaping and the amenities will be maintained by a private, off site landscaping company. Narrative describing compliance with the guidelines contained in the Meridian Design Manual: 1. Architectural Character: a} Facades. The building facade is modulated to create visual interest and shadow lines on all sides of the building. Lower floor elements (utility closets, bike storage) project from the vertical facade to help create articulation and provide covered entries and patios. b) Primary Entrance. There are (4) primary entrances into each Fourplex unit. Each entrance is defined by a low roof covering and gabled facade. The entry doors are set back fiom the vertical plane to create a covering and delineate a path. The lower facade portion of the building is designed so that an occupant can identify their portion of the residence by the use of overhangs, private patios, and modulating pieces that create privacy from the adjacent entries. Door and windows on the lower floor also help to define location of the building and bring a human scale. A cultured stone wainscoting provides a unique texture and variation to the lower level, and helps anchor poztions of the building. e} Mechanical Equipment. AC condensers will be the only mechanical equipment not contained within the building. Landscape screening will occur around the development to effectively hide the condensers from public view. 2. Materials: Building materials match or mimic other materials used on adjacent single-family residential properties. The use ofhorizontal and shake style siding, and cultured-stone is readily found throughout properties surrounding the site. Colors to be selected are in the natural or neutral ranges. Light browns, greens, and/or grays. 3. Parking Lots: Parking for this site is screened from the main arterial right of way by placement of the buildings. Parking is located internally within the site with a single drive aisle access, and a roundabout that directs parking into (4) distinct sections. 4. Pedestrian. Walkways and facilities: Pedestrian walkways, sitting/play areas, and gardens are located throughout the site. Care is taken to provide connections to Settlers Park and W. Ashby Drive. Walkways are designed to provide efficient access to unit entries and all. areas of the site.
