Hi Larry,
Attached (as a Word file) is the Sign Ordinance we discussed this morning. It was adopted by City Council on 2-20-01 as
Ordinance 01-909. It repealed Chapter 14, Title 11 in its entirety and enacted a new Chapter 14.
The question we (P&~ staff) have for you is related to Section 11-14-8.B re. Legal Non-Conforming signs. The reason
KFC was forced to reduce the height of their bucket sign is sub-paragraph 6, which requires it to become conforming if
there are alterations to the building on the property in excess of 25% of the existing building. The developer submitted an
application to construct a new restaurant on the site, Which is greater than 25% area of the old restaurant. A Variance
application is in process to keep the existing, non-conforming, free-standing bucket sign. Their hearing on the Variance is
stated for the 4-16-02 City Council meeting.
In the meantime, the developer has submitted a sign application for the wall signs on the property. The question is, can w
process/approve their sign application for wall signs prior to the Variance application for the free-standing sign being
decided by Council? Section 11-14-4. F, Issuance or Denial, states that the Planning Director can issue a new sign permit
"upon finding that the sign complies with all appropriate laws and regulations of the City." Technically, the wall signs mee
this finding, which are the only signs proposed in the application. However, the site on which the wall signs are proposed
has afree-standing sign that is out of compliance.
The other related question for you is the last paragraph of Section 11-14-8.B, which states that non-conforming signs mu.
be removed within 60 days after the event that makes it non-conforming. In this case, the event that made it non-
conforming was approval of the new restaurant. But what date do we actually tie the 60 days to? Issuance of building
permit? Occupancy? And what does this mean for issuance of additional permits on the site (i.e, the wall signs permit)?
