On or before the date of this Lease, Tenant shall deposit with Landlord a security deposit in the sum specified in the Lease Summary, Section K, ("Security Deposit"). The Security Deposit shall be held by Landlord, without liability for interest, as security for the faithful performance by Tenant of all the terms, covenants and conditions of this Lease. 8.2 Use and Return of Deposit. If Tenant fails to timely pay or perform any obligation under this Lease, Landlord may apply all or any part of the Security Deposit as may be necessary to compensate Landlord for the payment of any monetary obligation due under this Lease, or for any other loss or damage sustained by Landlord by reason of Tenant's failure. If all or any portion of the Security Deposit is so used, retained, or applied, Tenant shall, upon the written demand of Landlord, immediately deposit with Landlord a sufficient amount in cash to restore the Security Deposit to the original -amount. Tenani's failure to do -so within five (5) days er receipt of suchdemnd sfiall constitute a default under this Lease. Should Tenant comply with all of the terms, covenants and conditions of this Lease, including the prompt payment of all rent specified in this Lease, as it falls due, and all other sums payable by Tenant to Landlord, the Security Deposit shall be returned in full to Tenant at the end of the term of this Lease, or upon the earlier termination of this Lease. 8.3 Transfer of Deposit. If Landlord's interest in the Leased Premises is conveyed, Landlord shall transfer the Security Deposit to Landlord's successor -in -interest, and Landlord shall be discharged from any further liability with respect to the Security Deposit. Tenant shall not make or cause to be made any alterations, additions, or improvements or install or cause to be installed any trade Mures, exterior signs, floor coverings, interior lighting, plumbing fixtures, shades awnings, or canopies or make any other material changes to the Leased Premises without obtaining Landlord's prior written approval. Tenant shall present to Landlord plans and specifications for such work at the time approval is sought, and if required by Landlord, Tenant shall also provide security for the completion thereof in the form of a bond or other security satisfactory to Landlord. All such work shall comply with all Laws. Any material installed in - --violation of this provision may be removed by Land lord9 with a costs of removal and restorati®n to be reimbursed by Tenant to Landlord on the next installment of Additional Rent. All Tenant signage shall be consistent with the Planned Sign Program (City of Meridian) section 11-14-9.E.2.. Tenant wall signage shall be individual letter type consistent with existing Tenants signs and must be approved by Landlord prior to fabrication and installation. Additionally, any Tenant allotted space on the existing free-standing Tenant sign shall have copy and design approved by Landlord prior to installation. SHOPPING CENTER LEASE - Page 10
