ANSWER:
Neither of the definitions in Section 3 distinguishes between commercial free-standing signs and
residential subdivision identification signs. However, Tables A thru I in Section 10 do distinguish
between these two general sign types (by virtue of creating a separate category in the table and
establishing different dimensional requirements/standards fox them). As such, should there be a
difference between commercial signs and residential subdivision identification signs in how sign
height is measured and determined?
Based upon die d~finidon of a "sign" in 11-14-3, the purpose is to regulate the sign area used for
"communicating information to the public." The sign ordinance specifically states that the height of
the sign includes visual appurtenances, landscape berms and/ox support or ornamental elements. The
intent of the ordinance is to have a uniform sign height, particularly in commercial areas where
businesses are aggXessively competing with one another. The ordinance language is clear with regard
to such commercial signs.
We have recently seen a shift in the design and quality of residential subdivision identification signs
within the city. Many of these signs are incorporated into large landscape architectural and/or
architectural entry features. As such, the sign is only a part of the entry feature. Staff has previously
limited the height llof such architectural features to six (6) feet -consistent with the sign height
regulations as applied to commercial signs. However, residential subdivision signs require greater
flexibility in deter~hining the height of signs related to the area used for communicating to the public.
Staff will now determine sign height based on that portion of a structure which is physically
supporting the sign background area. Other architectural elements primarily related to the entry
feature will not ba regulated as part of the sign
Regarding the question of where the sign height is determined from, there should be no difference
between commercial, residential or any other type of free-standing sign. The height measurement will
always be measured per the first sentence of the "Height of Sign" definition in MCC 11-14-3 (e.g.
using the adjacent grade as the baseline for the measurement and including landscape berms, etc.).
Finally, my interpretation of MCC 11-14-3 and 11-14-10 is that the definition of "Height of Sign"
does not adequately address all of the possible sign types and, specifically, is not intended to prohibit
or discourage developers from constructing creative entrances to their subdivisions using a mixture
of elements. Rather, the City of Meridian wants to encourage innovative designs to create attractive
entrances and features along our roadways. I do not interpret the Sign Ordinance and maximum
height as intending to apply to fences, walls, or other architectural features within these subdivision
entrance areas. Tlierefoxe, while the residential subdivision identification sign itself is restricted to the
six (6) foot maximum height, other structures within the common lot may be allowed to exceed the
six (6) feet as long as they do not exceed the maximum height allowed within the zone. Other
determinations may be made on a case-by-case basis by the Zoning Administrator.
