Roger Llewellyn, on behalf of Money Tree has applied for a Planned Sign Program for 519 E. Fairview
Avenue (multi-tenant building.) This site and previously approved signs existed prior to the current Sign
Ordinance. The sign ordinance requires that a Planned Sign Program (PSP) be applied for with any
new sign permit applications when one does not already exist. This letter outlines my review and
approval notes of the Planned Sign Program.
The number and types of approved signage are as follows:
Center /Commercial Signs
No center sign for this multi-tenant building is approved with this PSP.
Wall Signs
• Only one wall sign (Money Tree) is proposed and approved at this time
• Future tenant signs will require separate sign permits and must comply with this program.
• Future proposed wall signs must be consistent in design as detailed in the lease agreement
submitted with the PSP.
**All signage must be in compliance with MCC 11-14.

9. Options to Extend_ provided that Lessee is not then in default in the
performance of the Lease, Lessee shall have an option to extend the term of
the Lease for four (4) additional terms of five (5) years each, upon the same
terms and conditions set forth in the Lease as amended. Such options to
. extend shall be exercised by written notice given to Lessor not -ess than one
hundred eighty (180) days prior to the end of each respective lease term. The
minimum rent For the first year of~each extended lease term shall increase by
three percent (3%) over the minimum rent for the prior year. The minimum
rent for the second year of each extended term and each year thereafter, shall
increase by three percent (3%) over the minimum rent for the prior year.
] 0, Security Deposit. Pursuant to the Rider to the Lease, if the option to renew is
exercised by Lessee, the Security Deposit of $2,000 shall be credited to the
13`" month of the option period. According to our records, this has not
occurred, Landlord agrees to credit the original Security Deposit of $2,000
against first (1~`) month's rent in the New Premises. Further, Landlord shall
no longer require Tenant to maintain a Security Deposit pursuant to'the Lease.
11 _ Use. Tenant will use the Premises for retail financial services including, but
not limited to, check cashing, small loans, payday loans, title loans, mortgage
loans, tax preparation, electronic filing of tax returns, tax refund anticipation
loans, money order sales, receivable factoring, Western Union or Moneygram
wire transfers, prepaid long distance phone cards and Automated Teller
Machine electronic banking_
l2_ AssignmentlSubletting. Tenant shall have the right, without Landlord's
consent; to assign the Lease to an entity with which Tenant may merge or
consolidate, to any subsidiary of Tenant, to any corporation under common
control with Tenant, or to a purchaser of all or substantially al! of Tenant's
assets. Except as sat forth above, Tenant ~shaU riot assign the Lease in whole
or in part without Landlord's consent, such consent not to be unreasonably
withheld, conditioned or delayed.
13. ~arty')<'ermi~ation. Tenant shall have the right to terminate the Lease upon
One Hundred Twenty (120) days written notice if,. by a change in federal,
state or local law, rule, regulation or ordinance, it becomes no longer possible,
or economically practical to make small loans and/or payday loans as
currently allowed by such applicable laws, rules, regulations and ordinances.
1f Tenant elects to exercise this termination option, Tenant shall pay Landlord
a Five Thousand Dollar ($5,000) early termination fee upon tendering written
notice.
l4. Signage, Tenant shall be entitled to combine the top two (2) pane) spaces on
Landlord's new multi-tenant pylon sign for the center (see attached Exhibit
C). Tenant shall prepare a design rendering for Landlord's approval, which
shall not be unreasonably withheld, The new panel shall be fabricated,
installed, and maintained at Tenant's sole expense.
