Letter by Ron Sumner w/Pic 5/21/13Meridian City Council 33 East Broadway Meridian, ID Hearing Date: May 22, 2013 Regarding: Application MDA 13-009 by Wal-Mart Stores, Inc. for modification of the Development Agreement. The request to change the fencing type along the southern boundary of the site from a 8 feet tall vinyl to a 8 feet tall pre-cast concrete fence is welcomed by the adjacent homeowners, with the following exception: The proposed fence is planned to be built just inside the Wal-Mart property line, leaving a potential fora "Spite Strip" of "no-man's" land between the existing 5 foot vinyl fence and the new fence. This will create a serious safety hazard, as well as anon-maintained strip of land locked between the fences. This safety hazard is serious if a child was to crawl over the shorter fence to retrieve a ball or any other reason, and became trapped. This can also become a haven for rodents and other undesirable varmints. An example of a similar Spite Strip between fences can be seen at the Wal- ent to occur in Meridian. ;~x pY We formally request that this modification be denied by the City, unless Wal-Mart agrees to remove the existing vinyl fence, and replace it with their pre-cast concrete fence, tying in all existing residential property dividing fences to join with the new fence.
